HomeMy WebLinkAboutRES NO 13-90RESOLUTION NO. 13-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING COMBINED ROAD PROGRAM COOPERATIVE PROCESS AND PROCEDURES RELATING THERETO, FOR RURAL AREAS, URBAN PLACES, AND URBANIZED AREAS IN KERN COUNTY. WHEREAS, Section 137 of the Federal-Aid Highway Act of 1987 authorized the Combined Road Program (CRP); and WHEREAS, in August of 1988 California was authorized to participate in the CRP; and WHEREAS, Block Grants of Federal Aid Secondary (FAS), Federal Aid Urban (FAU), and Highway Bridge Rehabilitation and Replacement (HBRE) will be available; and WHEREAS, to increase flexibility to construct ready projects, reduce any unobligated balance, and prevent fund lapse, it would be to the City of Bakersfield's advantage to participate in Block Grants available through the Combined Road Program. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, State of California, as follows: 1. The Combined Road Program authorized by Section 137 of the Federal-Aid Highway Act of 1987 and the Cooperative Process and Procedures relating to said program, which are attached hereto as Exhibit "A" and incorporated herein by this reference, are hereby approved. 2. The attached Cooperative Process and Procedures approved herein are recommended for approval by the Kern Council of Governments (Kern COG). 3. California is one of five states selected to participate in the demonstration program. PURPOSE The purpose of the Cooperative Process and Procedures is to establish criteria and guidelines for the implementation of the Combined Road Program (CRP) for the Rural Areas, Urban Places, and Urbantzed Areas in Kern County. The CRP will allow the flexibility to respond more quickly to actual local needs and will provide evidence that State and local transportation officials are fully capable of administering Federal funds under a block grant approach. ESTABLISHMENT The Federal Aid Urban (FAU) Committee shall have the authority to establish the CRP C~mmittee. After approval of the CRP Committee the FAU Committee shall be disbanded, however, any actions taken by the FAU Committee shall remain valid, subject to revision and modification by the CRP Committee. COMPOSITION Currently, the CRP Committee shall be made up of representatives of the State of California (Caltrans), Kern County, Golden Empire Transit District (GET), and the cities of Arvin, Bakersfield, Delano, McFarland, Ridgecrest, Shafter, Taft, and Waeco, each of which shall have one vote. The Kern County Council of Governments (Kern COG) will remain informed and be invited as an observer. Membership will be subject to change following the 1990 and future census, The following officials, or an alternate designated in writing, shall serve on the CRP Committee: Galtrans District 06 Ca/trans District 09 Golden Empire Transportation County of Kern City of Arvin City of Bakersfield City of Delano City of McFarland City of Ridgecrest City of Shafter City of Taft City of Wasco District Director District Director Manager Public Works Director Public Works Director Public Works Manager Manager Public Works Director Public Works Director Public Works Director Public Works Director Public Works Director FUNDING DISTRIBUTION The CRP does not provide more funding to the partlctpants. Each member agency will receive their same allocation of State and Federal funds as provided for in the Federal Highway Act of 1987 and any future acts, however, the local agencies are authorized to use their Federal Aid Secondary (FAS), Federal Aid Urban (FAU), and Highway Bridge Rehabilitation and Replacement (HBRR) allocations on any eligible project regardless of the source of these funds, i.e. FAU allocations may be used on the FAS system. The CRP fund may be combined or loaned between agencies at their discretion. The loans between agencies must be agreed to and processed by the participating agencies and submitted to the CRP for approval. Agencies shall process funding reimbursement for CRP expenditures with Caltrans under the latest approved procedures. RESPONSIBILITY The CRP Committee shall review and recommend adoption by the Federal Highway Administration (FHWA) each local agency's respective rural, urban, or urbanized boundaries whlch will be observed when implementing the CRP. The CRP Committee shall review and approve project(s) from each Rural Area, Urban Place, or Urbanized Area. The request for projects may be submitted by any voting member agency. In order for a project to be eligible for funding, it must be included in an approved Regional Transportation Improvement Program (RTIP). Approved projects shall be eltglble for full CRP participation based on the total estimated project cost, including right-of-way, preliminary and construction engineering. When the cost of a project exceeds the funds allocated to the applicant, that agency shall fund the entire difference with local funds. - 2 - The CRP Committee shall approve Cooperative Process and Procedures and updates, when required. Each member agency shall adopt appropriate resolutions approving the Combined Road Program, this Cooperative Process, these Procedures, and any subsequent changes. Certified copies of the adoption resolutions shall be provided Caltrans, Kern County, and Kern COG. The County will be the CRP Committee lead agency, will preside over meetings as chairman, and record the business of the Committee. a. Meetings shall be scheduled as required to conduct the business of the Committee. Do Minutes of the meetlngs shall be transmitted to each representative of the Committee wlthin two weeks following the meeting. The County will maintain an unofficial record of revenues and loans between agencies utilizing information provided by Gaittans. Caltrans will monitor the administration of the GRP in accordance with the procedures mutually agreed to by Caltrane and the FHWA. Galtrans will monitor lapse requirement of funds and give notice when funds are subject to lapse. Caltrans will process claims and disburse funds for GRP expenditures in compliance with the latest approved procedures. They shall inform the County of any transaction to allow the unofficial record of revenues to be kept current. - 3 -
