There are new programs in the management and siting of storage, treatment and disposal facilities and much stricter regulation of generators. The issue of legal liability for releases of hazardous materials to the enviroment has made compliance with these laws very important. At the same time, new advances in technology have given companies the tools to alter their process so that they become more efficient, ecomi- cal , and protective of the enviroment. These new laws affect industrial people in fields as diverse as electronics, plastics, paints, textiles, leathers, pesticides and on and on. Also affected are their chemical suppliers: those who treat'liquid or solid wastes; hazardous waste transporters; municipalities where hazar- dous wastes are generated, stored, transported, treated, or disposed of; and private citizens interested in their own health, safety, and welfare. The effect of all the new legal requirements is to expand the liability. and responsibility of companies, corporate officers, plant managers, and superintendants, public officials and others who have anything to do with generation, storage, transportation, use, treatment, or disposal of hazar- dous waste. As if these pieces of legislation were not enough, court-made law, know as common law, provides principles of liability for nuisance, neg- ligence, trespass, violation of water rights, and liabiiity for ultra- hazardous activities. One of the obvious ways to reduce these liabilities is to reduce the amount of wastes at the source., where it is generated. Anything that the company can doltocut down on large volume items, such as 55 gallon, or 5 gallon containers should be considered. Another factor to consider is the rising costs of disposal, which makes source reduction more attractive. Thank you, Paul F. Gates Jr. E.P.A.I.D. NUMBER Ail generators of hazardous waste must have a hazardous waste activity number issued by the Environmental Protection Agency. Each generator'site mus[ have its own I.D. number. You will notice below, under installation address, the office for which the booklet was prepared. ..~ ~ ~'~1~,~% ACKNOWLEDGEMENT OF NOTIFICATION m~'cr,'~ o~ HAZARDOUS WASTE ACTIVITY This is to acknowledge that you have filed a Notification of Hazardous Waste Activity for the installation located at the address shown in the box below to comply with Section 3010 of the Resource Conservation and Recovery Act (RCRA). Your EPA Identification Number for that installation appears in the box below. The EPA Identification Number must be included on all shipping manifests for transporting hazardous wastes; on all Annual Reports that generators of hazardous waste, and owners and operators of hazardous waste treatment, storage and disposal facilities must file with EPA; on all applications for~ a Federal Hazardous Waste Permit; and other hazardous waste management reports and documents required under Subtitle C of RCRA. ~,~. SELF INSPECTION CHECK LIST Have I evaluated my entire waste stream to determine if any wastes are hazardous. Do I now have an E.P.A identification number? Is hazardous waste ever stored on site for longer than 90 days? If waste is stored for more than 90 days, does the facility have a permit from the State Department of. Health Services to do so? Are all containers'(drums, buckets, tanks) with hazardous waste stored closed (except when being filled or emptied)? Are all containers with hazardous waste properly and visibly labeled with the contents and starting date of accumulation? · Are containers inspected at least weekly to insure good condition? Are flamable wastes that are stored outside at least 50.feet from the facilities property line? Is a state registered transporter used when hazardous waste is shipped off site? Are records for all hazardous waste transported off site (manifest or receipts) on file for the last three years? Is the hazardous waste being treated, stored or dis- posed at a state authorized facility? Do I have documented records of employees being properly trained in all procedures of proper hazardous waste management? Have I realistically assessed how any possible dis- aster will impair my hazardous waste management procedures? Does the facility have an internal communication or alarm system (intercom or smoke alarms)? Does the facility have an external communication system (telephone or radio)? YES NO DISPOSAL OF PESTICIDE MOST CONTAINERS In California, the label is not the law as it pertains to disposal requirements. This is merely an ~utline only. In your own areas of responsibility you should check local ordinances. Information as it becomes available, will be sent to you as soon as possible. 1. Notice as of April 11, 1986 from the P.C.O.C. states that the Department of Health - Toxic Substance Control Division has rescinded their interpretation of the previous notice dated 4-9-86. Presently it is not legal to dispose of any aerosal container by taking it to a landfill, or by throwing' it into a trash bin, even though empty. 2. Disposal of most pesticide containers; May be taken to landfills after they have been triple rinsed. The procedure for triple rinse is as follows: Example Only Size of Container Amount of Rinse Water A. Less than 5 gallons - ¼ Container Volume B. 5 gallons or over - 1/5 Container Volume Place required minimum amount of rinse water in the container, replace closure securely, and agitate. ' Drain rinse solution from container into tank mix. Allow con- tainer to drain 30 seconds after normal emptying. 3. In case of leakers, banned materials or containers that can- not be triple rinsed see Hazardous Waste section in th~ booklet. 4. Remember to check local regulations for disposal. Hazardous Waste "Hazardous Material" may become "Hazardous Waste" for a number of reasons. It may be that for some reason a pesticide may have lost its registration, or may be the result of a leak and clean-up situation. Spills Pesticide spills of chemicals should be Soaked up with an absorbent material like cat litter or soil and returned to the office in a labeled leakproof 'container. Your office manager will-then seek out the proper method of disposal. Reporting If the situation calls for it, it may be necessary to report 'the release to the proper agencies. The office manager will determine what is necessary. You should consider reporting the "release" if there is a reasonable belief that the release or threatened release poses a significant present or potential hazard to human health, safety, property, or the environment. It may be necessary to notify the Department of Agriculture in your area. It may also be necessary to report the incident to the State Office of Emergency Services. (DES). AB 2185 If an incident occurs while being transported and the hazardous material has been given an "RQ" valve (reportable quantity) by,CE R- CLA, it may be necessary to report the incident to the National Responce Center. Section 117.3 How To Use Haz-Mat Drum In case of an emergency your office is equiped with the necessary materials to handle the situation. The office has one 55 gallon 17-H, tested drum, with lid sealing ring and bolts. Inside this drum you will find one bag of absorbant material (Vermiculite)~ A. Approximately 2 inches of Vermiculite should be Spread to cover the bottom of the.drum. B. Place hazardous material on the absorbant and then cover and surround the hazardous material completely. C. It may not be necessary to use all the absorbant material, if this be the case save'it. D. Now the drum should be released and the Empty Label removed, spray painted over or destroyed in some manner. E. The drum must remain sealed except' to add or remove waste. F. In case of emergency the drum is already labeled with the hazardous waste label and necessary poison labels. G. .Your area manager should then contact the regional manager or the corporate office for instructions on how to fill out warning labels and for other instructions. DOCUMENTATION LABELS HOW TO FILL DRUM STORAGE REQUIREMENTS A generator may store hazardous waste on site in containers and/or tanks for a period of 90 days or less without a permit from the Department of Enviromental Services, Hazardous Waste Section, provided that other regulations are complied with. (Sec.66508) Requirements for containers (i.e. drums and other non-stationary devices): -Containers must be in good condition (i.e. no rusting, and structurally sound). Sec. 67241 -Containers or liners must be compatible with waste stored (i.e. not reactive with the containment material). Sec. 67242 -containers must always be closed except to add or remove waste. Sec. 67243 .-Containers must be inspected weekly for leaks and deterioration. This should be documented. Sec. 67244 -Containers holding ignitables must be stored at least 50 feet from the property line. Sec. 67246 MANIFEST Once the drum has been used it will be necessary to start documen- tation. After receiving proper information for the Waste Label and the top of the manifest (next page), the drum should be inspected weekly, and the condition of the drum nOted. ~ When the drum is picked up, be sure to keep copies of the manifest for your files. The waste hauling company may require their own be used, but be sure to get copies of this.
