SUBSTANCE Dear Mr. Barber: This is to inform you that this department has reviewed the results for the preliminary assessment associated with the closure of the tanks located at the above stated address. Based upon laboratory data submitted, this office is satisfied with the assessment .performed and requires no further action at this time. Box 60706 Bakersfield, California 93386-0607 (805) 871-3207 November 131 1998 Mr. Don Mead MP Environmental Services, Incorporated 3400 Manor Street Bakersfield, California 93308 Dear Mr. Mead: Two underground gasoline tanks, four dispensers, and associated piping were removed on October 29, 1998 at the Oak Street Car Wash property located at 600 Oak Street in Bakersfield, California (see Figure 1). Each of the gasoline tanks had a volume of approximately 10,000 gallons. They had been in place for many years and were in good condition when remOved. The dispensers were located just north of the tank excavation. The piping ran over the tops of the tanks and along the west edge of the dispensers. The tank abandonment was witnessed by Mr. Steve Underwood of the Bakersfield City Fire Department, Environmental Services. Eight soil samples were collected from beneath the tanks by Smith-Gutcher 'and Associates as directed by Mr. Underwood. Four samples were collected from below each tank. The samples were collected from 2 and 6 feet beneath the bottom of the tanks at the test hole locations shown on Figure 2. Two samPles also were collected from below each dispenser. The soil samples from below the tanks were collected using a hand driven core sampler after the test holes were excavated to the aPpropriate depth with an excavator. The samples were collected from the excavator bucket. The hand driven core sampler was driven into the soil. The core sampler contained one 2-inch diameter by 2-inch long brass liner. The liner was labeled with the test hole number and depth. The sample was then place in an ice chest on blue ice for transport to the laboratory. The soil samples from below the dispensers were collected with a hand driven core sampler once the test hole was hand augered to the appropriate depth. The remainder of the sample collection from beloW the dispensers followed the described procedures for sampling below the tanks. The soil samples were analyzed for total petroleum hydrocarbons (TPH) as gasoline, benzene, toluene, ethyl benzene, and total xylenes (BTX&E), and MTBE. The samples were delivered to BC Laboratories in Bakersfield, California for analyses. The analytical results are included as Appendix A. No TPH as gasoline, BTX&E, or MTBE constituents were detected in the soil samples collected from below the tanks and dispensers above the practical quantitation limits. Based on the results of the investigation, no gasoline constituents are present in the soil below the tanks and dispensers above the practical quantitation limits. I feel we must inform you of how serious an' impact non-compliance 'will be to your business. On December 23, 1998 (December 22, 1998 deadline) this office will be forced to revoke your permit to operate, effectively shutting down your fueling operation. On January 1, 1999, Senate Bill 1491 takes effect, banning fuel deliveries for those who have not met the compliance upgrade. After 90 days of closure, your tanks will be considered illegally abandoned and we will take action to properly close these tanks. If you do not comply with our tank closure requirement, we will find it necessary to take legal action, including, but not limited to citation and/or injunctive relief. It is this offices sincere hope, that we do not have to pursue such action, which is why we continue to update you. The tanks have not been properly permitted (permit revoked) and have been out of service, therefore, you are in violation of the following,sections of the Uniform Fire Code as adopted by the Bakersfield Municipal Code, Chapter 15.64. Section 7902.1.7.2.3, Uniform Fire Code (1994 Edition) "Underground tanks which have been out of service for a period of one (1) year, shall be removed from the ground in accordance with Section 7902.1.7.4 and the site shall be restored in an approved manner". The specific remedial actions necessary to return the property to compliance have been provided to you by the City of Bakersfield Fire Department, Office of Environmental Services in correspondences dated December 15, 1997 and February 6, 1998. The purpose of this letter is to impress upon you the need to take immediate action. With that goal in mind, I urge you to return the property to compliance through cooperation with the Office of Environmental Services. 1 must inform you that failure to correct these violations before June 6, 1998, may necessitate legal action, including, but not limited to misdemeanor citations and/or injunctive relief. Pollution Control loans, thru the SBA, are intended to provide loan quarantees to eligible small businesses for the financing of planning, design, or installation of pollution prevention cofltrols, which includes underground storage tank facilities. The vast majority of businesses are eligible for financial assistance from the SBA. The SBA defines an eligible small business as one that is independently owned and operated and not dominant in its field of operation. For those applicants that meet the SBA's credit eligibility standards, the agency can quaranty up to eighty percent (80%) of loans of $100,000. Seventy five percent (75%) of loans above $100,000. Lynn Knutson, Chief of Finance for the SBA says, "If customers apply immediately, and meet the requirements, funding is available". Barber Trust owns property located at 600 Oak Street (Oak Street Car Wash) which contains two underground storage tanks. An inspection was performed at the above referenced site on December 15, 1997. The purpose of this inspection was to verify reports that the two underground storage tanks are no longer in use. On December 15, 1997, a letter was sent to your current tenants Mr. Zeituni and Mr. Bormman Sadeghi (see enclosures). Mr. Zeituni and Mr. Sadeighi have failed to respond to our letter. It now falls on the property owner to meet. compliance regulations. Your tanks located at 600 Oak Street have been "out of service" for more than ninety (90) days. The Uniform Fire Code therefore classifies these tanks as illegally abandoned. You must therefore, either properly close your tanks (remove them), or put them back into service or request a temporary closure status until December 22, 1998. Should you decide to request temporary closure status, you must meet certain requirements (see enclosures). The maximum time allowed by this office for temporary closure is December 22, 1998. You must send a letter in writing requesting temporary closure, providing you comply with temporary closure requirements. This office will give you thirty (30) days, (March 6, 1998) to explore your options. Failure to respond will result in further regulatory action.
