A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
APPROVING THE FILING OF APPLICATION TO AMEND AN EXISTING
AGREEMENT WITH THE STATE WHICH WOULD ALLOW THE TRANSFER
OF GRANT FONDS UNDER THE 1984 CALIFORNIA PARK AND REC-
REATIONAL FACILITY ACT FROM DEVELOPMENT OF SIERRA PARK TO
THE ACQUISITION OF A PARK SITE IN NORTHEAST BAKERSFIELD.
WHEREAS, the People of the State of California have enacted the 1984 California
Park and Recreational Facility Act of 1984 which provides funds to the State of California
and its political subdivisions for acquiring lands and for developing facilities for public
recreational purposes; and
WHEREAS, the State Department of Parks and Recreation has been delegated the
responsibility for the administration of the program, setting up necessary procedures
governing application by local agencies under the pro9ram; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of applications for
the transfer of funds prior to submission of said applications to the State; and
WHEREAS, said applications contain assurances that the applicant must comply
with; and
WHEREAS, the applicant agency will enter into an agreement with the State of
California for the acquisition of a park site.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby:
1. Approves the filing of an amended application for funding under the lg84
California Park and Recreational Facility Act to transfer moneys originally appropriated
for development of Sierra Park to acquisition of a park site in Northeast Bakersfield;
2. Certifies that said agency understands the assurances and certifications
in the application; and
3. Certifies that the projects included in this application conform to the
recreation element of the applicable City general plan; and
4. Certifies that said agency will provide acquisition documents to the State
within one (1) year upon approval of transfer of funds; and
5. Appoints the City Manager or designee as agent of the City to conduct all nego-
tiations, execute and submit all documents including, but not limited to applications, agree-
ments, amendments, payment requests, and so on which may be necessary for the completion of
the aforementioned projects; and
6. Appoints Arthur J. Saalfield legal counsel of the City of Bakersfield for the
purposes hereof.
