VIOLATION OF CHAPTEFI 6.95 CALIFORNIA HEALTH AND SAFETY CODE SECTION 25503.5 (a) Any business, except as provided in subdivision (b) and (c), which handles a hazardous material or mixture containincj a hazardous material which has a quantity at any one time during the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, or 200 cubic feet at standard temperature and pressure for a compressed gas, or if the substance is a radioactive material which is handled in quantities for which an emergency plan is required to be adopted pursuant to Part 30 (commencing with Section 30.1), Part 40 (commencing with 40.1), or Part 70 (commencing with 70.1 ) of Chapter 10 of Title 10 of the Code of Federal Regulations (54 Federal Register 14051), or pursuant to any regulations adopted by the state in accordance with those regulations, shall establish and implement a business plan for emergency response to a release or threatened release of a hazardous material in accordance with the standards in the regulations adopted pursuant to Section 25503. VIOLATION OF CHAPTER 6.95 CALIFORNIA HEALTH AND SAFETY CODE[ SECTION 25509(a)(1-6) (a) The annual inventory form shall include, but shall not be limited to, information on all of the following which are handled in quantities equal to or greater than the quantities specified in subdivision (a) of Section 25503.5: (1) A listing of the chemical narne and common names of every hazardous substance or chemical product handled by the business. (2) The category of waste, including the general chemical and mineral composition of the waste listed by probable maximum and minimum concentrations, of every hazardous waste handled by the bUsiness. (3) A listing of the chemical name and common names of every other hazardous material or mixture containing a hazardous material handled by the business which is not otherwise listed pursuant to paragraph (1) or (2). (4) The maximum amount of eaclh hazardous material or mixture containing a hazardous material disclosed in paragraphs (1), (2), and (3) which is handled at any one time by the business over the course of the year. (5) Sufficient information on how and where the hazardous materials disclosed in paragraphs (1), (2), and (3) are handled by the business to allow fire, safety, health, and other appropriate personnel to prepare adequate emergency responses to potential releases of the hazardous materials. (6) The SIC Code number of the 13usiness if applicable. (7) The name and phone number of the person representing the business and able to assist emergency personnel in the event of an emergency involving the business during nonbusiness hours. 2) Drums not properly labeled. VIOLATION OF THE CALIFORNIA CODE OF REGULATIONS TITLE 8, SECTION 5194 4) Except as provided in Sections 5194(f)(5) and (f)(6) the employer shall ensure that each container of hazardous substances in the workplace is labeled, tagged, or marked with the following information: 2 (A) Identity of the hazardous subsllance(s) contained therein; and (B) Appropriate hazard warnings. (5) The employer may use signs, placards, process sheets, batch tickets, operating procedures, .or other such written materials in lieu of affixing labels to individual stationary process containers, as long as the alternative method identifies the containers to which it is applicable and conveys the information required by section 5194(f)(4) to be on a label. The written materials shall be readily accessible to the employee.,; in the work areal throughout each work shift. In construction, the employer may' use such written materials in lieu of affixing labels to individual containers as long as the alternative method identifies and accompanies the containers to which it is applicable and conveys the information required to be on a label. 6) The employer is not required to label portable containers into which hazardous substances are transferred from labeled containers, and which are intended only for the immediate use of the employee wlho performs the transfer. In construction, the employer is not required to label portable containers into which hazardous substance are transferred from labeled containers, so lang as either the labeled container stay on the job site or the employer has complied with section 5194(0(5). (7) The employer shall not remove or intentionally deface existing labels on incoming containers of hazardous substance, unless the container is immediately marked with the required information. . (8) The employer shall ensure that: labels or other forms of warning are legible, in English, and prominently displayed on the container, or readily available in the work area throughout each work shift. Employers having employees who speak other languages may add the information in their language to the material presented, as long as the information is presented in English as well. (9) The manufacturer, importer, distributor, or employer need not affix new labels to comply with this section if existing labels already convey the required information. 3 3) Hazardous Materials containers open on site. VIOLATION OF THE CITY OF BAKERSFIELD MUNICIPAL CODE SECTION 15.64.340 Hazardous materials shall be stored in such a manner as to prevent spills or accidental releases. All containers shall be closed when not in use and good housekeeping maintained in the area of storage and use. 4) Waste oil spilled onto the ground in the pit area. VIOLATION OF SEC 80.104 OF THE UNIFORM FIRE CODE' Hazardous materials shall not be released into a sewer, storm drain, ditch, drainage canal, lake, river or tidal waterway, or upon the ground, sidewalk, street, highway or into the atmosphere. 5) Hazardous Materials Training inadequate. VIOLATION OF SEC 80.109 OF THE UNIFORM FIRE CODE Persons responsible for the operation of areas in which hazardous materials are stored, dispensed, handled or used shall be familiar with the chemical nature of the materials and the appropriate mitigating actions necessary in the event of fire, 'leak or spill. Responsible persons shall be designated and trained to be liaison personnel for the fire department. These persons s;hall aid the fire department in preplanning emergency responses and identification of the locations where hazardous materials are located and shall have access to Material Safety Data Sheets and be knowledgeable in the side emergency response procedures. 6) Material Safety Data Sheets not availalble. VIOLATION OF SECTION 80.106 OF THE UNIFORM FIRE CODE 4 Material Safety data sheets (MSDS) shall be readily available on the premises for hazardous materials regulated by this article. The above violations must be corrected by April 30th 1994 Failure to correct these violations will resUlt in further' enforcement action.
