' 00 A RESOLUTION OF THE CITY OF BAKERSFIELD IMPOSING AN INTERIM MORATORIUM ON THE ISSUANCE OF PERMITS FOR VENDORS CONDUCTING SALES FROM PORTABLE CONCESSION STANDS IN CITY PARKS WHEREAS, Bakersfield Municipal Code, section 12.56.240 governs sales of goods and solicitation of funds within City parks; and WHEREAS, sections lB)and lC)of Bakersfield Municipal Code section 12.56.240 governs the issuance of permits to vendors to conduct sales from permanent and portable concession stands within City parks; and WHEREAS, the current process of issuing permits to vendors to conduct sales from permanent and portable concession stands within City parks does not adequately allow for a uniform and consistent approach to concession sa[es within City parks; and WHEREAS, this resolution is necessary to give the City an opportunity to refer the matter to an appropriate City Council Committee for consideration and discussion of revised ordinance language and time for staff to prepare a Request For Proposal to conduct concession sales in City parks; and WHEREAS, this moratorium will ultimately result in improved community interests and ensure the continued and orderly regulation of City parks. NOW, THEREFORE, INCORPORATING THE ABOVE RECITALS HEREIN, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. The above recitals and findings are true and correct. That an interim moratorium is imposed on the processing of any permits for vendors to conduct sales from portable concession stands within City parks, as allowed under Municipal Code sections 12.56.240 lB) and (Cl. That this interim moratorium shall expire on September 2, 2001, forty-five (45) days after its adoption, unless subsequently extended by the Bakersfield City Council. 4.
