A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING AND AUTHORIZING THE
MAYOR TO EXEC~T~ THE CONSENT TO COI~ON USE
AGREEMENT NO. 81151 WITH THE CALIFORNIA
DEPARTMENT OF TRANSPORTATION.
WHEREAS, Consent to Common Use Agreement No. 81151,
between the State of California, Department of Transportation,
(hereinafter "Department") and the City of Bakersfield
(hereinafter "City") covers common areas of rights of way for
City irrigation facilities and State Road 6-KER-178 at Post Mile
0.48 and it is in the interest of both parties that such
agreement be executed; and
WHEREAS, Department requires a Resolution from the
governing body of the City authorizing the Mayor to execute the
above-mentioned Consent to Common Use Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. Consent to Common Use Agreement No. 81151 is hereby
approved; and
2. The Mayor of the City of Bakersfield is hereby
authorized to execute Consent to Common Use Agreement No. 81151,
his signature to be notarized; and
3. The City Clerk shall certify the passage of this
Resolution and shall cause a certified copy hereof, and two (2)
executed copies of the agreement, to be mailed to the State
Department of Transportation, 4491 West Shaw Avenue, Fresno, CA
93722.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on November 29, 1989 , by the
