NOTICE OF VIOLATION AND SCHEDULE FOR COMPLIANCE
IN THE INSPECTION OF YOUR BUSINESS BIGGAR CONSTRUCTION,
LOCATED AT 100 OAK STREET, BAKERSFIELD, CA 93304 ON
APRIL 9, 1991 THE FOLLOWING HAZARDOUS MATERIALS REGULATION
VIOLATIONS WERE IDENTIFIED:
/1.~t The hazardous materials inventory filed on 3-25-91 is
incomplete. Use the attached inventory form to report
the hazardous waste, 2-$5 gallon drums of unknown
flammable. 3-~fi gallon drums concrete additive. These
wastes must be claimed on the inventory until properly
disposed of and until inspections verify that such waste
~s not routinely generated.
VIOLATION OF CH' 6.96 CALIFORNIA HEALTH
& SAFETY CODE 25509(a)('1-4)
(a)The annual inventory form shall include, but
shall not be limited to, information on all of the
-r-following which are handled in quantities equal to or
greater than the quantities specified in subdivision (a)
of Section 25503.5:
(1
A listing of the chemical name and common names
of every hazardous substance or chemical "
product handled by the business.
(2
(3
The category of waste, including the general
chemical and mineral composition of the waste
listed by probable maximum and minimum
concentrations, of every hazardous waste
handled by the business.
A listing of the chemical name and common, names
of every other hazardous material or mixture
containing a hazardous material hgndled by the
business which is not otherwise listed pursuant
to Paragraph (1) or (2).
(4) The maximum amount, of each hazardous material
or mixture containing a hazardous material
disclosed in paragraphs (1), (2), and (3) which
is handled at any one time by the business over
the course of the year.
~2.C~U~Hazardous wastes may not be accumulated on site for 90
days or more without a permit or interim status.
VIOLATION OF 40 CODE OF FEDERAL REGULATIONS
SUB PART C, PART 262.34,
Accumulation time
Except as provided in paragraphs (d), (e), and (f) of
this section, a generator may accumulate hazardous waste
on-site for 90 days or less without a permit or without
having interim status, provided that:
(1) The waste is placed in containers and the generator
complies with Subpart I of 40 CFR Part 265, or the waste
is placed in tanks and the generator complies with
Subpart J of 40 CFR Part 285, except 265.197(c) and
285.200. In addition, such a generator.is exempt from
'all the requirements in Subparts G and H of 40 CFR Paru
288, except for 285.11 and 285.114.
(2) The date upon which each period of accumulation
'begins is clearly marked and visible for inspection on
each container.
(3) While being accumulated on-site, each container and
tank is labeled or marked clearly with the words,
"Hazardous Waste", and
-~'(4) The generator complies with the requirements for
owners or operators in Subparts C and D in 40 C~R Part
285 and with 285.18.
(b) 'A generator who accumulates hazardous waste for more
than 90 days is an operator of a storage facility and is
subject to the requirements of 40 CFR Parts 264 and 265
and the permit requirements of 40 CFR Part 270 unless he
has been granted an extension to the 90 day period.
Such. extension may be granted by EPA if hazardous wastes
must remain on-site for longer than 90 days due to
unforeseen, temporary, and uncontrollable circumstances.
An extension of up to 30 days may be granted at the
discretion of the Regional Administrator on a case-by-
case basis.
Application must be made with Kern County Environmental
Health Department, 2700 M St.. 861-3636, to properly
permit or close the underground gasoline storage tank.
The above violations must be corrected by May 9, 1991.
The department will schedule a re-inspection of your facility
to verify compliance. If you have any questions re~arding
