James J. Hoblitzell & Associates was retained to investigate the possibility
of effectuating an in-ground closure of an approximate reported 500 gallon
underground Waste oil storage tank at 3309 Gulf Street, Bakersfield, California.
It was reported to James J. Hoblitzell & Associates (JJHA) by the site owner, Mr.
Jerry .Swoape that he.had inherited the property which had been purchased by
his father circa 1930.. The'original portion of this metal corrugated building
had been, it was reported, one of the first stables in the Bakersfield area. Over
the years, the building has been added onto and for a period of time, also served
as a diesel repair shop for a tenant. For the past approximate ten or so years,
the facility, it was reported, has been utilized as personal storage. The
building is currently approximately sixty-five (65) feet by seventy-five (75) feet.
Within the southeast (SE) corner is a small interior room approximately ten ('10)
by twenty-five (25) feet.
It was reported and estimated that sometime in the 1940's the waste oil tank
was installed. As the tank is located~in an interior room and not readily accessible,
it was felt that an in-ground closure would be the'most practical solution to
tke this tank permanently out of service and close the site. In Bakersfield,
California, the appropiate regulatory authority is the Bakersfield Fire Department,
Office of Environmental Services'. An inquiry was made to the head of this department
and concurrence received that an in-ground closure would be appropiate and proper.
Thereafter, an application was made for proper permits and authority.and sub-
sequently received.
On 10 October, 1996, JJHA utilized a high pressure hot water cleaner and
non-halogenated cleaner to rinse the tank. 'Initially, the tank was evacuated
of residual and ~vacuated into a vacuum truck for proper disposal at the
proposed disposal facility. The certified scales at the disposal facility
indicated that a total of 1,700 pounds (.85 tons) or approximately 212 gallons
of rinseate was disposed of. After approximately ten (10) cleaning cycles of
rinsing, the rinseate was off hauled for disposal~by Hayter Trucking, Inc., a
division'of General Production of Taft, California. Tank rinseate was transported
to the McKittrick Waste Disposal Site at McKittrick, Californiawhere it had been
properly profiled for acceptance. ~
JJHA had retained Horizon Environmental, Inc.'of Bakersfield to conduct the
soil sampling required pursuant to posted permit conditions. Mr. Dayne Frary,
Registered Geologist (R.G.), Senior Geologist forHorizon Environmental, Inc.
conducted soil sampling utilizing a hand auger. All samples were shipped pursuant
to LUFT requirements under Chain of Custody to Sherwood Labs Corporation, DHS
Certification # 1400, in Hilmar, California. The results of those soils analysis
are attached.

After'tank cleaning, rinsing, evacuation and soil sampling was completed,
Southwest Ready Mix, Inc. of Taft, California cuased a truck to be on site
wherein a'concrete sand mix known as a two (2) sack slurrywas introduced
into theempty clean tank. Approximately three (3) cubic yards of the two (2)
sack slurry.mix was utilized indicating that the tank was, in fact, either a
500 or 550 gallon waste oil tank. The a.rea was.cleaned and the job completed
on 10 October, 1996. I have personal, knowledge that the events as indicated
in this report actually transpired.

RE: Closure of UST Site located at 3309 Gulf Street, Bakersfield, CA.
Dear Mr. Hoblitzel:
Per your request, we have reviewed the UST closure for a waste oil tank
located at 3309 Gulf Street, Bakersfield, California. We concur that a closure in place
would be appropriate for this tank. Closure in place must consist of emptying the ·
tank of all contents, cleaning the tank, filling the tank with a two-sack cement
mixture, removing all above grade piping including any vents, and removing soil
samples utilizing either a drill or hand auger (boring at an angle) from two feet and
six feet under the tank..The soil samples must be sampled for total petroleum
hydrocarbons (TPH) as oil and grease. No heavy metal's analysis is required unless
the test results detect TPH as oil and grease.
The appropriate application, is the Tank Removal Permit. If I can be of any
further service, please do not hesitate to call me.

RE: Closure of UST Site located at $~L~l~n~l:f~, Bakersfield, CA.
Dear Mr. Hoblitzel:
Per your request, we have reviewed the UST closure for a waste oil tank
located at 3309 Gulf SWeet, Bakersfield, California. We concur that a closure in place
would be appropriate for this tank. Closure in place must consist of emptying the
tank of all contents, cleaning the tank, filling the tank with a two-sack cement
mixture, removing all above grade piping including any vents, and removing soil
samples utilizing either a drill or hand auger (boring at an angle) fi.om two feet and
six feet under the tank. The soil samples must be sampled for total petroleum
hydrocarbons (TPH) as oil and grease. No heavy metal's analysis is required unless
the test results detect TPH as oil and grease.
The appropriate application, is the Tank Removal Permit. If I can be of any
further service, please do not hesitate to call me.

FOR A LONG'PERIOD OF TIME. INSIDE THE BUILDING~WHICH IS CURRENTLY UTILIZED FOR
PERSONAL STORAGE BY MR. AND MRS. SWOAPE IS A SMALL ROOM WEREIN~AN OLD WASTE OIL

IS NO ACCESS INTO THIS SM&LL ROOM OTHER THAN A MAN'DOOR FROM THE MAIN BUILDING.

It has come to our attention that you currently own property located at 3309 Gulf Street APN
332-120-04-00-7), in Bakersfield which contains at least one underground storage tank, located along
the west property line, next to the truck wash facility. The tank has not been properly permitted and
has been out of service, therefore, you are in violation of the following sections of the Uniform Fire
Code as adopted by the Bakersfield Municipal' Code, Chapter 15.64, Ordinance No. 3502:
Section 79.115 (a, b, & f) Uniform Fire Code (1992 edition).
(a) Failure to remove or safeguard an out of service tank.
(b) Failure to obtain a permit to remove or temporarily close an

Dear Mr. Swoape:
This is to confirm that the waste oil underground storage tank has been granted
temporary closure by this agency for the 12 month period beginning March 15, 1995 and
ending on March 15, 1996.
Temporary closure is hereby granted under the following conditions contained in Title
23 of the California Code of Regulations:
2671. Temporary Closure Requirements
(a)
An Owner or operator shall comply with all of the following requirements to
complete and maintain temporary closure of an underground storage tank:
(1)
All residual liquid, solids, or sludges shall be removed and handled in
accordance with the applicable provisions of in accordance with Chapters
6.5 and 6.7 of Division 20 of the Health and Safety Code.
(2)
If the underground storage tank contained a hazardous substance that
could produce flammable vapors at standard temperature and pressure,
it shall be inerted, as often as necessary, to levels that will preclude an
explosion or to lower levels as required by the local agency.
(3)
The underground storage tank may be filled with a non corrosive liquid that
is not a hazardous substance. This liquid shall be tested and the test
results submitted to the local agency prior to removal from the
underground storage tank at the end of the temporary closure report.
(4)
Except for required venting, ail fill and access locations and piping shall be
sealed using locking caps or concrete plugs.
(5)
Power service shall be disconnected from all pumps associated with the
use of the underground storage tank unless the power services some other
equipment which is not being closed, such as the impressed-current
cathodic protection system.
(b)
The monitoring required pursuant to the permit may be modified by the local
agency during the temporary closure period. In making a decision to modify
monitoring requirements, the local agency shall consider the nc-~ to maintain
monitoring in order to detect unauthorized releases that may have occurred
during the time the underground storage tank was used but that, have not yet
been detected. In all cases, corrosion protection shall continue to be operated.
(c)
The underground storage tank shall be inspected by the owner or operator at
least once every three months to verify that the temporary closure measures are
still in place, the inspection shall include but is not limited to the following:
(1) Visual inspection of all locked caps and concrete plugs.
(2)
If locking caps are used, at least one shall be removed to determine if any
liquids or other substances have been added to the underground storage
tank or if there has been a change in the quantity or type of liquid added
pursuant to subsection (a) (3) of this section.
(d)
At the end of a temporary closure period over 12 months, including any extension
granted by the local agency, the owner may reuse the underground storage tank
only if the tank meets the requirements of Article 3 for new underground storage
tanks or is upgraded to meet the requirements of Article 6.
(e)
All new and existing underground storage tank systems which have been
temporarily closed must continue to comply with repair and recordkeeping
requirements, release reporting and investigation requirements, and release
response and corrective action requirements specified in this chapter and Chapter
6.7 of the Health and Safety Code.
Failure to comply with the requirements will immediately terminate the temporary closure
status. Upon termination of temporary closure, either through non-compliance or by
expiration of the 12 month term, the tank(s) must either be integrity tested and
repermitted for operation or else removed from the site under a valid permit for
permanent closure.
