This is to advise you that this Department has reviewed the project
results for the preliminary assessment associated with the closure
of the tanks noted above.
Based upon the sample results submitted, this Department is
satisfied 'that the assessment is complete. Based on current
requirements and policies, no further action is indicated at this
time.
It is important to note that this letter does not relieve, you of
further responsibilities mandated under the California Health and
Safety Code and California Water Code if additional or previously
unidentified contamination at the subject site causes or threatens
to cause pollution or nuisance or is found to pose a significant
threat to public health.

I. It is thc responsibility of the Permittee to obtain permits which may be required by other regulatory agencies prior to beginning work. (i.e., City
Fire and Building Departments)
2. Permittee must notify the Hazardous Materials Management Program at (805) 861-3636 two working days prior tO tank removal or abandonment
in place to arrange for required inspections(s).
3. Tank clo~ure activitic~ must be per Kern County Environmental Health and Fire Department approved methods az described in Handbook UT-
30.
4. It is the contractor's responsibility to know and adhere to all applicable law~ regarding the handling, t~ansportation or trea{ment of hazardous
materials.
5. Thc tank removal contractor must have a qualified company employee onsite supervising the tank removal. The employcemnst have tank removal
experience prior to working unsupervised.
6. ff any contractor~ other than those listed on permit and permit application arc to be utilized, prior approval must be granted by the specialist
listed on the permit. -Deviati0n from the submitted application is not allowed.
7. Soil Sampling:
a. Tank size less than or equal to 1,000 gallons - a minimum of two samples must be retrieved from beneath the center of the tank at depths
of approximately two feet and six feet.
b. Tank size greater than 1,000 to 10,000 gallons - a minimum of four samples must be retrieved one-third of the way in from the ends of
-each tank at depths of approximately two feet and six feet.
c. Tank size greater than 10,000 gallons - a minimum of six samples must be retrieved on-fourth of the way in from the ends of each tank
* and beneath the center of each tank at depths of approximately two feet and six feet.
8. Soil Sampling (piping area): · '.
A minimum of two samples must be retrieved at depths of approximately two feet and six feet for every 15 linear feet of pipe run and under the
dispenser area.

Program
Purging/lnerting Conditions: ' ' ~ '
a. Liquid shall be pumped from tank pribr to purging such that leas than 8 gallons of liquid remain in tank. (CSH&SC 41700)
b. ' Tank shall be purged through vent pipe discharging at least 10 feet above ground level. (CSH&SC 4'1700) ..
c. No emission shall result in odors detectable at or beyond property linc. (Rule 419)
d. No emission sball endanger the health, safety, comfort of repose of any person. (CSH&SC 41700)
e. Vent lines shall remain attached to tank until thc inspector arrives to authorize removal. .
RECOMIVtENDATIONS/GUIDELINES FOR REMOVAL OF UNDERGROUND STORAGE TANKS
This depa~:tmcnt is responsible for enforcing thc Kern County Ordinance Code, Division 8 and state regulations pertaining .to underground storage tanks.
Representatives from this department respond to job sites during tank removals to ensure that the tanks arc safe to remove/close and that thc overall
job performance is consistent with permit requirements, applicable laws and safety standards. Thc following guidelines are offered to clarify thc interests
and expectations for this department. '
1. .lob site safety is one of our primary concerns. Excavations are inhercntly dangerous. It is thc contractor's responsibility to know and abide by
CAL-OSI-IA regulations. The job foreman is responsible for thc crew and any subcontractors on thc job. As a general rule workers arc not
permitted in improperly sloped excavations or when unsafe conditions exist in the hole. Tools and equipment arc to be used only [or their designed
function. For example, backhoe buckets arc never substituted for ladders. '"
2. Properly licensed contractors are assumed to understand thc requirements of thc permit issued. Thc job foreman is responsible for knowing and
abiding by the conditions of thc permit. Deviation from the permit conditions may result in a stop-work order.
3. Individual'contractors will be held responsible for their post-removal paperwork. Tracking foims, hazardous-waste manifests and analyses
documentation is necessary for each site in order to close a case file or move it into mitigation. When contractors do not follow through on
necessary paperwork, an unmanageable backlog of incomplete cases results. If this continues, processing time for completing new closures will
increase.

and benzene.
All soil samples retrieved from beneath waste oil tanks and appurtenances must be analyzed for total organic halides, lead, oil and grease.
All soil samples retrieved from beneath' crude oil tanks and appurtenances must be analyzed for oil and grease..
All soil samples retrieved from beneath tanks and appurtenances that contain unknown substances must be analyzed for a full range of
substances that may have been stored within the tank.

Purging/Inerting Conditions:
a. Liquid shall be pumped from tank prior to purging such that less than 8 gallons of liquid remain in tank. (CSH&SC 41700)
b. Tank shall be purged through vent pipe discharging at least 10 feet above ground level. (CSH&SC 41700)
c. No emission shall result in odors detectable at or beyond property line. (Rule 419)
d. No emission shall endanger the health, safety, comfort of repose of any person. (CSH&SC 41700)
e. Vent lines shall remain attached to tank until the inspector arrives to authorize removal.
RECOMMENDATIONS/GUIDELINES FOR REMOVAL OF UNDERGROUND sToRAGE TANKS
This depart ment is responsible for enforcing the Kern County Or~dinance Code, Division 8 and state regulations pertaining to underground storage tanks,
Representatives from this department respond to job sites during tank removals to ensure that the tanks are safe to remove/close and that the overall
job performance is consistent with permit requirements, applicable laws and safety standards. The following guidelines are offered to clarify the interests
and expectations for this department.
1. Job site safety is one of our primary concerns. Excavations are inherently dangerous. It is the contractor's responsibility to know and abide by
CAL-OSHA regulations. The job foreman is responsible for the crew and any subcontractors on the job. As a gener?l rule workers are not
permitted in improperly sloped excavations or when unsafe conditions exist in the hole. Tools and equipment are to be used only for their designed
function. For example, backhoe buckets are never substituted for ladders.
2. Properly licensed contractors are assumed to understand the requirements of the permit issued. The job foreman is responsible for knowing and
abiding by the conditions of the permit. Deviation from the permit conditions may result in a stop-work order.
3. Individual contractors will be held responsible for their post-removal paperwork. T~acking forms, hazardous-waste manifests and analyses
documentation is necessary for each site in order to close a case file or move it into mitigation. When contractors do not follow through on
necessary paperwork, an unmanageable backlog of incomplete cases results. If this continues, processing time for completing new closures will
increase.

Gentlemen:
On December 12, 1989, this Department contacted Gary Whitten in regards to
the application for a permit to remove three (3) underground storage tanks located
at 2700 "K"' Street, Bakersfield. At which time it was explained that the
application could not be processed Until additional information was provided in
writing to this Department. As of the date of this letter the ~following
information has not been received:
Quality Vacuum is listed as the decontamination contractor. A copy of
their decontamination procedures are not on file.
D & J is listed as the principal tank removal contractor. D & J
Construction has on file with the Kern County Environmental Health
Services Department, a copy of Workers Compensation only. A current
pocket copy with expiration date of license, site safety planS for tank
removal and Liability Insurance are needed on file.

The application in the contractor information section is lacking a
phone number for the tank removal contractor and in the environmental
information the depth to groundwater is lacking.
Please resubmit the additional information in writing. The permit will not
be issued until all pending matters regarding D & J Construction are completed with

Application for U.T. Removal
In order to expedite permit processing before submitting your permit appLication(s) for
permanent closure, check to see that all of the following are addressed:
Appl/cations must be fully completed or they will be returned, no exceptions. The
use of the answer "NA" (not applicable) is unacceptable.
2. Permit fee(s) must be submitted with the application or it will be returned.
Contractors must have current copies of the following information on file with this
program:
Current pocket copy with expiration date clearly noted on one of the
following contractors license: General A, C-61, & D-40, C-36, and
General B with restrictions.
B, Current copy of Certificate of Workers Compensation and .liability
~urances.
C. Current copy of Cal OSHA trench permit.
D. Site safety plans.
Preliminary Site assessment contractor must also have a copy of his sampling
protocol on file with this program. ~ protocol must address requirements that
are in E.P.A. document SW-846 and Kern County Handbook U.T. #30 for soft
samples.
The laboratory listed on the application must be State Cerli~ed for the analysis of
the required samples.

on file. These procedures must address site safety and include certification with
the use of an explosiveity meter. Tanks and piping must be cleaned to remove all
sludge/residue and maintain an LEL level of 5% or less with a normal atmosphere..
All hazardous waste must be hauled under manifest by licensed hazardohs waste
haulers.
Underground storage tanks must be sent to a Hazardous Materials Management
Program qualified scrapping facility or stat~ licensed disposal facfl.ity for disposal.
Plot plan must include all required information on application.
Uncontrolled emissions from contaminated soils are not allowed unless written
approval is received from the Hazardous Materials Management Program.
When contaminated soil is encountered during tank removal one of the three
options must be followed:
Place contaminated soil back in the excavation with an understanding that
it may have to be removed as a hazardous waste or further assessment
might be required ff contamination is significant.

Segregate, cover, analyze and make preparation for disposal if analysis show
significant contamination.

Completed applications received at the Public Services Counter are routed th.rough
all necessary county departments for approval prior to Environmental Health
(HMMP) review. Environmental Health has no control over the amount of times
these reviews may take, however, once it is received by the HMMP, it is our policy
to endeavor to process completed applications in no more than five (5) working
days.
