.results for the preliminary assessment associated with the closure
of the tank located at the above stated address.
Based upon laboratory data'submitted, this office is satisfied
with the assessment performed and requires no further action at
this time.
This letter does not relieve you of any liability for past,
present, or future operations. In addition, any future changes in
site use may require further assessment or mitigation. It is the
property owners responsibility t0 notify this department of any
changes in site usage.

Laboratory results from preliminary site assessment conducted
at 1000 NILES STREET, BAKERSFIELD,'CA. (Permit #BR-0067)
Dear MR. METTLER:
Upon review of the recently submitted laboratory results from your
facility, this office has determined that the extent of the
contamination plume, associated with the FUEL tank previously located on
your property, has not been adequately defined.
This office requires (in accordance with Chapter 6.7 of the
California ~Health and Safety Code and Chapter 16, Title 23 of the
California Code of Regulations) that further assessment be done to
define the vertical and horizontal extent of the cOntamination plume.

your property, has not been adequately defined.
This office requires (in accordance with Chapter 6.7 of the
California Health and Safety Code and Chapter 16, Title 23 of the
California Code of Regulations) that further assessment be done to
define the vertical and horizontal extent of the contamination plume.
Please submit a work plan for further assessment, to this office,
with in 30 days from receipt of this letter. The work plan should follow
guidelines found in: Appendix A - Reports, Tri - Regional Board Staff
Recommendations for Preliminary Evaluation and Investigation of
Underqround Tank'Sites; January 22, 1991.

CONDITIONS FOR ABANDONMENT OF UNDERGROUND STORAGE TANKS
** Contractors must have the following information on file in order to obtain a permit:
1. Copy of Contractors license
2. General liability policy
3. Workmans compensation policy
4. Site safety plan
** Site assessment/sample collection contractor must have a soil sampling and quality control/quality
assurance protocol on file.
GENERAL
A permit application for an UST abandonment shall be filed and applicable fees paid 5 working
days prior to the commencement of work. This permit shall remain on-site during the entire
removal process.
A. Permit is valid for 90 days.
Forty-eight hour advance notice-shall be given to the Bakersfield City Fire Department
Hazardous Materials Specialist to arrange an inspection appointment.
It is the responsibility of the Permittee to obtain any permit required by other regulatory
agencies (i.e. Building department and Department of Public Works).
Tank Closure activities must follow the Uniform Fire Code and all Federal and Cai-Osha
regulations.

It is the Contractors responsibility to know and adhere to all applicable laws and regulations
regarding the handling, transportation or treatment of hazardous materials.
If any contractors other than those listed on permit and permit application are to be utilized,
prior approval must be granted by the Bakersfield City Fire Department Hazardous Materials
Specialist. Deviation from the submitted application is not allowed.
TANK EXCAVATION, REMOVAL AND DISPOSAL
-Abandonment of tanks in place will only be allowed if removal would pose undue risk to an
existing structure. Proof of risk and a work plan/proposal shall be submitted to the Bakersfield
City Fire Department Hazardous Materials Division for review and approval prior to the
commencement of any work activity.
Excavation of enough material to expose the top of the tank, rem°val of contents, high pressure
rinsing, and inerting may be done pdor to the arrival of the inspector. TANKS MAY NOT BE
REMOVED WITHOUT AN INSPECTOR PRESENT.

Job site safety and assuring all CAL-OSHA regulations are followed is the contractors
responsibility.
o
Excavations, holes, pits, trenches 'etc.. shall be back filled immediately. Any excavations not
back filled shall be properly secured as to ensure public safety (i.e. fenced off).
Any excavated material from the tank pit, piping runs, etc. not used as back fill will be properly
disposed of, or if left on location will be either containerized or covered with suitable material
to prevent the emission of hazardous, noxious or unpleasant vapors and/or odors. In addition
the material will be properly secured as to ensure public safety (i.e. fenced off).
6. Tanks shall be either decontaminated or transported as hazardous waste.
A Hazardous Waste manifest will accompany either the rinsate or the tank and shall be present
on site and presentable upon request.
The interior of tanks being transported not as hazardous waste (decontaminated) shall have a
lower explosive limit (LEL) of no greater than 5% immediately following cleaning and prior to
the introduction of COz

The contractor shali Certify on the inspection form that the cleaning process was
properly conducted and the LEL results did not exceed 5%.

The decontaminated tank shall be inerted with the introduction of CO2, in the form of dry ice
or from canisters.

A. A rate of 20 pounds of dry ice to 1000 gallons of tanks capacity, or the
corresponding weight of Carbon Dioxide (CO2).
B. If canisters are used they shall be bonded to the tank(s).
C. A receipt for the ¢02 shall remain on site and presentable upon request.
Prior to the removal of a decontaminated tank the LEL level will be no greater than 5% and the
oxygen level will be no greater than 12%.
SOIL SAMPLING/PRELIMINARY SITE ASSESSMENT
Soil samples shall be obtained under the direction of a professional engineer, geologist, or
authorized representative of a state-approved laboratory.
Samples shall be collected, at a minimum, from depths of 2 and 6 feet below the tank bottom,
dispensers, and product lines and from the following locations:
Ao
Tanks less than 1000 gallons - from the center of the tank.
Tanks 1000 - 10,'000 gallons - 1/3 of the way in from each end.
Tanks greater than 10,000 gallons - from the center and 1/4 of the way in the end
of the tank.
Below all dispensers.
Piping - every 15 feet and/or at connections, joints, bends, etc..
Any area of obvious contamination or likely areas of contamination may be required to be
sampled.
4. All samples shall be analyzed by a state certified laboratory.
Soil samples shall be analyzed for all known and suspected substances to have been stored
in the tank.
6. All samples will be. accompanied by a Chain-of-Custody sheet.
A soil sample report/preliminary assessment shall be submitted to the Hazardous Materials
Division with five days after results have been received and shall contain at a minimum the
following information.
Name and location of where the tanks were disposed of.
Name and location of where the rinsate was disposed of.
A signed copy of the'Hazardous Waste Manifest.
A tank disposal receipt from the scraping facility.
Copies of all lab data sheets and Chain-Of-Custody documentation.
A plot plan showing the locations of the buildings,, tanks, piping runs, dispensers,
and ALL SAMPLE LOCATIONS WITH CORRESPONDING I.D. NUMBERS AND
DEPTHS.

NOTICE OF VIOLATION AND SCHEDULE FOR COMPLIANCE
An inspection of the Mettler property located at 1000 Niles Street (APN 015-190-14-00-5)
revealed the presence of at least one underground storage tank that has been illegally
abandoned. The following is a list of violations that have been identified:
California H&SC:
Sec. 25284(a), Failure.to obtain a Permit to own and operate an underground
storage Facility for Hazardous Material;
(a) No person shall own or operate an underground storage tank unless
a permit for its operation has been issued by the local agency to the owner.
Sec. 25298, Failure to properly close an underground tank;

monitor each tank system, based on stored and the type of monitoring
installed.

Dear Mr. Mettler:
The Kern County Environmental Health Services Department
received a letter from you regarding the fee associated with a
permit to operate underground storage tanks located at 1000 Niles
Street in Bakersfield, California. The letter stated that the
underground storage tanks were no longer being used.
Current law regulating underground storage tanks requires that
you maintain the permit to operate the tanks and ensure that the
tanks are capable of holding product, by completing necessary
monitoring and upgrades when required, until the tanks have been
removed under permit. If you do not plan to reuse the tanks you
are required to submit an application for a permit to permanently
close the tanks utilizing local guidelines. All tanks which cannot
meet the monitoring and upgrade requirements must be abandoned
under permit.

Services Department that you own at least one underground storage
tank which is currently not permitted through this department.
Current law requires that all owners of existing underground storage tanks
apply for a permit to operate their, facilities, unless they meet exemptions
provided in Chapter 6. ? of California's Health and Safety Code. The
exemptions provided in law are listed below:

a farm and which stores motor vehicle fuel used primarily for
agricultural purposes and not for resale.

which has a capacity of 1,100 gallons or less, and which stores

3. structures such as sumps, seperators, storm drains, catch basins,
oil field gathering lines, refinery pipelines, lagoons, evaporation
ponds, well cellars, separation sumps, lined and unlined pits,
sumps and lagoons.
4. tanks not substantially underground.
5. tanks storing substances not designated as "hazardous"; the
following liquid and solid substances are considered "hazardous
substances"
-- those defined as such in Section 25316 of the Health and Safety
Code of the State of California.
-- substances on the list prepared by the Director of Industrial
Relations pursuant to Section 6382 of the Labor Code of the
State of California.
-- any substance or material classified by the National Fire
Protection Association as a flammable liquid, a Class II
combustible liquid, or a Class III-A combustible liquid.
-- any regulated substance, as defined in subsection (2) of
Section 6991 of Title 42 of the United States Code, as that
section reads on January 1, 1989, or as it may subsequently
be amended or supplemented.
