Kern County Department of Public Health Division of Environmental Health 2700 "M" Street Bakersfield, California 93301 Dear- Mr. Theroux: As discussed during out- previous meeting in late November of last year, attached is the Report of Facility Information (RFI) - Plan of Operation to permit a Small Volume Transfer Station near- Mckittrick, California. ]'he attached submittal has been prepared in accordance with the Division of Health Servicers working draft entitled "Preparation of a Report of Facility Information". By copy of this submittal, it is our understanding that Project review wi 11 simultaneously be init iated with the Kern County Planning Department and that if applicable, a Conditional Use Permit will be issued. In addition, we understand that this document will undergo review by c0ther applicable environmental regulatory agencies such as the Sta~e Regional Water Quality Contrnl Board and the Department of Health Services. As solid material is currently being accepted at Sooner's Transfer and Processing Plan~, we would greatly appreciate if review of this project by your department could be expedited. After a short discussion on the following, Ann Bo¥ce suggested this is probably an excellent "action item" for the haz waste task force, and that I draft a review for you: I received a call from Mr. Nathan Smith, Tracer Technologies, 681 Lion's Gate Drive, Ventura (805) 985-6196 this morning, re: statements made by Dave Heath to a client of Tracer's, the Seneca Corporation. Apparently, Heath approached Kelly Erisman, of Seneca's hazardous materials section, with the following proposal: his company is ready to accept waste cuttings, muds, and other solids, whether hazardous, designated or non-hazardous, and either treat the wastes with Portland cement on the generator's site, or truck the wastes to Kern County to the Sooner Inc. site for the treatment. Wastes thus "treated" would be disposed of by Heath/Sooner by use of the material as "road base", or in other unspecified ways. Heath promised to supply each generator with a signed statement of release from liability, and has been assuring the firm that all this disposal would be handled in a "very quiet, discrete manner". Further, Heath told Mr. Erisman that he intended to approach both Santa Fe Energy and Conoco (for wastes from their "grubb" site) with the same proposal, that he and his firm "were ready to roll" Mr. Smith believes Seneca has enough concern to file a sworn deposition of the conversations, if approached by our county agencies. The referenced "Sooner, Inc." project is a proposal to use a Maricopa site for waste processing, strictly non-hazardous, and is not under permit. The project is presently under review for Conditional Use Permit by KCPADS (contact Glen Barnhill), and the proponents have also approached the Fresno RWQCB. I am aware of involvement of Dave Heath only because of calls from the outside;. the key project proponent is a John Webb. KCPADS has issued a written order to Sooner against any such operations prior to issuance of all permits; this indicates Dave Heath/Sooner is prepared to violate that order. Please be aware of the legal constraints upon disposal of "designated" and other classes of non-hazardous waste; illegal disposal below the hazardous contaminant line needs to be pursued for enforcement as well. I'd appreciate a coordinated action through Daphne; as you are aware, this program has a number of current cases trying to deal with the same problems.
