Gentlemen:
Please consider this letter transmittal of our concurrence with the proposed
plan for the handling, storage, and use of the oil-contaminated soil generated
from an accidental pipeline release near Hinkley, California, on or about
September 16, 1989, as road surfacing material at Edwards Air Force Base.
It is our understanding that the soil, when utilized in conjunction with
SC-800 asphalt mix at a predetermined rate, will result in a product which would
substantially meet industry standards for virgin products of this type. We
therefore would have no objections to use of the material as outlined in the
Edwards Air Force Base letter to you dated February 6, 1990.

Dear Mr. Berger:
Ail American Pipeline Company has developed a proposal for
using oil contaminated desert soil as road surfacing
material on Edwards Air Force Base.
This proposal stems from an accidental release of crude oil
at our station facility near Hinkley, California in San
Bernardino County. After numerous attempts to find an
alternative to hauling this material to distant locations,
we.finally secured an agreement from the Air Force Base to
use the material in an environmentally safe manner for road
surfacing on the base.
We have had the material tested for suitability as road
surfacing material. It has a very high stability and meets
San Bernardino County road standards when mixed with SC800
asphalt. Both the San Bernardino County ~Environmental
Health Department and the Lahontan Water Quality Control
District have recorded agreement with its use in this
manner.
Laboratory analysis of the existing material and after
mixing it with the asphalt material resulted in significant
reductions in the soluble fractions of the crude oil
composition. I have enclosed copies of the relevant data
and correspondence for your review.

In response to your request to Edwards Air Force Base (EAFB) to investigate
our potential and capability to utilize the approximately 5000 cubic yards of
crude oil cont~ntnated soil caused from the pipeline leak adjacent to Hawes
Radio Station west of HinKley, we have determined that we can utilize your
contaminated soil as a material for asphalt mix in road paving projects on
base. It is our understandin~ that the material must be utilized in
conjunction with only SC-800 asphalt mix for surfacin~ roads. Edwards AFB
agrees to accept the soil subject to satisfactory completion of all of the
followir~ measures prior to your transport of any material onto the base
property:
a. Delivery of material to the' Astronautics Lab vicinity must be no

b. The material will be delivered and windrowed alon~ several specified
roads in agreed upon quantities to meet our road pavin~ needs in the area.
c. All American Pipeline Company must provide to EAFB copies of all
laboratory results pertainin~ to the contaminated soil alon~ with copies of
appropriate regulatory agency concurrences with the proposal to utilize the
contaminated soil for road pavin~ projects at the Air Force Astronautics Lab
prior to delivery of any such soils.
d. Specific arrangements for schedulin~, access, points of delivery and
windrow locations will be formalized through the execution of a Standard Form
44 between EAFB and All American'Pipeline Company.
Should these procedures be acceptable to you, please respond in writing
conftrmin~ your agree~nent in principle with our proposal. We can then begin
developin~ a formal agreement throu&h the Standard Form 44 to accept your
material this sprin~. Should you have any questions or comments, please

Regarding the proposal made to this Department to transport soil
that has been mixed with crude oil to a county facility (Roads
Department) for use as a material, that is, it will be mixed with
SC 800, and be applied to roads as an asphalt mix, this Department
has no objections to this use provided it is done in keeping with
standard industry practices, and meets all criteria for such
application. This use is to be managed in an environmentally
sound manner.
However, the Regional water quality control board having
jurisdiction over the locations where the material is to be used
may have additional requirements for it's use. The Department
recommends that this office be informed of your proposed use.

CRUDE OIL RELEASE FROM TWELVE GAUGE STATION, HINKLEY, SAN BERNARDINO COUNTY
Dear Mr. Boll:
This is to follow-up our meeting of October 17, 1989, at which you proposed
use of contaminated soil as a material for an asphalt mix. Currently,
approximately 5,000 cubic yards of cmltaminated soil originating from the
crude oil pipeline release occurring on or about October September 16, 1989,
is stockpiled at the release site near Hinkley. You propose to transport the
material to the San Bernardino County Roads Department. The soil would be
mixed with SC 800 in a cold process for application to roads as paving
material.
Based on samples.and analytical data submitted and information supplied
regarding the mixing process, we have no objections to your proposed use for
the contaminated soil provided the conditions listed below are followed.
The contaminated soil is only that soil originating from the
above-referenced crude oil release and is as described to us and
characterized in your.proposal..
The contaminated soil is transported and otherwise managed in an
environmentally save manner.
The material is mixed and applied according to standard industry
practice and the asphalt mix meets.all Caltrans and other
applicable criteria.
You should be aware that this does not constitute a release from further
investigation at the release site or future liability which may occur as a
result of the crude oil release. Any operations conducted as part of this
project shall comply with all applicable federal, state and local laws.
We encourage reuse of contaminated material when complying with with
environmental guidelines and as such support your proposal. If you have any
questions or comments regarding the above matter, please contact Cindi Mitton

PROPOSED DISCHARGE OF HYDROSTATIC TEST WATER IN KERN COUNTY
Our staff has reviewed the Report of Waste Discharge and technical information
submitted by All American Pipeline Company for the discharge of hydrostatic
test water at five test sites in Kern County. The information reviewed
indicates that the discharge water will not enter any bodies of surface water
and the project will not have adverse effects on waters of the state.
Waste discharge requirements for this project are hereby waived in accordance
with provisions of Board Resolution No. 82-036. This waiver is granted with
the following conditions:
I. Adequate filtration shall be provided in the discharge water to control iron
oxide discoloration (rust) that could result on the receiving soils.
2. Appropriate erosion control measures shall be implemented at each test site
to mitigate potential erosion problems.
3. The discharge water shall not enter surface water.
4. Color photographs shall be taken at each discharge location before each
project is initiated and upon completion of operations. The photographs
shall be submitted to the Regional Board within 30 days following project
completion.
Provisions of the California Water Code require that you inform us of any
changes in the operation which would result in significant changes in the
character, location or volume of the discharge.
