1.0 INTRODUCTION
EnecoTech Inc. (EnecoTech) was retained by Argonaut Holdings, Inc. to provide
environmental oversight during the removal of three underground storage tanks (UST) at
the former Penske Cadillac located at 3101-3103 Pacheco Road in Bakersfield, California.
The environmental oversight/assessment activities were intended to verify the effectiveness
of the UST closure and necessary remedial actions. All sampling, analysis and related
activities were performed within the guidelines and intent of federal and state programs
pertaining to public health and safety, USTs, and petroleum hydrocarbons. In addition,
all sampling activities were conducted by a California registered geologist; UST closure
activities were performed in accordance with City of Bakersfield Fire Department, the
signed permit is included in Appendix C. This UST Closure Report presents the findings
of the UST closure and soil excavation, sampling activities, and AST installation.
1.1 Site Setting
The site is located at 3103-3103 Pacheco Road in Bakersfield, California' (Figure 1 -
Appendix A). The site is an automobile dealership which consists of a showroom and
service area. The property is bound by Wible Road on the west, Gasoline Alley on the east,
Pacheco Road on the north and commercial properties on the south. Buried utilities,
including water, sewer, electric, and telephone lines serving the property were not observed
in the vicinity of the USTs.
The USTs were located in the south portion of the property on the southeast and south
central sides of the service building (Figure 2 - Appendix A). The USTs were installed in
1987 and consist of one (1) 10,000-gallon gasoline tank and two (2) 550-gallon waste oil
tanks. All tanks were of steel construction, double-walled, and possessed fiberglass
reinforced plastic corrosion protection. The 10,000-gallon tank was also equipped with a
vapor monitoring system for leak detection.

2.0 FIELD ACTIVITIES
2.1 UST Removal and Closure Assessment
EnecoTech provided environmental oversight during the UST removal and excavation
activities conducted during September 1998. Philip Service Corporation (PSC) was
retained by EnecoTech to conduct the UST Closure.
During the tank removal and soil excavation, a photoionization detector (PID) was used
to monitor the organic vapor concentration. The PID was calibrated onsite to 100 parts
per million (ppm) isobutylene gas. The instrument was used to determine the selection of
representative sampling locations and to asses the necessity of over excavation.
Additionally, visual observations of the excavation pit were also made and recorded.
Photographic documentation of the UST closure activities is included as Appendix B.
Authorization to close and remove the tank was granted by the Bakersfield Fire
Department on duly 17, 1998 via a telephone conversation with Inspector Steve
Underwood. Copies of the State of California Underground storage Tank Permit
Application (Forms A and B), the City of Bakersfield Permit Application For Removal of An
Underground Storage Tank, and the perndt receipt and authorization is included in
Appendix C.
2.2 Site Activities
When EnecoTech personnel arrived onsite on September 11, 1998, the asphalt and
concrete around western waste oil tank (tank #3) was broken up. Fill and vent pipes were
cut and the tank was subsequently pressure washed. Rinsate was collected with a
vacuum truck. On September 12, 1998, the asphalt and soil above the remaining two
tanks was removed. Prior to tank removal, the two waste oil tanks were observed to be
empty; approximately 1,000-gallons of gasoline remained in the 10,000-gallon tank,
therefore, some liqUid waste Was generated during tank removal (in addition to rinsate).
Following steam cleaning of the tanks, Inspector Steve Underwood of the Bakersfield Fire
Department confirmed that measured LELs were acceptable and removal could commence.
No organic vapors were detected by the PID during the tank removal. The USTs were
removed from the ground on September 12, 1998 under the supervision of Inspector
Underwood. Prior to UST removal, dry ice was placed in each tank. The tanks were each
lifted with a crane and inspected while suspended before being loaded onto a flatbed
trailer. No ground water was encountered in the excavation. No holes or cracks were
observed in any of the tanks during the inspection. Upon Inspector Underwood's approval,
tanks the were removed from the site. The USTs were transported to Golden State Metals,
Inc., of Bakersfield, California. The tank pit area was subsequently backfilled and
compacted with pea-gravel and structural fill. Copies of the Certification Statement of
Tank Decontamination and the Certificate of Tank Disposal/Destruction are included in
Appendix D.

The tanks' rinsate was transported as Non-RCRA-California Hazardous Waste to the De-
Mermo/Kerdoon facility, located in Compton, California. A copy of the Uniform Hazardous
Waste Manifest for the rinsate is included in Appendix D.
Four 250-gallon aboveground storage tanks (ASTs) were installed at the site following the
removal of the USTs. The tanks are non-vaulted and of double-walled steel construction.
Two (2) of the tanks will be used to store waste oil on site, and the other two (2) will store
motor oil. No vehicle fueling will be completed on site.
2.3 Soil Samplin_~
The locations, quantity, and associated analyses for soil samples collected beneath the
tanks and dispenser followed the Closure Permit Supplement requirements. Soil samples
were collected approximately two- and six-feet below the bottoms of the tanks and
dispenser pump. Ground water was not encountered in the excavations.
The samples were collected, transported, and stored consistent with USEPA guidelines as
specified in USEPA document USEPA/540/P-87/001 "A Compendium of Superfund Field
Operation Methods" compiled by the Office of Emergency and Remedial Response.
Sampling methodology, preservation of samples, Chain-of-Custody, QA/QC, and
documentation of sampling procedures were performed according to these guidelines. In
addition, all sampling activities were conducted by a California registered geologist.
The soil samples collected were:
Placed in 2 inch wide by 3 inch long brass tubes capped with teflon sheets
and plastic caps;
Placed in plastic bags;
Placed on ice; and
Stored in insulated plastic coolers for transport to the laboratory.
Soil sampling was conducted on September 12, 1998, subsequent to UST removal. In
accordance with the Health and Safety Plan, a backhoe was used to dig a 2- to 3-foot hole
and retrieve soil for each sample collected below the tank chambers. The four soil samples
collected from below the gasoline tank were designated as T1-W-2', T1-W-6', T1-E-2' and
T1-E-6' (one sample each from 2-feet and 6-feet beneath the tank on the west; one sample
from each 2-feet and 6-feet beneath the tank on the east side). Samples collected from
beneath tanks #2 and #3 (waste oil tanks) were designated T2-2', T2-6', T3-2' and T3-6',
respectively (see Figures 3 and 4). Finally, two samples were collected at two- and six-feet
beneath the dispenser and were designated D-2' and D-6', respectively. Sample locations
are shown on Figures 2 and 3 in Appendix A. Chain-of-custody documentation is provided
in Appendix E.

2.4 Analytical Results
The soil samples were submitted to Advanced Technology Laboratories of Signal Hill,
California, a California state-certified laboratory. Chain-of-custody documentation
accompanied all samples to the laboratory. Post-closure confirmation soil samples
collected from beneath the gasoline UST and the dispenser were analyzed for total
petroleum hydrocarbons (TPH) using modified USEPA Method 8015, benzene, toluene,
ethylbenzene and total xylenes (BTEX) and methyl tertiary butyl ether using USEPA
Method 8020. Samples collected from beneath the waste oil USTs were analyzed for total
recoverable petroleum hydrocarbons (TRPI-I) using EPA Method 418.1.
TPHg, benzene and ethylbenzene were not detected above method detection limits in any
of the samples collected from beneath the gasoline US"I'. Toluene was detected in sample
T1-W-6' at a concentration of 0.012 mg/kg. No other samples from beneath the gasoline
tank were found to contain detectable concentrations of toluene. With the exception of Ti-
E-6' in which no xylenes were detected, xylenes were present in samples T1-W-2', T1-W-6'
and T1-E-2' at 0.012 mg/kg, 0.011 mg/kg and 0.0059 mg/kg, respectively. MTBE was
reported in samples T1-W-2', T1-W-6' and T1-E-2' at concentrations of 0.064 mg/kg, 0.134
mg/kg and 0.059 mg/kg, respectively; MTBE was not detected above method detection
limits in sample T1-E-6'.
Sample D-6', collected from beneath the dispenser, was not reported to contain TPHg or
BTEX above method detection limits. Additionally, the two-foot sample (D-2') did not
contain benzene at concentrations above the method detection limit. D-2 was reported to
contain TPHg, toluene, ethylbenzene and x-ylenes at 28 mg/kg, 0.076 mg/kg, 0.228 mg/kg
and 1.920 mg/kg, respectively. MTBE was reported at 0.198 mg/kg and 0.022 mg/kg in
D,2' and D-6', respectively.
Samples T2-2' and T3-6', collected from beneath waste oil tanks //2 and #3, were not
reported to contain TRPH above the method detection limit. TRPH was detected in
samples T2-6' and T3-2' at concentrations of 14 mg/kg and 22 mg/kg, respectively.
Table 1 - Appendix A, summarizes the results of analyses of the UST closure samples and
is included in Appendix E along with copies of the laboratory analytical report, laboratory
quality control data, and chain-of-custody forms.

3.0 CONCLUSIONS
The analytical results for the soil samples collected during the closure of the USTs
indicated that TPHg, TRPH, and BTEX were not detected at levels above the Bakersfield
Fire Department levels of 100 ppm TPH (all ranges) and 100 ppm total BTEX. In addition,
the Bakersfield Fire Department has not established a specific action level for MTBE.
Therefore, no further assessment or remediation activities to address the former USTs or
dispenser appear to be warranted.

4.0 QUALIFICATIONS AND LIMITATIONS
EnecoTech is pleased to have performed environmental oversight during the removal of
three underground storage tanks (UST), at the former Penske Cadillac located at 3101-
$103 Pacheco Road in Bakersfield, California. Argonaut may release this document to
other interested or appropriate parties. These services were performed in accordance with
the scope-of-work described in this report. EnecoTech assumes no responsibility for
detection or assessment of any conditions affecting the property which are beyond the
scope-of-work requested by Argonaut.
EnecoTech has conducted the tasks outlined in the scope-of-work in a manner consistent
with the level of care ordinarily exercised by members of the profession currently practicing
under similar conditions. In performing these tasks, EnecoTech has relied on documents
from parties outside EnecoTech's control. The sources of such information are located in
the appendices of this report. EnecoTech cannot and does not warrant the accuracy of
this information.
No environmental assessment is infallible. Some uncertainty will always exist concerning
the presence or absence of potentially adverse conditions at a particular property,
irrespective of the rigor of the investigation. Accordingly, EnecoTech offers no warranty
that adverse environmental conditions, other than those identified in this report, do not
exist at the subject property or may not exist there in the future~
Argonaut is herewith advised that the CONDITIONS OBSERVED BY EnecoTech ARE
SUBJECT TO CHANGE. Certain indicators of the presence of hazardous materials may
have been latent at the time of the site reconnaissance and may subsequently have
become observable.

construed to limit or preclude the Regional Water Quality Control Board or any
other agency from taking any further enforcement actions.
This letter does not relieve the tank owner of any responsibilities mandated
under the California Health and Safety Code and California Water Code if existing,
additional, or previously unidentified contamination at the site causes or threatens to
cause pollution or nuisance or is found to pose a threat to public health or water
quality. Changes in land use may require further assessment and mitigation.

RE: New Landowner Notification and Participation Requirements
Dear Mr. Stricklen:
This letter is to inform you of new legislative requirements
pertaining to cleanup and closure of sites where an unauthorized release of
hazardous substance, including petroleum, has occurred from an
underground storage tank (UST). Section 25297.15(a) of Ch. 6.7 of the
Health & Safety Code requires the primary or active responsible party to
notify all current record owners of fee title to the site off 1) a site cleanup
proposal, 2) a site closure proposal, 3) a local agency intention to make a
determination that no further action is required, and 4) a local agency
intention to issue a closure letter. Section 25297.15(b) requires the local
agency to take all responsible steps to accommodate responsible
landowners' participation in the cleanup or site closure process and to
consider their input and recommendations.
For purposes of implementing these sections, you have been
identified as the primary or active responsible party. Please provide to
this agency, within twenty (20) calendar days of receipt of this notice, a
complete mailing list of all current record owners of fee title to the site.
You may use the enclosed list of landowners form (sample letter 2) to
comply with this requirement. If the list of current record owners of fee
title to the site changes, you must notify the local agency of the change
within twenty (20) calendar days from when you are notified of the
change.
If you are the sole landowner, please indicate that on the
landowner list form. The following notice requirements do not apply to
responsible parties who are the sole landowner for the site.
In accordance with Section 25297.15(a) of Ch 6.7 of the Health &
Safety Code, you must certify to the local agency that all current record
owners of fee title to the site have been informed of the proposed action
before the local agency may do any of the following:
1) consider a cleanup proposal (corrective action plan)
2) consider a site closure proposal
3) make a determination that no further action is required
4) issue a closure letter
You may use the enclosed notice of proposed action form (sample
letter 3) to comply with this requirement. Before approving a cleanup
proposal or site closure proposal, determining that no further action is
required, or issuing a closure letter, the local agency will take all
reasonable steps necessary to accommodate responsible landowner
participation in the cleanup and site closure process and will consider all
input and recommendations from any responsible landowner.

Preliminary site assessment results from the former Penske
Cadillac underground storage tank site located at 3101 Pacheco Road,
Bakersfield, Ca, yield MTBE concentrations between 0.022 mg/kg (ppm)
and 0.198 mg/kg (ppm). The remainder of the test results are below levels
that we would normally require a full site assessment.
I have enclosed the closure report, including this preliminary
assessment for your review. Per LG letter 153, any closure involving
MTBE must be reported to the Regional Water Quality Control Board
prior to closure. I am requesting concurrence that this site can be closed
with no further action required.

Your letter dated 23 March 1999 requested our review and comment on potential closure of the leaking
underground tank at the subject property. We reviewed the files which you provided to this office, and
we do not object to closure of this site. The following is a brief summary of corrective action at the site,
followed by our comments.
In September 1998, three underground storage tanks (USTs) were removed from the project site. The
USTs were in good condition. One 10,000-gallon UST was used to store gasoline and two 550-gallon
USTs were used to store waste oil. Four soil samples were collected from 2 and 6 feet beneath the
gasoline tank. Soil samples were also collected from 2 and 6 feet beneath each waste oil tank
and beneath the dispenser. Soil samples collected from beneath the gasoline tank and the dispenser were
analyzed for benzene, toiuene, ethylbenzene, and xylenes (BTEX), total petroleum hydrocarbons as
gasoline (TPH-g), and methyl t-butyl ether (MTBE). Soil-samples collected from beneath the waste oil
tanks were analyzed for total recoverable petroleum hydrocarbons (TRPH).
TPH-g was only detected in a soil sample collected from 2 feet beneath the gasoline tank at a
concentration of 28 mg/kg. This sample also contained trace concentrations of toluene, ethylbenzene,
and xylenes. MTBE was detected in soil samples collected from beneath the gasoline tank and dispenser
ranging from nondetect to 0.198 mg/kg. TRPH of 14 and 22 mg/kg were detected in soil samples
collected from beneath the waste oil tanks.
The responsible party proposes to leave the degraded soils in place without any remediation and has
requested closure of the site.
Based'on the information provided to this office, petroleum impacted soils appear to be at low
concentrations and limited to relatively small areas under the former gasoline tank. We do not object to
closure of this site.

UNDERGROUND STORAGE TANK UPDATE
Dear Underground Storage Tank Owner:
You have been receiving monthly updates from this office, regarding the
underground storage tank compliance deadline, since December of 1997. I feel
we must inform you of how serious an impact non-compliance will be to your
business.
On December 23, 1998 (December 22, 1998 deadline) this office will be
forced to revoke your permit to operate, effectively shutting down your fueling
operation. On January 1, 1999, Senate Bill 1491 takes effect, banning fuel
deliveries for those who have not met the compliance upgrade.
After 90 days of closure, your tanks will be considered illegally
abandoned and we will take action to properly close these tanks. If you do not
comply with our tank closure requirement, we will find it necessary to take legal
action, including, but not limited to citation and/or injunctive relief.
It is this offices sincere hope, that we do not have to pursue such action,
which is why we continue to update you. Time is running out, contractors are
booking 6-8 weeks in advance, and costs are climbing at an alarming rate.

have upgraded, removed or replaced their tanks in the first quarter of 1998. This
office is expecting an even bigger second quarter result. This commitment, has
helped this office achieve a 75% compliance average for the underground storage
tanks within the City. This is a very "good start".
For the benefit of those who have not yet upgraded, the City of
Bakersfield and Kern County Environmental Health, will conduct a Underground
Storage Tank Workshop scheduled for Friday, July 17, 1998, from 8:00 a.m. - 12

Dear Underground Storage Tank Owner:
The City of Bakersfield has some exciting news regarding loan monies, which has just
become available through the Small Business Loan Association (SBA).
Pollution Control loans, thru the SBA, are intended to provide loan quarantees to eligible
small businesses for the financing of planning, design, or installation of pollution prevention
controls, which includes underground storage tank facilities.
The vast majority of businesses are eligible for financial assistance from the SBA. The
SBA defines an eligible small business as one that is independently owned and operated and not
dominant in its field of operation. For those applicants that meet the SBA's credit eligibility
standards, the agency can quaranty up to eighty percent (80%) of loans of $100,000. Seventy five
percent (75%) of loans above $100,000. Lynn Knutson, Chief of Finance for the SBA says, "If
customers apply immediately, and meet the requirements, funding is available".
The City of Bakersfield hopes all of our underground storage tank owners take advantage

You will be receiving this letter on our about December 22, 1997. One year
from today, December 22, 1998, your current underground storage tank(s) will
become illegal to operate. Current laws and code requirements would require that
if your tanks are not (r~pla~ed, up~aded) by that date, your permit to
operate would be revoked, - - it will be illegal for any fuel distributer to deliver
fuel to your tank(s), - - and your tank(s) would then be considered illegally
abandoned and require that action be taken within ninety (90) days to remove the
tank(s).
Of course, we have no interest in pursuing this route. We would like to
have your tanks properly handled prior to this December 22,1998 deadline. Please
review your situation and reply within two weeks as to the current (realistic) plans
for your existing tank(S):
As we get closer to the December 22, 1998 deadline, I would expect
construction costs, as well as lead times to increase considerably. If there is
anything this office can do to assist you in your planning, do not hesitate to call.

be registered with the State of California Water Resources Control Board and renew that
registration every five years. Our records indicate five years have passed since your last
State registration pursuant to Section 25287 of the California Health and Safety Code.
This means that for state registration renewal you must submit an Underground
Storage Tank renewal application form, Forms A. B and C completed for each tank at
this'facility (forms included) and a state surcharge of $56.00 for each tank. Please make
your check payable to the City of Bakersfield.

complete the attached Certification of Financial Responsibility form,
An attached letter from the State Water Resources Control Board lists the approved financial responsibility mechanisms
required to pay for corrective actions resulting from leaking underground fuel tanks.
Remember, most tank owners only have to show financial responsibility for at least $10,000 of clean up liability. The
Underground Storage Tank Clean Up Fund (USTCF) may be used as the mechanism to cover the remaining accidental release
liability.
The total amounts of financial responsibility required (check boxes from section A of form) are as follows:
If you don't sell product from you tanks, and you pump less than 10,000 gallons per month,
check "$500,000 per occurrence". Else, or if you are in the business of selling from your
tanks, check "1 million dollars per occurrence".
For owners of 101 or more petroleum underground storage tanks, check the "2 million dollar
annual aggregate" box. All others need only check the "1 million dollars annual aggregate'
box.
Please be aware that failure to provide the financial responsibility document to this office within 30 days will result in
your Permit to Operate being revoked. (25265.1 (b) California Health & Safety Code). ·
