The meeting was called to order by Mayor Medders, followed by the Pledge of Allegiance. Acting City Clerk Gafford called the roll as follows: Present: Absent: Councilmembers Edwards, DeMond, Smith, Brunni (seated at 5:45), Peterson, McDermott, Salvaggio None NEW BUSINESS Correspondence from the Planning Commission regarding Capital Improvements Program. Mayor Medders declared the hearing open for public participation. No protest or objections being received and no one wishing to speak in favor, Mayor Medders closed the public portion of the hearing for Council deliberation and action. Upon a motion by Councilmember McDermott, correspondence from the Planning Commission regarding Capital ~mprovements Program was received and placed on file. HEARINGS This is the time set for public hearings before the Council to receive public comments on the proposed Fiscal Year 1990-91 Operating Budget for the City of Bakersfield. City Manager Dale Hawley stated the Fiscal Year 1990-91 Budget is $146,561,156 and the revenues are expected to increase 2.7 percent over Fiscal Year 1989-90. He also provided a brief summary of the Budget and recommended that the public input be referred to the Budget and Finance Committee for their review and report back to the Council on June 27, 1990. Mayor Medders declared the hearing open for public participation. This is the time set for public hearings before the Council for hearing protests by property owners on the amount of assessments or the fairness of the benefit formula for maintaining certain local improvements, to be borne by all parcels of property within Maintenance District Nos. 1 through 26, which provides the bases for the benefit assessments for maintaining certain local improvements within each District. These hearings have been duly advertised and the property owners notified as required by law. MAINTENANCE DISTRICT NO. 1: This district pays for maintenance of street landscaping along Gosford Road, Stockdale Highway, Kroll Way, Ca~ino Media, and Ming Avenue. Correspondence has been received from Joseph Clerou, 8220 Norfolk Court, expressing concerns regarding Maintenance District No. 1 Assessments. Correspondence has been received from Laura Whitaker representing Oceanic Communities expressing concerns regarding Maintenance District No. 1 Assessments. Mayor Medders declared the hearing open for public participation. No protest or objections being received and no one wishing to speak in favor, Mayor Medders closed the public portion of the hearing for Council deliberation and action. Adoption of Resolution No. 49-90 of the Council of the City of Bakersfield for Maintenance District No. I approving and adopting the 1990-91 Budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Upon a motion by Councilmember Peterson, Mayor Medders recessed the meeting at 5:35 p.m. The meeting reconvened at 5:48 p.m. Upon a motion by Councilmember McDermott, the City will contribute 25 percent towards the cost of maintenance districts and it will be included in the calculations for each of the districts in the last column as opposed to the third column, by the following roll call vote: Ayes: Councilmembers Smith, Brunni, McDermott, Noes: Councilmembers Peterson, Edwards, Demond Abstain: None Absent: None Salvaggio Bakersfield, California, June 12, 1990 - Page 3 Upon a motion by Councilmember Peterson, Resolution No. 49-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None MAINTENANCE DISTRICT NO. 2: This district pays for maintenance of A~berton Park. Mayor Medders declared the hearing open for public participation. Parks Superintendent Frank Fabbri stated that the total budget for Maintenance District No. 2 is $22,268; there is a carryover of $22,097, which leaves a deficit of $171; therefore, there is no assessment. Councilmember Peterson disqualified himself from participating in Maintenance District No. 2 as a result of a real or imaginary conflict of interest. No protest or objections being received and no one wishing to speak in favor, Mayor Medders closed the public portion of the hearing for Council deliberation and action. Adoption of Resolution No. 50-90 of the Council of the City of Bakersfield for Maintenance District No. 2 approving and adopting the 1990-91 Budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Upon a motion by Councilmember McDermott, Resolution No. 50-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Noes: Abstain: Absent: Councilmembers Edwards, McDermott, None None Councilmember Petersoil DeMond, Smith, Salvaggio Brunni, MAINTENANCE DISTRICT NO. 3: This district pays for ~aintenance of Campus Park north and Campus Park south; median landscaping and street landscaping along Old River Road, White Lane, Gosford Road, District Boulevard, Park View Drive, and Pin Oak Boulevard. Communication has been received from Lawrence Dillin Sr., 9404 Steinbeck Lane, dated June 5, 1990, stating opposition to the assessment. Communication has been received from Maria A. Ice and Jacqueline K. Hultquist, 3820 Millay Way, dated June 5, 1990, expressing concerns regarding Maintenance District No. 3. 4 Bakersfield, California, June 12, 1990 - Page 4 Communication has been received from Charles and Gwendolyn Odle, 3717 Perugia, Sebrina, Florida, in opposition to the assessment. Parks Superintendent Fabbri stated that Maintenance District No. 3 has a total budget of $233,918; there is a carryover of $168,316. The total assessment is $65,602, and the cost per single family resident after the 25 percent park subsidy is $17.19. Mayor Medders declared the hearing open for public participation. Adoption of Resolution No. 51-90 of the Council of the City of Bakersfield for Maintenance District No. 3 approving and adopting the 1990-91 Budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Councilmember Brunni requested a breakdown of where the Budget total comes from and where the money is going for each service. Upon a motion by Councilmember Brunni, Resolution No. 51-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None MAIN'r~NANCE DISTRICT NO. 4: This district pays for maintenance of Pin Oak Park and Garden Park; median landscaping and street landscaping along Old River Road, White Lane, Gosford Road, Park View Drive, Pin Oak Boulevard and Scarlet Oak Boulevard. Correspondence has been received from Pamela L. Cline, 9612 Lea Oak Road, dated June 7, 1990, in opposition to the assessment. Parks Superintendent Fabbri stated that the total Budget for Maintenance District No. 4 is $302,619; there is a carryover of $91,177. The total assessment is $211,442, and the cost per resident after the 25 percent park subsidy is $117.98. Mayor Medders declared the hearing open for public participation. Ms. Donna Cazacus, 9608 Red Oak Court, spoke in opposition to the assessment and suggested the City look into other options for assessment. Councilmember Salvaggio requested that staff provide Ms. Donna Cazacus with a copy of the study regarding maintenance districts prepared through Cal State and a copy of the reports that came to the Council from the Committee working on this issue. Upon a motion by Councilmember Brunni, Resolution No. 52-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None MAINTENANCE DISTRICT NO. 5: This district pays for maintenance of Haggin Oaks Park, median landscaping and wall planters along Scarlet Oak Boulevard, and Haggin Oaks Boulevard. Parks Superintendent Fabbri stated that Maintenance District No. 5 has a total budget of $108,209; there is a carryover of $92,498. The total assessment is $15,711, and the cost per resident after the 25 percent subsidy is $17.22. Mayor Medders declared the hearing open for public participation. Ms. Pamela Cline, 9612 Lea Oak Road, stated she is concerned with the inequities between Maintenance District No. 4 and Maintenance District No. 5. Upon a motion by Councilmember Brunni, Resolution No. 53-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, Peterson, Noes: None Abstain: None Absent: None DeMond, Smith, Brunni, McDermott, Salvaggio MAIN'r~NANCE DISTRICT NO. 6: This district pays for maintenance of median landscaping and street landscaping along Ming Avenue, Gosford Road, Brookside Drive, and Westwold Drive. Parks Superintendent Fabbri stated that the total budget for Maintenance District No. 6 is $46,089; there is a carryover of $18,284. The total assessment is $27,805. Residents will be assessed from $16.11 to $22.55. Mayor Medders declared the hearing open for public participation. Adoption of Resolution No. 54-90 of the Council of the City of Bakersfield for Maintenance District No. 6 approving and adopting the 1990-91 Budget, levying assessments, reserving the right to perform maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Upon a motion by Councilmember Brunni, Resolution No. 54-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, De Mond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None MAINTENANCE DISTRICT NO. 7: This district pays for maintenance of median and street landscaping along Ming Avenue and Old River Road. Parks Superintendent Fabbri stated that the total budget for Maintenance District No. 7 is $66,500; there is a carryover of $44,504, and the total assessment is $21,996. Upon a motion by Councilmember Brunni, Resolution No. 55-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None Upon a motion by Councilmember DeMond, Maintenance District Nos. 14 and 19 were moved forward to be heard at this time. MAINTE~ANCE DISTRICT NO. 14: This district pays for maintenance of Challenger Park, located at Harris Road and Akers Road. Those sunivisions along Panama Lane which have street landscaping on Panama Lane also pay for maintenance of street landscaping. Communication has been received from Salvatore and Cheryl Massaro, dated June 4, 1990, in opposition to the assessment. Communication has been received from Ana Espericueta, 100 Baker Street, in opposition to the assessment. Parks Superintendent Fabbri stated that the total budget for the parks portion of Maintenance District No. 14 is $40,977; there is a carryover of $5,361. The total assessment is $35,616. The assessment with the 25 percent subsidy for City residents is $10.01. There are also some County islands included in this district, and their fee is $14.05. For the streetscape portion of Maintenance District No. 14, the total budget is $7,390; there is a carryover of $675. The total assessment is $6,715. Only the portion of the tracts south of Panama Lane pay into that portion, and their individual assessment is $30.12. Mayor Medders declared the hearing open for public participation. Mr. Salvatore Massaro, 4100 Southern Breeze Drive, spoke in opposition to the assessment for Maintenance District No. 14. Mr. Ned (unintelligible), 4108 Southern Breeze Drive, spoke in opposition to the assessment for Maintenance District No. 14. Tract No. 5107 south of Panama Lane pays for maintenance of street landscaping along Panama Lane. Communications have been received from Patricia Davis, 1201 Jimson Street; Douglas and Phyllis Bailey, 5112 Gaylene Avenue; Primitivo and Nadine Calvetti, 5409 Stine Court; and Marion Gentz, 499 Pacheco Road; in opposition to the assessment. Parks Superintendent Fabbri stated that the total budget for Maintenance District No. 19 is $40,978; it is anticipated there will be a deficit of $2,805. The total assessment is $35,587. With the 25 percent subsidy, a single family resident will pay $19.98. Also within this district there are some streetscapes. The budget for that is $2,607. There is no carryover or deficit, and the cost per resident is $22.09. Mayor Medders declared the hearing open for public participation. Ms. Patricia Davis spoke in opposition to the assessment. Parks Superintendent Fabbri stated that the total budget for Maintenance District No. 13 is $8,151; there is a carryover of $1,699. The total assessment is $6,452, and the cost per resident is $9.03. Councilmember McDermott asked staff to correct the annual Public Works Director's Report, bottom of page 2, to read "Maintenance District No. 13" instead of "Maintenance District No. 11." Parks Superintendent Fabbri stated that the total budget for Maintenance District No. 15 is $9,172; there is a deficit of $8,709. The total assessment is $17,881, and the individual assessments range from $105 to $1,900. Mayor Medders declared the hearing open for public participation.
