HomeMy WebLinkAboutRES NO 188-89RESOLUTION NO. 188-89 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND APPROVING SEGMENT I OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 3-89). WHEREAS, the Council of the City of Bakersfield referred Segment I of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakers- field, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on September 21, 1989, on Segment I of a prop. osed amendment to the [,and Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before sai~ hearing by publication in the Bakersfield Californian, s local newspaper of general circulation; and WHEREAS, such Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: SEGMENT I DEWALT-PORTER ENGINEERING has requested to amend the Land Use Element of the Bakersfield Metropolitan Area General Plan from Commercial to Low Density Residential, Medium Density Residential to Low Density Residential, Low Density Residential to Medium Density Residential, on approximately 141.4 acres located within the Rancho Laborde Specific Plan area, generally north of Rosedale Highway, south of Norris Road, east of Calloway Drive and west of Fruitvale Avenue, as depicted on map marked Exhibit "~" attached hereto and made a part hereof; and WHEREAS, for the above-described Segment, an Initial Study was conducted, and it was determined that the proposed pro- ject would not have a significant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 107-86 have been duly fol- lowed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 36-89 on September 21, 1989, the Planning Commission recommended approval and adoption of Segment I, subject to a condition of development, and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on WEDNESDAY, NOVEMBER 15, 1989, on the above-described Segment I of the proposed amend- ment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given an least ten <10) calendar days before the hearing by pub- lication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true an(] correct. 2. The Negative Declaration for Segment I i.s hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. Based on an initial study, staff determined the General Plan Amendment would not have a significant adverse effect on the environment because additions, revisions, and con- ditions of approval in the project description and/or mitigation made by or agreed to by the applicant would avoid or lessen the effects to a point where no significant impacts would occur. 5. On October 16, 1985, the City Council of the City of Bakersfield approved a Negative Declaration for the entire Rancho Laborde Specific Plan area (SCH#85081901). This document is incorporated by reference into the Initial Study and is deemed sufficient to cover the proposed project. - 2 - 6. The City Council ~ereby approves and adopts Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, with incorporation therein of the following condition of development: Future development of the site shall be subject to site plan review policies, ordinance and development standards. 7. That Segment I, approved herein, be combined with other approved segments described in separate resolutions, to ~orm a single Land Use Element Amendment, GPA 3-89. .......... o0o .......... - 3 - I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on November 15, 1989 __, by the following vote: CITY CLERK and Ex Officio Clerk of the Council of the City of Bakersfield APPROVED November 15, 1989 CLARENCE E.
