NOTICE OF VIOLATION
AND SCHEDULE FOR COMPLIANCE
Dear Mr. Cooper:
On November 3, 2003, Bakersfield Fire Department Fire Plans Examiner,
Mr. David Weirather, inspected various shops in the Valley Plaza complex.
His concentration centered on exit corridors and the accumulation of
combustibles.
In his inspection of the complex, he found approximately 90% of exit
corridors were in non-compliance with fire code requirements to maintain
clear exit paths as outlined in the 2001 California Fire Code. The shops
inspected were notified that compliance was mandatory and would be re-
inspected. The remaining shops must also comply by November 11, 2003 or
face additional regulatory action.
This is a serious issue that requires your immediate action. Failure to
comply will result in additional regulatory action.
Please notify all parties concerned. The complex will be re-inspected on
November 11th, 2003.

Dear Mr. Cooper:
The following items were observed to be in violation of the Uniform Building
Code during our inspection on July 18.2001.
Kiosks, vending machines and arcades in the main halls are to be a
minimum of 20 feet apart and a minimum of 10 feet on each side to
any part of the building and/or store fronts (UBC 404.4.7)
Permanent kiosks are to be constructed of a fire-resistive material or
removed. (UBC 603.1)
All penetrations of fire walls and ce/lings in secondary exit corridors
by pipes and;or conduits resulting in voids, cracks or holes shall be
sealed by fire resistive mater/als. Mater/als and method of sealing to
be approved by the Building and/or Fire Departments prior to
installation. (UBC 709.6.3)
Dead end-side corridors leading to rear of stores offofsecondary exit
corridors are to have fire rated doors re-installed with "this is not an
exit"fi~. (L~C !004.3.2.4)

Secondary fire exit corr/dors are not to be obstructed with equipment.

Replace exit sign at entrance to secondary corridor - between Macy's-
Spencers entrances. (UBC 1003.2.8.2)
Replace exit sign going from the Oasis tbod court into the main
corridor of the mall. (UBC 1003.2.8.2)
Provide a minimum of 10 feet on each side from the building and/or
any part of the store fronts to tables and/or chairs in the corridor
between the Oasis food court and the main mall corridor. (UBC
404.4.7)
Provide a public address system to be accessible for use bv the Fire
Department. (UBC 404.3.6)

Provide an up-to-date floor plan showing all ma/n and secondary
corridors and names of businesses with space numbers. Must be
legible. You are required to submit to the Fire and Building
Department an up-to-date floor plan whenever a tenant is added or
changed. ((UBC 404.3.8)

Any work done on any plumbing, mechanical, fire sprinkler, smoke
evacuation systems or any construction, tenant improvement effecting
any of the above systems require a building permit and inspection by
the Building and/or Fire Department. (UBC 106.1)
Obtain permits to provide and/or up~m~ade' a smoke control system for
mall and tenant spaces built prior to 1979. (UBC 404.3.3 and 905)
Arrange for inspections of all tenant areas so that they may be
inspected for smoke evacuation systems and any work that mav have
been done without permits.
Provide Fire Alarm throughout entire mall which provides a clear
message to alert occupants of the need to evacuate entire building.
