A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
APPROVING THE FILING OF AN APPLICATION TO AHEND AN EXISTING
AGREENENT WITH THE STATE FOR GRANT FUNDS FROH THE COHHUNITY
PARKLAND ACT OF 1986 TO INCLUDE ACQUISITION AND DEVELOPMENT
OF A PARK SITE IN NORTHEAST BAKERSFIELD.
WHEREAS, the people of' the State of California have enacted the Community
Parkland Act of 1986 which provides funds to the State of California and its political
subdivisions for acquiring lands. and developing facilities for' public recreational
purposes; and
WHEREAS, the State Department of Parks and Recreation has been delegated
the responsibility for the administration of programs under said Act setting up necessary
procedures governing application by local agencies under the program; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of amended appli-
cations prior to submission of said applications to the State; and
WHEREAS, said applications contains assurances that the applicant must comply
with; and
WHEREAS, the applicant agency will enter into an agreement with the State of
California for the acquisition and development of the project.
NON, THEREFORE, BE IT RESOLVED that the City Council hereby:
1. Approves the filing of an amended application for the 1986 State Grant
assistance for the above project..
2. Certifies that said agency has or will have sufficient funds to operate
and maintain the project when construction is completed; and
3. Certifies that said agency understands the assurances and certifications
in the application; and
4. Certifies that said agency has or will have available prior to commencement
of any work on the projects included in these applications matching money from a nonstate
source for the acquisition portion; and
5. Certifies that the projects included in these applications conform to the
park policy contained in the Open Space Element of the applicable City genera] plan; and
6. Certifies that said agency will provide acquisition documents to the State
within one (1) year upon approval of the amended application; and
7. Appoints the City Manager or designee as agent of the City to conduct all
negotiations, execute and submit all documents including, but not limited to applications,
agreements, amendments, payment requests, and so on which may be necessary for the completion
of the aforementioned projects; and
8. Appoints Arthur d. Saalfield legal counsel of the City for purposes hereof.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting thereof held on the 21st day
