BOX 6278 · BAKERSFIELD, CALIFORNIA 93386 · (805)589-5648 September 18, 1995 Bakersfield City Fire Department ATTENTION: HOWARD WINES 1715 Chester Avenue Bakersfield CA 93301 Dear Mr. Wines SUBJECT: Tank Closures for Property Located at 1222 Golden State Avenue~ Bakersfield, CA On July 10 & 11, 1995 CALPI, Inc. removed 3,285 Gallons of gasoline contaminated water from three 5,000 gallon underground storage tanks located at Golden State Tinting, 1222 Golden State Avenue, Bakersfield, CA. Fluid was disposed of at Gibson Environmental in Bakersfield, CA under hazardous waste manifest #93196521 & #93196540. On July 20,. 1995 CALPI, Inc. utilized Melton Drilling of Bakersfield, CA to slant drill six test holes beneath each end of the 5,000 gallon tanks. Twelve soil samples were analyzed at BC Laboratories for TPH Gasoline and BTX&E. A complete chemical analysis is enclosed. On September 11, 1995 CALPI, Inc. again utilized Melton Drilling to cement the void space in each tank using a 'cement slurry consisting of two sacks of cement per cubic yard of concrete. At a minimum, the workplan shall include: 1) Obtaining a valid permit to Abandon, issued by this office, for abandoning the tanks in place in a manner consistent with the California Underground Storage Tank Regulations. 2) Removal of the fluid remaining in the tanks and proper transportation and disposal at an appropriate facility. 3) Soil samples shall be collected below the tanks at depths great enough to assure that any potential environmental threat will bedetected. Prior to September 5, 1995, you shall obtain a valid permit to Abandon, issued by this office, for abandoning the tanks in place pursuant to a previously approved workplan. Prior to December 5, 1995, you shall perform all of the work necessary to close the tanks as listed in the approved workplan under a valid permit to Abandon issued by this office. A formal closure report shall be submitted to this office within 5 days after the soil sample results are available. Although there appears to have been prior attempts at abandonment, our position is that the tanks and associated piping have not met the standards that this office enforces for proper tank closure. As a policy, this office does not normally allow abandonment in place. However, due to the previous efforts toward abandonment, we may consider this as an option provided: 1. A permit for tank closure is obtained through this office. Please give this office 2 working days notice prior to the commencement of any work. 2. A Preliminary Site Assessment is performed including analysis of soil samples obtained at 2' and 6' below and 1/3 of the way in from both ends of each tank. All companies and individuals retrieving samples must submit an acceptable sampling procedure to this office before the samples can be taken. 3. All piping is disconnected from the tanks and removed from the site. Soil samples must be retrieved from 'areas below pipelines extending from the tank and below dispenser islands. Samples must be retrieved for every 15 linear feet of pipeline, at 2' and 6' below the piping. Samples must be retrieved directly under each dispenser area, also at 2' and 6' depths. 4. All remaining liquid shall be removed from the tanks. The resultant hazardous waste must be transported under manifest to a state approved disposal or treatment facility. All flammable vapors shall be purged from the tanks. 5. The tanks are to be filled with a sand slurry consisting of a ratio of two sacks of cement per cubic yard of concrete. The filling process must continue until the material flows from all apertures in the top of the tank. Care must be taken in the filling process to prevent voids from occurring. Additional site characterization may be required as result of the soil sample analysis. I believe you have been informed by Joe Dunwoody in his February 24, 1992 letter referencing state guidelines for allowing certain levels of petroleum hydrocarbons allowed to remain in the soil if it is determined that they pose no threat to the ground water or public safety. As discussed earlier only when levels are below detectable limits (Non-Detectable) can a site be referred to as "clean". However, State guidelines do allow for certain levels of petroleum hydrocarbons to remain in the soil if it is determined that they pose no threat to the ground water or public safety. This determination is based on the leaching potential of the petroleum constituents involved. Based on a cursory review of the environmental setting of the property located at 1222 Golden State Avenue the levels allowed to remain in place would be: 1000 parts per million (ppm) for Total Petroleum Hydrocarbons as Gasoline (TPHG): 1 ppm for benzene; and 50 ppm for toluene, xylene and ethylbenzene. It should be noted that the above stated levels are not the levels' that would be allowed to remain based on preliminary sampling that occurs during a typical tank abandonment. The above stated levels are allowable after a thorough site characterization has been performed and reasonably demonstrates that the impacted soil is confined to a small area directly below the tanks. The levels of petroleum hydrocarbons that could remain in the soil without requiring a site characterization are significantly lower than the above stated levels. In short, if the sample collected from 2 feet below the tank has a TPHG level of 200 ppm and a sample collected 10 feet below the 2 foot sample has a TPHG level of 20 ppm; then the extent of contamination would be considered limited and a site characterization would not be required. Extenuating circumstances, such as contradictory evidence would require, according to State Guidelines, that a site characterization be performed. Soil was sampled under the-direction of Bakersfield City Fire Department, Hazardous Materials Division. The samples were analyzed at SMC of Bakersfield for TOX, lead and oil and grease. We have done quite a bit of research on our problem and believe we finally have something definitive with respect to the closing of the tanks. The property was originally used as a Texaco station and was owned by Dr. William H. Moore. The executor of Dr. Moore's estate, H.E. Rickard, explained to me that when Dr. Moore died in 1968 Texaco had three more years left on its lease. Some time in the latter half of 1971 Texaco subcontracted to have the underground storage tanks filled with drilling mud. Dr. Moore's son in law, Walter W. Griffith Sr., witnessed the filling and has supplied us with a written statement to that effect (Enclosed). SEC. 15.211 FLAMM.~BLE AND COMBUSTIBLE LIQUIDS III liquid to the nearest wall of any basement, pit, cellar or prop- erty line shall be not less than 1 foot. The distance from any part of a tank storing Class I liquids to the nearest wall of any base- ment, pit or cellar shall be not less than 1 foot, and from any prop- erty line that may be built upon, not less than 3 feet. A minimum distance of one foot, shell to shell, shall be maintained between underground tanks. b. Depth and Cover. Excavation for underground storage tanks shall be made with due care to avoid undermining of foundations of existing structures. Underground tanks shall be set on firm foundation and surrounded with soft earth or sand well-tamped in place. Tanks shall be covered with a minimum o£ 2 feet of earth or shall be covered by not less than 1 foot of earth on top of which shall be placed a slab of reinforced concrete not less than 4 inches thick. When underground tanks are or are likely to be subjected to traffic, they shall be protected against damage from vehicles passing over them by at least 3 feet of earth cover, or 18 inches of well-tamped earth, plus 6 inches of reinforced con- crete or 8 inches of asphaltic concrete. When asphaltic or reinforced concrete paving is used as part of the protection it shall extend at least 1 foot horizontally beyond the outline of the tank in all directions. c. Anchorage. Where a tank may become buoyant dueto a rise in the level Of the water table or due to location in an area that may be subjected to flooding, suitable precautions shall be observed to anchor the tank in place. Section 15.211. INSIDE OF BUILDINGS. Tanks for storage of flammable or combustible liquids shall not be installed inside buildings except as provided under Divisions V, VI or VII, and in accordance with the construction and occu- pancy separation requirements of the Building Code for a Group E-2 occupancy. Tanks for the storage of flammable or combustible liquids may be installed under a building as an underground tank complying with Section 15.210. Section 15.212. ABANDONMENT OF TANKS. a. Whenever any tank is taken out of service or shall not have been used for a period of ninety (90) days, such tanks shall be prop- erly safeguarded, abandoned or removed in a manner approved by the Chief. b. A permit shall be obtained from the Chief to remove, aban- don, place temporarily out of service or otherwise dispose of any flammable or combustible liquid tank. c. Any underground tank which is to be permanently aban- doned shall be removed from the ground and the hole properly filled. If circumstances warrant, however, such tank may be abandoned in place in a manner and with a material approved by the Chief. d. Tanks "temporarily out of service" shall have the fill line, gage opening and pump connection secured against tampering. Current law requires that all owners of existing underground storage tanks apply for a permit to operate their facilities, unless they meet exemptions provided in Chapter 6.7 of California's Health and Safety Code. The exemptions provided in law are listed below: 1. A tank with a capacity of 1,100 gallons or less which is located on a farm and which stores motor vehicle fuel used primarily for agricultural purposes and not for resale. 2. A tank which is located on a farm or at the residence of a person which has a capacity of 1,100 gallons or less and which stores home heating oil for consumptive use on the premises where stored. 3. Structures such as sumps, separators, storm drains, catch basins, oil field gathering lines, refinery pipelines, lagoons, evaporation ponds, well cellars, separation sumps, lined and unlined pits, sumps, and lagoons. 4. Tanks not substantially underground. 5. Current law requires that all owners of existing underground storage tanks apply for a permit to operate their facilities, unless they meet exemptions provided in Chapter 6.7 of California's Health and Safety Code. The exemptions provided in law are listed below: 1. A tank with a capacity of 1,100 gallons or less which is located on a farm and which stores motor vehicle fuel used primarily for agricultural purposes and not for resale. 2. A tank which is located on a farm or at the residence of a person which has a capacity of 1,100 gallons or less and which stores home heating oil for consumptive use on the premises where stored. 3. Structures such as sumps, separators, storm drains, catch basins, oil field gathering lines, refinery pipelines, lagoons, evaporation ponds, well cellars, separation sumps, lined and unlined pits, sumps, and lagoons. 4. Tanks not substantially underground. 5. Tanks storing substances not designated as "hazardous"; the following liquid and solid substances are considered "hazardous substances": -- those defined as such in Section 25316 of the Health and Safety Code of the State of California 2700 "M" STREET, SUITE 300 BAKERSFIELD, CALIFORNIA 93301 (805) 861-3636 Max and Bernadine Foutz December 21, 1990 page 2 -- substances on the list prepared by the Director of Industrial Relations pursuant to Section 6382 of the Labor Code of the State of California -- any substance or material classified by the National Fire Protection Association as a flammable liquid, a Class II combustible liquid, or a Class III-A combustible liquid -- any regulated substance, as defined ~n Subsection (2)' of Section 6991 of Title 42 of the United States Code, as that section reads on January 1, 1989, or as it may subsequently be amended or supplemented. OWNERS OF THE FACILITIES NOT DESCRIBED AS EXEMPT ARE CURRENTLY VIOLATING THE LAW AND MUST OBTAIN ONE OF.THE FOLLOWING PERMITS IN ORDER TO BRING THE FACILITY INTO COMPLIANCE: -- A permit for operation -- A permit for tank removal The owner must submit a completed application to the Kern County Environmental Health Services Department before the permit will be issued. To assist you with compliance, the Department has included applications and instructions for the proper completion of each application within this packet. Completed forms must be returned within 14 days. The application for the permit for permanent closure of your tanks is to be submitted IN LIEU OF the application for the permit to operate. Failure to obtain a permit may result in fines of five hundred aollars (8500) to five thousand dollars ($5,000) per day per Division 8, Section 8.48.480, of the Kern County Ordinance Code. We have done quite a bit of research on our problem and believe we finally have something definitive with respect to the closing of the tanks. The property was originally used as a Texaco station and was owned by Dr. William H. Moore. The executor of Dr. Moore's estate, H.E. Rickard, explained to me that when Dr. Moore died in 1968 Texaco had three more years left on its lease. Some time in the latter half of 1971 Texaco subcontracted to have the underground storage tanks filled with drilling mud. Dr. Moore's son in law, Walter W. Griffith Sr., witnessed the filling and has supplied us with a written statement to that effect (Enclosed). Please let us know if this statement will suffice to document the date and procedure used in the tank abandonment. Once again, your help and cooperation with this matter is greatly appreciated. WHICH AT THAT TIME WAS ACCEPTABLE WITH THE AUTHORITIES ETC. I DO NOT REMEMBER WHICH C©MPAMY WAS SELECTED.
