If the trench or excavation is five feet or deeper, applicant shall, at applicant's sole cost, comply with all of the
requirements of Municipal, State, Federal authorities now in force, or which may hereafter be in force, including all
provisions and regulations of the Labor Code of the State of California. Applicant shall be responsible for obtaining
the required permits from Municipal, State and Federal Authorities, PRIOR to proceeding with any of the work.
In consideration of granting this permit, applicant shall indemnify, defend, and hold harmless CITY, its officers, agents
and employees against any and all liabiliw, claims, actions, causes of action or demands whatsoever against them, or
any of them, before administrative or judicial tribunals of any kind whatsoever, arising out of, connected with, or caused
by applicant, applicant's employees, agents, independent contractors, companies, or subcontractors in the performance
of, or in any way arising from, the terms and provisions of this permit whether or not caused in part by a party

EXPLANATION OF ABBREVIATIONS
Probe-Depth'. The number before the hyphen gives the location number of the probe from which the sample was
collected. The location of the given probe is given on the accompanying map, usually Figure 1. The number after
the hyphen gives the depth, usually in feet, at which the sample was collected. The apostrophe indicates that the
depth is in units of feet.
Piping Trench 1. Indicates the beginning of a section in which the listed results that follow are associated with
the piping at the facility.
Tank 1. Indicates the beginning of a section in which the listed results that follow are associated with tank
number one.
Tracer. Each tracer chemical used during the test is identified with a letter designator.
Micrograms per Liter. Tracer concentrations are listed in units of micrograms per liter.
Total Volatile HydroCarbons. The concentration of hydrocarbon vapors is determined for each sample.
Milligrams per Liter. The concentration of hydrocarbon vapors present in each sample is listed in units of
milligrams per liter.
Automatic Tank Gauge, Tank 1. A sample with this designator was collected below the manhole cover and
outside the access riser for the automatic tank gauge.
Fill, Tank 1. A sample with this designator was collected inside the spill bucket at the fill riser.
Fill-Vapor-Recovery-Riser Sump, Tank 1. A sample with this designator was collected' from the sump
containing the fill riser and the vapor recovery riser. The sample was collected below the spill buckets.
Pipe Interstice, Tank 1. A sample with this designator was collected between the primary and secondary
containment walls of the double walled piping. The piping interstice is accessed inside the turbine sump.

Dear Owner/Operator:
Effective January 1, 2003 Assembly Bill 2481 went into effect. This
Bill deletes the requirement for an upgrade certificate of compliance
(the blue stiCker in your window) and the blue fill tag on your fill.
You may, if you wish, have them posted or remove them. Fuel
vendors have been notified of this change and will not deny fuel
delivery for missing tags or certificates.

RE: Necessary secondary containment testing requirements by December 31, 2002 of
underground storage tank (s) located at 1918 M Sweet, Bakersfield, CA.
Dear Tank Owner / Operator,
If you are receiving this letter, you have no~t yet completed the necessary secondary
containment testing required for all secondary containment components for your underground
storage tank (s).
Senate Bill 989 became effective January 1, 2002, section 25284.1 (California Health & Safety
Code) of the new law mandates testing of secondary containment components upon installation
and periodically thereafter, to insure that the systems are capable of containing releases from
the primary containment until they are detected and removed.
Of great concern is the current failure rate of these systems that have been tested to date.
Currently the average failure rate is 84%. These have been due to the penetration boots leaking
in the turbine sump area.
For the last six months, this office has continued to send you monthly reminders of this
necessary testing. This is a very specialized test and very few contractors are licensed to
perform this test. Contractors conducting this test are scheduling approximately 6-7 weeks out.
The purpose of this letter is to advise you that under code, failure to perform this test, by the
necessary deadline, December 31, 2002, will result in the revocation of your permit to
operate.
This office does not want to be forced to take such action, which is why we continue to send
monthly reminders.

You will be receiving this letter on or about December 1, 2002. One
month from today, January 1, 2003, your current underground
storage tank(s) will become illegal to operate. Current law would
require that your permit be revoked for failure to perform the
necessary Secondary Containment testing.
In reviewing your file, I see that you have received "Reminder
Notices" since April of this year. This is your last chance to comply
with code requirements for Secondary Containment testing prior to
January 1, 2003.

The purpose of this letter is to inform you about the new provisions in
California Law requiring periodic testing of the secondary containment of
underground storage tank systems.
Senate Bill 989 became effective January 1, 2002, section 25284.1 (California
Health & Safety Code) of the new law mandates testing of secondary
containment components upon installation and periodically thereafter, to ensure
that the systems are capable of containing releases from the primary
containment until they are detected and removed.
Secondary containment systems installed on or after January 1, 2001 will be tested
upon installation, six months after installation, and every 36 months thereafter.
Secondary containment systems installed prior to January 1, 2001 will be tested by
January 1, 2003 and every 36 months thereafter. REMEMBER! Any component
that is "double-wall" in your tank system must be tested.
Secondary containment testing shall require a permit issued thru this office and
shall be performed by either a licensed tank tester or licensed tank installer.
Please be advised that there are only a few contractors who specialize and have
the proper certifications to perform this necessary testing.
For your convenience, I am enclosing a copy of the code for you to refer to. Once
again, all testing must be done under a permit issued by this office.

REMINDER NOTICE
Dear Tank Owner/Operator:
The purpose of this letter is to inform you about the new provisions in Califomia
Law requiring periodic testing of the secondary containment of underground storage
tank systems.
Senate Bill 989 became effective january 1, 2002. section 25284.1 (California
Health & Safety Code) of the new law mandates testing of secondary containment
components upon installation and periodically thereafter, to ensure that the systems
are capable of containing releases from the primary containment until they are'
detected and removed.
Secondary containment systems installed on or after January 1,2001 shall be tested
upon installation, six months after installation, and every 36 months thereafter.
Secondary containment systems installed prior to January 1,2001 shall be tested by
January 1, 2003 and every 36 months thereafter. REMEMBER!! Any component
that is "double-wall" in your tank system must be tested.
Secondary co .ntainment testing shall require a permit issued thru this office, and
shall be performed by either a licensed tank tester or licensed tank installer.
Please be advised that there are only a few contractors who specialize and have the
proper certifications to perform this necessary testing.
For your convenience, I am enclosing a copy of the code for you to refer to. Once
again, all testing must be done under a permit issued by this office.

§ 2637. Secondary Containment Testing and Annual Maintenance Certification.
(a) Secondary containment systems installed on or after January I, 2001 shall be tested upon installation, 6 months after
installation, and every 36 months thereafter. Secondary containment systems installed prior to January I, 2001 shall be tested by
January I, 2003 and every 36 months thereafter. Secondary containment testing shall be conducted as follows:
(1)By December 31, 2002, the owner or operator of any secondary containment system that the owner or operator
determines cannot be tested in accordance with tiffs section shall replace the secondary containment system with a system
that can be tested in accordance with this section. As an alternative, the owner or operator may submit a proposal and
workplan for enhanced leak detection to thc local agency in accordance with subdivisions 2644. I (a)(l), (2), (4), and (5) by
July !, 2002; complete the program of enhanced leak detection by December 31, 2002; and replace the secondary
containment system with a system that can be tested in accordance with this section by July 1, 2005. The local agency shall
review the proposed program of enhanced leak detection within 45 days of submittal or re-submittal.
(2) Periodic testing of secondary containment systems shall be conducted using a test procedure that demonstrates that thc
system performs at least as well as it did upon installation. For example, if the secondary containment system was tested
upon installation by using a test method that applied a pressure of 5 psi, then the periodic test must be conducted using a
method that tests the system at an equivalent pressure. These tests shall be performed in accordance with manufacturer's
guidelines or standards. If there are no manufacturer's guidelines or standards, secondary containment systems must be
tested using an applicable method specified in an industry code or engine~ng standard. If there are no applicable
manufacturers guidelines, industry codes, or engineering standards a test method approved by a state registered professional
engineer shall be used. ..
(3) Secondary containment testing shall be performed by either a licensed tank tester, licensed tank installer, or any person
meeting the requirements of subsection 2637 (b)(l).
(4) Underground storage tank owners and operators shall submit a copy of the test report to the local agency within 30 days
of the completion of the test.
(5) Owners and operators of underground storage tanks must notify the local agency at least 48 hours prior to conducting the
test, unless this notification requirement is waived by the local agency.
(6) Secondazy containment systems where the continuous monitoring automatically monitors both primary and secondary
containment, such as systems that are hydrostatically monitored or under constant vacuum, are exempt from periodic
secondary containment testing.
(b) All monitoring equipment used to satisfy the requirements of this article shall be installed, calibrated, operated and
maintained in accordance with manufacturer's instructions, and certified every 12 months for operability, proper operating
condition, and proper calibration. Written records shall be maintained as required in section 2712. On or after January I, 2002
the following shall also apply:
(1) Persons performing installation, repair, maintenance, calibration, or annual certification of monitoring equipment shall
meet the following requirements:
(A) Possess a current Class "A" General Engineering Contractor License, C-I 0 Electrical Contractor License, C-34
Pipeline Contractor License, C-36 Plumbing Contractor License, or C-61 (D40) Limited Specialty Service Station
Equipment and Maintenance Contractor License issued by the Contractors State License Board.
(B) Be trained and certified by the manufacturer of the monitoring equipment; and,
(C) Be re-certified by thc manufacturer by completion of a manufacturer's refresher course. Additionally, this
certification shall be renewed at the time interval recommended by the manufacturer, or every 36 months, whichever
is shorter.

(2) Individuals employed by persons performing installation, repair, maintenance, calibration, or annual certification of
monitoring equipment for the purpose of conducting this work shall meet the requirements of 2637(b)(I)(g) and (Cl.
(3) Annual monitoring equipment certification shall be made on a "Monitoring System Certification" form (see Appendix
vi).
(4) UST owners and operators shall submit a completed "Monitonng System Certification" form to the local agency within
30 days after completion of the inspection.
(5) The UST owner or operator shall notify the local agency at least 48 hours prior to conducting the installation, repair,
replacement, calibration, or certification or' monitoring equipment unless the notification requirement is waived by the local
agency.
(6) A person conducting UST monitoring equipment certification shall affix a tag/sticker on each monitoring equipment
component that is being certified, repaired; or replaced. The tag/sticker shall be placed in a readily visible location and shall
include the date the UST component was certified, repaired, or replaced, and the contractor's license number.

Article 4. Existing Underground Storage Tank Monitoring Requirements
§ 2640. General Applicability of Article.
(a) Thc requirements of this article apply to owners or ope~ors of existing underground storage tanks. ,
(b) The requirements of this article apply during the following periods:
(1) Any operating pericd, including any period during which the tank is empty as a result of withdrawal of ali stored
substances before input of additional hazardous substances;
(2) Any period during which hazardous substances are stored in the tank, and no filling or withdrawal is conducted; and
(3) Any period between cessation of the storage of hazardous substances and the actual completion of closure, pursuant to
Article 7, unless otherwise specified by local agency, pursuant to section 267 l(b), during a temporary closure period.
(c) This article shall not apply to underground storage tanks Sat are designed, constructed, installed, and monitored in
accordance with Article 3.
(d) Owners or operators.of tanks monitored pursuant to section 25292(bXSXA) of the Health and Safety Code shall comply with
the requirements of section 2645. Tank systems having a capacity of more than 2,000 gallons shall not be monitored pursuant to
section 25292CoXSXA) of the Health and Safety Code.
(el An owner or operator of an underground storage tank system with a single-walled component that is located within 1,000 feet
ora public drinking water well, as notified by the board according to its Geographic Information System mapping database, shall
implement a program of enhanced leak detection or monitoring for that tank system in accordance with section 2644.1.
Additionally, the following conditions for enhanced leak detection shall apply:
(I) For the purpose of section 2644.1, vent or tank riser piping, vapor recovery piping, and suction piping that meet the
definitions of section 2636(a)(I), (2), or (3), are not considered single-walled components.
(2) Owners or operators notified by the board who believe that their facility is not subject to this requirement may request
reconsideration by the Division of Clean Water Programs Underground Storage Tank Program Manager. The request shall
be in writing and received by the Underground Storage Tank Program Manager within 60 calendar days of the date the
notification was mailed. The Program Manager shall make a decision on the request, and notify the applicable local agency
of this decision, within 90 calendar days of receipt of the request.
(3) The request for reconsideration must include the name and address of the subject facility, the name and address of the
· owner or operator submitting the request, and the-reason(s) why the requester believes the board notification was in error. If

REMINDER NOTICE
Dear Tank OwnedOperator:
The purpose of this letter is to inform you about the new provisions in California law
requiring periodic testing of the secondary containment of underground storage tank
systems.
Senate Bill 989 became effective January 1, 2002. Section 2:5284.1 (California Health &
Safety Code) of the new law mandates testing of secondary containment components
upon installation and periodically thereafter, to ensure that the systems are capable of
containing releases from the primary containment until they are detected and removed.
Secondary containment systems installed on or after Sanuary 1, 2001 shall be tested upon
installation, six months after installation, and every 36 months thereafter. Secondary
containment systems installed prior to January 1, 2001 shall be tested by January 1, 2003
and every 36 months thereafter.
Secondary containment testing shall require a permit issued thru this office, and shall be
performed by either a licensed tank tester or licensed tank installer.
Please be advised that there are only a few contractors who specialize and have the proper
certifications to perform this necessary testing.
For your convenience, I am enclosing a copy of the code for you to refer to. Once again,
all testing must be done under a permit issued by this office.

facility. And label "Facility Information Center" and contains the UST Routine Monitoring
& Response Plan, Hazardous Material Business Plan and other environmental records and

· The reporting of any discrepancies and alarms with the monitoring system, UST, piping,
and associated hardware.
2. SBC - Environmental Management (California & Nevada region) at (800) 75% 6575 is
responsible for all maintenance and repairs to the UST monitoring system, UST, piping, and all
associated hardware.
E. Reporting format:
· An external modem is connected to the TLS - 350 and all alarms are polled daily.
SBC - Environmental Management uses computers with Internal Environmental
Management software program for accessing/polling all facilities with Veeder Root
TLS-350's on a daily basis; of all inventory, alarms, warnings, in tank leak detection,
and sensors leak detection status, performing set up and programming changes, and
system diagnostics with all data being stored.

Preventative maintenance, calibration, certification to manufacturer's specification and repair
for the UST monitoring system and associated hardware are performed on a minimum annually.
SBC - Environmental Management directs, manages, and schedules all maintenance and
repairs for the California and Nevada region's, UST's, piping, associated hardware, and
UST monitoring systems preventative maintenance, calibration, certification and
repairs.
Currently SBC - Environmental Management (Califomia& Nevada region) has an
annual contract with Tait Environmental Systems, 701 North Parkcenter Drive, Santa
Ana, CA 92705, Phone (714) 560-8222 or fax (714) 560-8237 to perform Calibration
and field services.
G. Training:
SBC Hazardous Materials/Wastes Management Handbook, Section 20 Titled
"Underground and Aboveground Storage Tanks" describes the methods and procedures
company employees follow for underground and Aboveground storage tank and
monitoring systems.
UST and the Veeder Root TLS-350 monitoring system operating instructions are on-
site. On-site training is performed on initial start-up of the UST monitoring system and
refresher training is performed on an as needed basis. Training includes this
Underground Storage Tank Monitoring Plan and the Operating manuals for electronic
monitoring equipment.

An unauthorized release of any hazardous substance (unleaded gasoline, diesel fuel) from the
primary containment into the secondary containment (interstitial space, fill sump, piping sump,
and piping vault) will be removed within 8 hours after the release has been detected, or contact
our petroleum maintenance service contractor to remove the product from the secondary
containment, and request additional time (as needed). Removal methods are by hand/electrical
pump for small quantities and by vacuum truck for large quantities.
Small quantities of any hazardous substance will be placed into steel drums. Large quantities
will be placed into a vacuum truck tank.
In the event of a release outside the secondary containment, the fire department will be
contacted immediately calling 9-1-1. In the event of a non-emergency release the Bakersfield
Fire Department will be notified at 805-326-3979.
An SBC authorized vendor will perform removal and disposal of any hazardous substance.
Spill Kits containing Absorbent pads are located on site in the BATTERY AREA for
immediate Reponses to any release.

· Detection Accuracy - The measure of sensor response to the presence of liquids.
· Response Time - Amount of time the detector must be exposed to liquid before it responds.
· Recovery ~me - Amount of time that passes before the detector returns to its baseline reading
after the test liquid is removed.
· Lower Detection Limit - The smallest liquid concentration that the detector can reliably detect.
· Product Activation Height - The height of liquid to cause sensor activation.
· Specificity - Indicates the level of response, of the detector, to several different liquids.

The city will start compliance inspections on all fueling stations
within the city limits. This inspection will include business plans,
underground storage tanks and monitoring systems, and hazardous
materials inspection.
To assist you in preparing for this inspection, this office is
