HomeMy WebLinkAboutRES NO 09-90RESOLUTION NO. 9-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, AMENDING RESOLUTION NO. 28-88, WHICH ESTABLISHED UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 18 (EAST WHITE LANE FROM UNION AVENUE TO 200 FEET EAST OF EAST LINE OF MADISON STREET). WHEREAS, by Resolution No. 28-88, the Council of the City of Bakersfield established Underground Utility District No. 2, Division 18; and WHEREAS, Resolution No. 28-88 set September 30, 1989, as the date by which all affected utilities must have all underground facilities installed and all above-ground facilities must be removed; and WHEREAS, Resolution No. 28-88 also set December 31, 1989, as the date by which all affected property owners must be ready to receive underground service; and WHEREAS, the aforementioned dates as set forth in Resolution No. 28-88 are no longer realistic. WHEREAS, Resolution No. 28-88 defined the underground utility district boundary which is no longer accurate. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that Resolution 28-88 be amended as follows: 1. That the area within the amended district boundary in the State of California be more particularly described as follows: UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 18 Beginning at the intersection of the south line of White Lane and the east line of Union Avenue; THENCE (1) northerly along said east line of Union Avenue to intersect the north line of White Lane; THENCE (2) easterly along said north line of White Lane to a point 200 feet east of east line of Madison Street; THENCE (3) southerly from said point to intersect the south line of White Lane; THENCE (4) westerly along said south line of White Lane to the Point of Beginning. Attached hereto and marked Exhibit "A" and incorporated as though fully set forth herein, is a map delineating the boundaries of Underground Utility District No. 2, Division 18, as amended. 012590 R-UUD2.1 -1- DS/mro 2. April 30, 1991, is fixed as the date on which all affected utilities must have all facilities installed, and have completed removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable television or similar or associated services within Underground Utility District No. 2, Division 18. 3. November 30, 1990, is fixed as the date on which all affected property owners must be ready to receive underground service. 4. April 30, 1991, is fixed as the date by which all poles, overhead wires and associated overhead structures must be removed and by which wires and facilities for supplying electric, communication, cable television or similar associated service within Underground Utility District No. 2, Division 18 must be installed. 5. All other provisions of Resolution No. 28-88 shall remain in effect. .......... 000 ..........
