RE£ #~13700 COOl RESOLUTION NO. 15-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF EAST PLANZ ROAD, FROM APPROXIMATELY ONE-QUARTER MILE EAST OF SOUTH UNION AVENUE TO MADISON STREET, WITHIN THE BAKERSFIELD AIRPARK EXPANSION PROJECT AREA, IN THE CITY OF BAKERSFIELD. WHEREAS, on Wednesday, January 24, 1990, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1069 declaring its intention to order the vacation of East Planz Road, from approximately 1/4-mile east of South Union Avenue to Madison Street, within the Bakersfield Airpark expansion project area, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on WEDNESDAY, FEBRUARY 21, 1990, after notices were duly published and posted as required by law; and NOW, THEREFORE, BE RESOLVED by the Council of the City of Bakersfield as follows: 1. That the vacation of East Planz Road, from approxi- mately 1/4-mile east of South Union Avenue to Madison Street, within the Bakersfield Airpark expansion project area, in the City of Bakersfield, County of Kern, State of California, more particu- larly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective street or ease- ment purposes. 2. That the vacation of East Planz Road, from approxi- mately 1/4-mile east of South Union Avenue to Madison Street, within the Bakersfield Airpark expansion project area, in the City of Bakersfield, County of Kern, State of California, be and the same is hereby closed up, vacated and abandoned for public street purposes reserving therefrom an easement for public utilities purposes more particularly described in Exhibit "A". Reference to said Resolution of Intention No. 1069 is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested Dy the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. .......... 000 .......... 6358 0938 I BEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on ~£B ~ ~ 1990 , by the following vote: AYES; COUNCILMEMBERS: EDWARDS. B. Haggin" filed May 3, 1889 in the Office of the Kern County Recorder. EXCEPTING THEREFROM any portion lying within the east 45 feet of said Lots 3 and 28. RESERVING THEREFROM an easement for public utilities purposes being the north 25 feet and the west 60 feet of that portion of Lot 3 described above. The north line of said Lot 3 is determined to be on the north line of said Section 17 for this description. RY/meg LEGAL2
