On November 24, 1998, Baseline received sixteen soil samples collected from the project shown above.
Baseline performed all analyses on-site using a mobile laboratory. Enclosed is the Chain-of-Custody Record.
Baseline analyzed the samples for Total Petroleum Hydrocarbons as gasoline (M8015/LUFT) and Volatile
Aromatics (EPA 8020A) including MTBE. In this report, Baseline presents the results and QA/QC summary for
this analysis.

Dear Underground Storage Tank Owner:
Having difficulty getting a return phone call from underground storage
tank contractors? Are contractors telling you that they are booked until February
and March of 1999? Has your price, that you were quoted six months ago,
almost doubled?
These are some of the concerns voiced by tank owners who are now
trying to meet the compliance deadline. With less than 53 days left, many will
fall short of being upgraded by December 22, 1998.
This office has started issuing compliance stickers to those owners who
have upgraded or replaced their underground storage tanks.' We regret that you
will not be receiving one.
For those who will not make the deadline, this office suggests that you
start preparing for closure. Your facilities will not be permitted to pump fuel
after December 22, 1998.

Dear Underground Storage Tank Owner:
One month from today, this office will start issuing compliance
stickers to those owners who have upgraded or replaced their underground
storage tanks.
We regret you will. not be receiving one. On December 23, 1998,
your current underground storage tank(s) will become illegal to operate.
Current law would require; that your permit be revoked and, without a
compliance sticker it will be illegal for you to receive fuel deliveries after
January 1, 1999.
After 90 days of closure, your tank will be considered illegally
abandoned and we will take action to properly close these tanks. If you do

relief.

You have been receiving monthly updates from this office, regarding the
underground storage tank compliance deadline, since December of 1997. I feel
we must inform you of how serious an impact non-compliance will be to your
business.
On December 23, 1998 (December 22, 1998 deadline) this office will be
forced to revoke your permit to operate, effectively shutting down your fueling
operation. On January 1, 1999, Senate Bill 1491 takes effect, banning fuel
deliveries for those who have not met the compliance upgrade.
After 90 days of closure, your tanks will be considered illegally
abandoned and we will take action to properly close these tanks. If you do not
comply with our tank closure requirement, we will find it necessary to take legal
action, including, but not limited to citation and/or injunctive relief.
It is this offices sincere hope, that we do not have to pursue such action,

WATER BALANCE
Measurements showed that water in the backfill area at the time
of testing was below tank bottom, and therefore not a facter in test
determination. A monitoring well or a well point was driven in the
backfill area to determine that there is no water in the backfill at
tank bottom.
A precision test was performed on tanks at the above location using the
Alert 1000 underfill system and the Alert 1050 ullage system. I have
reviewed the data produced in conjunction with this test for purpose of
verifying the results and certifying the tank systems. The testing was
performed in acorrdance with Alert protocol, and therefore satisfies all
requirements for such testing as set forth by NFPA 329-92 and USEPA 40
CFR part 280.
The results of testing are shown on the following page, and indicate
whether the wetted and non-wetted portion passed or failed. Included
with the report are reproduction (Df data compiled during the test which
formed the basis for these conclusion. This information is stored in a
permanent file if future verification of test results is needed.

It has been conveyed to th:is office, by Mr. Pankaj Patel, that you
administer the business affairs of Mr. Milt Younger, the property owner at 1800
"H" Street, Downtown DeliMart,
Our records reveal that you are past due on your precision tank testing on
your underground storage tanks located at 1800 "H" Street, Downtown DeliMart.
Section 2643 2(a) of Article 4; Title 23, Division 3, Chapter 16, CCR,
requires that all underground tanks, that do not utilize automated leak detection,
shall have a precision tank test annually. Pipeline leak detectors and automated
detection systems also have to be certified to be in working order.
During our inspection, it was noted that your "Emergency Shutdown"
switch cover and sign were missing. This is in violation of Section 5201.5.3 of
the Uniform Fire Code (1994 Edition)
Section 5201.5.3'
"Emergency shutdown devices shall be provided for
all fuel dispensers. Such devices shall be distinctly
labeled "Emergency Fuel Shutdown Device." Signs
shall be provided in approved locations."
You also have exposed wires directly above the emergency shutdown
switch, which are exposed and have current threw them. These must be properly
removed and capped, to prevent accidental shock. Per N.E.C. 310-2A.
To avoid further enforcement action, the above mentioned corrections
must be made within 30 days (March 27, 1998).

The City of Bakersfield has some exciting news regarding loan monies, which has just
become available through the Small Business Loan Association (SBA).
Pollution Control loans, thru the SBA, are intended to provide loan quarantees to eligible
small businesses for the financing of planning, design, or installation of pollution prevention
controls, which includes underground storage tank facilities.
The vast majority of businesses are eligible for financial assistance from the SBA. The
SBA defines an eligible small business as one that is independently owned .and operated and not
dominant in its field of operation. For those applicants that meet the SBA's credit eligibility
standards, the agency can quaranty up to eighty percent (80%) of loans of $100,000. Seventy five
percent (75%) of loans above $100,000. Lynn Knutson, Chief of Finance for the SBA says, "If
customers apply immediately, and meet the requirements, funding is available".

Underground Storage Tank Inspection Program within the next 2 weeks.
The Bakersfield City Fire Department recently changed its City Ordinance
concerning "hold open devices" on fuel dispensers. The Bakersfield City Fire
Department now requires that "hold open devices" be installed on all fuel
dispensers. The new ordinance conforms to the State of Cali£omia guidelines.

the month of January, our office had six sites (14 tanks) which are now in
compliance. This is a very big "first step".
For those who have not yet upgraded, I would like to share some thoughts
on why it is so important to act right away:

Licensed oontractors are booking up fast, in some cases, up
to three months in advance.
Supplies (pumps, dispensers, leak detection equipment)
may be scarce.
The cost for upgrading or removing could go up as demand
increases.
Assembly ]Bill 1491 will ban fuel deliveries at, er January
1999 to non-upgraded owners.
The good news, is there is still time!!! If there is anything this office can
do to assist you in your planning, do not hesitate to call.

You will be receiving this letter on our about December 22, 1997. One year
from today, December 22, 1998, your current underground storage tank(s) will
become illegal to operate. Current laws and code requirements would require that

operate would be revoked, - - it ~rill be illegal for any fuel distributer to deliver
fuel to your tank(s), - - and your tank(s) would then be considered illegally
abandoned and require that action be taken within ninety (90) days to remove the

Of course, we have no interest in pursuing this route. We would like to
have your tanks properly handled iprior to this December 22,1998 deadline. Please
review your situation and reply within two weeks as to the current (realistic) plans
for your existing tank(s).~

Measurements showed that water in the backfill area at the time
of testing was below tank bottom, and therefore not a facter in test
determination.
A precision test was performed on tanks at the above location using the
Alert 1000 underfill system and the Alert 1050 ullage system. I have
reviewed the data produced in conjunction with this test for purpose of
verifying the results and certifying the tank systems. The testing was
performed in acorrdance with Alert protocol, and therefore satisfies all
requirements for such testing as set forth by NFPA 329-92 and USEPA 40
CFR part 280.
The results of testing are shown on the following page, and indicate.
whether the wetted and non-wetted portion passed or failed. Included
with the report are reproduction of data compiled during the test which
formed the basis for these conclusion. This information is stored in a
permanent file if future verification of test results is needed.

not meet the current code requirements must be removed, replaced or upgraded to
meet the code by December 22, 1998. Your tanks do not currently meet the new

RE: Monitoring requirements for underground storage tanks.
Dear Mr. Patel:
Our records reveal that no precision tank testing has been performed
on three uderground storage tanks located at 1800 "H" Street.
Section 2643 2(A) of Article 4; Title 23, Div. 3, Chapter 16, CCR.,
requires that all underground' tanks that do not utilize automated leak
detection shall have a precision tank test annually. Additionally, pressurized
piping shall be tested annually and non-pressurized piping shall be tested
every three years.
Pipeline leak detectors, and automated leak detection systems also
have to be certified to be in working order on an annual basis.
Please make arrangernents to bring the tanks into compliance with
state law.

Dear Madam or Sir:
This letter is an official notice of your non-compliance with
state and county laws relating to underground tanks.
Upon review of our records,.it was discovered that the 1988
Permit to Operate fees for Leon's Deli Mart, 1800 "H" Street,
Bakersfield, California were not paid. Enclosed is a copy of
1988's invoice plus the §0% late penalty required by county
ordinance. The second invoice is for this year's Permit to
Operate fees. These invoices must be paid within S0 days to avoid
further penalties and/or legal action.
Be advised that these fees must be paid even if the tanks are
no longer in use. If the tanks are not in use, a permit for
permanent .closure must be obtained from this office. Permanent
closure requires either removal or closure in place of your tanks
and assessment by soil sampling to determine whether there has been
environmental damage as a result of unauthorized releases of
hazardous substances front your tank site. The specific
requirements for these activities are in Handbook #UT-30, available
with your application. No closure activity can beqin prior to the
issuance Q.f ~ permit from this office.

calibration checks within the last 30 days and were calibrated by a registered
device repairman ~f out of tolerance (all meter calibrations' must be recorded on
"Meter Calibration Check Form" found in the Appendix of Handbook).
G. Standard Inventory Control Monitoring was started at this-facility in accordanc~
with procedures described in Handbook #UT-10.

located at 1800 "H" Street Bakersfield, CA. have entered into
this written contract with Leon's Deli Mart, the operator of
same to fulfill a requi'rement of my Permit to Operate, #160025C.
I have provided the operator with a copy of the Permit to Operate
and Chapter 15 of the Ordinance.
I, Leon's Deli Mart, operator of underground storage tanks located
at 1800 "H" Street Bakersfield, .CA. have received from Petrini
Construction, owner of same, a copy of Permit to Operate #160025C
and Chapter 15 of the Ordinance describing fines and penalties
for non-compliance. I have read and understand my responsibilities
under this Permit and agree to do the following:
-- .monitor the underground tanks as specified in
the Permit to Operate.
-- maintain appropriate records as required by
the Permit to Operate.
-- implement all reporting procedures as required
by the Permit to Operate.
