HomeMy WebLinkAboutRES NO 197-89RESOLUTION NO. 1Q7-Rg A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE REMAINING EASTERLY 57 FEET OF ALLEY IN BLOCK 412-A (SOUTH OF TRUXTUN AVENUE ON WEST SIDE OF "D" STREET), IN THE CITY OF BAKERSFIELD. WHEREAS, on Wednesday, November 1, 1989, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1068 declaring its intention to order the vacation of the remaining easterly 57 feet of alley in Block 412-A (south of Truxtun Avenue on the west side of "D" Street), in the City of Bakersfield, County of Kern, State of California; and WHEREAS, ~.aid Council did fix a time and place for hearing all persons interes. ted in or objecting to said proposed vacation, which said hearing was held on WEDNESDAY, NOVEMBER 29, 1989, after notices were duly published and posted as required by law; and NOW, THEREFORE, BE RESOLVED by the Council of the City of Bakersfield as follows: 1. That the vacation of the remaining easterly 57 feet of alley in Block 412-A (south of Truxtun Avenue on the west side of "D" Street), in the City of Bakersfield, County of Kern, State of California, more particularly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective street or easement purposes. 2. That the vacation of the remaining easterly 57 feet of alley in Block 412-A (south of Truxtun Avenue on the west side of "D" Street), in the City of Bakersfield, County of Kern, State of California, be and the same rs hereby closed up, w~cated and abandoned for public street purposes reserving therefrom the north 10 feet of said alley portion as an easement for public utilities purposes. Reference to said Resolution of Intention No. 1068 is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. .......... 000 ..........
