A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING PLANS FOR AN ADDITION
TOTHE CUNNINGHAM MEMORIAL ART GALLERY.
WHEREAS, the City of Bakersfield (hereinafter "CITY")
is the owner of that certain real property located at 1930 "R"
Street, Bakersfield, including the Cunningham Memorial Art
Gallery (hereinafter, "GALLERY"); and
WHEREAS, the Bakersfield Art Foundation (hereinafter,
"FOUNDATION") has entered into Agreement No. 89-166 (hereinafter,
"AGREEMENT") with the City of Bakersfield to lease the gallery,
and operate it as a municipal art gallery; and
WHEREAS, the Agreement provides that in the event the
Foundation secures sufficient funds and permits to construct
additional facilities adjacent or attached to the Gallery, and if
construction of such facilities is approved by the City prior to
the termination of the lease, the City will extend the term of
the lease an additional two years; and
WHEREAS, the Foundation is presently securing funds for
construction of an addition, and has presented City with plans
for such addition, marked as Exhibit "A", attached hereto and
incorporated as though fully set forth herein, for the City's
approval; and
WHEREAS, City approval of said plans is a precondition
to the Foundation's securing of such funding.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that the plans set forth as Exhibit "A" are
hereby approved.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on November ~5, 1989 , by the
following vote:
