C. Emergency Action Plan
Forward
A basic system of emergency preparedness has been established to meet requirements of state
and local codes and Company policy. The Nestl6 Ice Cream Company - Bakersfield Plant
makes every effort to meet these requirements and provides for the protection of personnel and
property.
The effectiveness of any "Emergency Response Plan". is dependent on the participation of
employees at all levels in the planning and training activities, which occur prior to an emergency
or disaster.
The Emergency Response Plan is designed as a ready reference tool for use when an actual
emergency occurs. It will enable personnel to know what their responsibility is and what can be
expected from other team members.
In an actual emergency, the safety of personnel and the protection of property may depend on the
action taken by those in the area of the emergency. Therefore, all personnel should familiarize
themselves with the Emergency Response Plan and be aware of the proper steps to take during
an emergency.
In this facility, specific personnel are assigned to an Emergency Response Team. This team
assists in implementation of the Emergency Response Plan. The team provides guidance during
practice evacuations of the facility and during an actual emergency. For their own safety, all
personnel must follow the instructions of these individuals. In order to. critique the efficiency
and effectiveness of the Emergency Response Plan, all plant evacuations will be reviewed and
discussed by management within 48 hours of the evacuation.
General Evacuation Procedures
The following procedures apply to the Team Coordinators/Group Leaders/Lead Operators when
it is necessary to evacuate the plant.
Team Coordinators are responsible to assure personnel are safely evacuated and assembled in
their designated locations. Team Coordinators shall visually inspect their work areas in pairs
(buddy system) on their way out of the plant to ensure all employees have evacuated. Team
Coordinators shall report to the central assembly area, east of the Security Guard Office,
immediately upon exit from the building.
Group Leaders/Lead Operators shall lead employees on their specific line out of the plant
through the closest, safe exit and shall proceed directly to the assembly area east of the
Security Guard Office at the appropriate team sign. All personnel are to remain at this
location until the "all clear" signal has been given by the Incident Commander.
Upon assembly of personnel at their designated location, within the assembly area, the Team
Coordinator, Group Leader, or Lead Operator shall determine if all personnel are accounted
for by making a roll call. The Control Center shall be notified by the Team Coordinator,
Group Leader, or Lead Operator of the head count immediately.
The Control Center shall immediately notify the Incident Commander if any employee is
missing. The Incident Commander will notify the Emergency Response Team or Fire
Department. Nestl6 Ice Cream Company personnel may be assigned to assist the Fire
Department.
Ammonia Release Procedures
A. Purpose
The purpose of these procedures is to outline the responsibilities of the management team
who will be directing activities in the event of an ammonia release. The protection of
employees and Company assets is of the utmost importance.
B. Procedures
1. If there is a visible cloud of ammonia present or heavy odor, employees in that local area
are to be moved to another area and the Utilities/Facilities Team Coordinator is to be

notified immediately. The evacuation alarm should not be activated unless a potentially
life threatening situation exists. The decision to totally, or partially, evacuate the plant is
to be made by the Incident Commander and/or the refrigeration team, as appropriate.
Except in the case of a life-threatening situation, the message to evacuate should be
verbally communicated by Management Personnel from all areas as to avoid
employee panic.
If it is deemed necessary to evacuate and can be done safely without pulling the alarm
box, Senior Management members must consider wind direction. If the Central
Employee Assembly Area is upwind of the release, employees are to assemble in the
designated location as called for in our evacuation procedures. However, if the wind is
blowing in the direction of the Assembly area, the most senior management member must
decide on an alternate safe assembly location. If an alternate assembly location is
necessary, respective Team Coordinators must communicate this.. If the fire alarm pull
box is activated and the wind is in the direction of the Visitor Parking Lot, employees are
to. be directed to an alternate location as they evacuate to the visitor parking lot by Team
Coordinators, or any member of management available. The person pulling the fire
alarm pull box must contact the Security Office immediately by calling extension 599.

Employees must evacuate the plant immediately if the alarm is activated or if instructed
to do so by Management or any Utilities/Facilities Technician. Upon evacuation to the
Central Employee Assembly Area each employee must stay with his or her specific
production line, or department, in order to have an accurate head count conducted. All
employees must evacuate except those trained and authorized personnel (with proper
protective clothing and breathing equipment).
Each Department Manager, or Team Coordinator, in charge must account for each person
under his or her responsibility. Team Coordinators must account for the people on the
production lines, and then report to the Incident Commander. They must give the
Incident Commander a list of the missing emploYees and location of where they were last
seen, if possible.
5. If necessary, the Incident Commander will assign a squad to conduct a search.
C. Responsibilities of Utilities/Facilities Personnel
The Maintenance Manager is responsible for the ammonia release procedures in the
plant. In his/her absence a properly trained, Group Leader on duty is in charge of the
ammonia release activities.
After arriving at the scene of the ammonia release (with proper personal protective
equipment), the Utilities/Facilities personnel must assess the situation as quickly as
possible, and confer with the Incident Commander.
3. Turn on the fans, blowers, and ventilators as deemed appropriate by the Incident
Commander.

4. Utilities/Facilities personnel must not enter a high ammonia concentration (300 ppm or
greater) area without an approved ammonia SCBA and Level A protective equipment.

The Utilities/Facilities personnel must use the "buddy system." Each person must have a
"buddy" and is responsible for staying within sight of theii "buddy.". Each "buddy". must
be dressed out at the same level of protection as the entry person.
It is the responsibility of the Utilities/Facilities Team Coordinator or Group Leader on
duty to contact EHS personnel to. report the status of the ammonia release immediately.
He/she is also. to report as soon as possible if it is safe for the Production Supervisors to
re-enter the plant to get the food ingredients off the lines and have them properly stored.
D. Responsibilities of the Senior Member of Management
1. On first shift, the Plant Manager is the Senior Member of Management. His alternate
shall be a Business Unit Manager.
2. On second shift, the Business Unit Manager is the Senior Member of Management.. His
alternate shall be a designated Team Coordinator.
3. On third shift, the Business Unit Manager is the Senior Member of Management. His
alternate shall be the designated EPSU Team Coordinator.
The Senior Member of Management will set up a Control Center in the Administrative
Conference Room assisted by the Director of Human Resources, Plant Operations or
his/her designee. The ammonia release activities will be monitored from this location via
telephone and two-way radio. If evacuation is necessary this group will follow-up to be
sure all employees have evacuated.

If the media arrives at the plan, the Director of Human Resources, or his/her designee,
will give the news media the appropriate corporate contact. Should the media arrive at
the plant at an hour when the Director of Human Resources, or his/her designee, is not
present, their names(s), station identification, and phone number will be taken and
someone will get back to them.
Members of management near the location of the ammonia release are to keep all persons
not directly involved with facilities in the discovery and repair of the release away from
the scene. Only those employees who are properly trained and equipped to handle an
ammonia emergency should be allowed in the immediate area (this includes non-facilities
management). The Emergency Medical Service (EMS), or any other outside assistance
should be instructed by management to remain at a location several hundred yards from
the scene until their services are needed.

When the release has been stopped, the most senior member of management will make
the decision to allow employees to re-enter the plant and resume production operations,
or to terminate the current shift operations for the day.
E. Responsibilities of Production
When the Incident Commander has given the permission to allow Production Management to
re-enter the plant, the Plant Manager and Business Unit Managers shall appoint a team to
properly take care of the ice cream on the production lines. This team should consist of Lead
Operator, QA Personnel and Production Maintenance Technicians.

F. Responsibilities of The Emergency Response Team
All Emergency Response Team Members not involved in the repair of the ammonia
release shall be on stand-by at the Central Assembly Area. The Emergency Response
Team may be asked to assist in the employee search efforts.
Emergency Response Team Members shall also be on stand-by to spray water at the
ammonia release area. (Only if directed to do. so by the Utilities/Facilities Team
Coordinator or Utilities/Facilities Group Leader.)
G. Authorization to Re-Enter Plant
The authorization for employees to re-enter the plant to resume production can only be given
by the Incident Commander after he/she consults with the Utilities/Facilities personnel on
duty and after the Utilities/Facilities Team Coordinator and EHS personnel have accessed
that the work area is safe for re-entry. Air samples will be taken with the Manning Systems
Inc., monitors which are located in the Utilities/Facilities office, and/or the ammonia
detectors which are located throughout the Production Floor.
H. Medical Treatment For Exposure to Ammonia
In the event an employee is exposed to ammonia the following steps are to be followed in
order to properly care for the individual:
Ingestion: If ammonia is swallowed in liquid form, keep victim warm and immediately
obtain medical attention. If signs of respiratory obstruction develop, immediately transport
to the nearest medical facility. Do not induce vomiting.
Inhalation: Remove victim to fresh air. Give oxygen if breathing is difficult. If breathing has
stopped, perform artificial respiration and obtain immediate medical attention.
Contact with Skin: Apply water immediately to exposed areas of skin and continue for at
least 30 minutes. Remove contaminated clothing, shoes, and constrictive clothing while
continuing to apply water, being careful not to tear the skin. If skin surface is damaged,
apply a clean dressing. If skin surface is not damaged, cleanse the affected area thoroughly
with mild soap and water. Do not apply salves or ointment to affected areas and obtain
immediate medical attention.
Contact with Eyes: Remove victim to fresh air and immediately flush with flowing water for
at least 30 minutes with the eyelids held apart. Obtain immediate medical attention.
Ammonia Spills/Releases Procedures Quick Reference
The following procedure should be followed in the event of an ammonia spill or release:
1. Investigate the cause (Maintenance with protective equipment).

2. Evacuate affected area.
3. Shut down broken lines or system.
4. Contact Fire Department if any vapors go to. outside.
5. Contact the wastewater POTW if any ammonia has gone into. the sewer drains.
6. Vent the affected areas.
7. Control and contain the spill and neutralize the ammonia.
8. If more than 100. pounds (18 gallons) was spilled, EHS personnel or if they are not available,
the Business Unit Manager or his/her designee should contact the following immediately
(within 15 minutes of the incident):
a) National Response Center (get report number and name of person)(800) 424-8802 or
(202) 426-2675.
b) Local Emergency Response Commission (661) 326-3979
c) State Office of Emergency Services (800) 852-7550 or (916) 427-4341.
d) Celeste Miller (818) 549-6337.
9. A written report should be completed by the shift Utilities/Facilities Group Leader stating
dates, times, who, what, where, how, and corrective action taken. This should be given to the
EHS Manager.
10. EHS personnel should be contacted to. monitor employee exposure and limits.
Chemical/Hazardous Material Release and Notification
A. Responsibility of Plant Personnel
If you discover a chemical/hazardous material spill or threatened spill notify the security
office (ext. 599) and the proper response group will be notified of the situation.
Responsibilities of Facilities Management
1. After receiving a report of a spill, first identify the spill location and determine what
resources are necessary to properly respond to the incident.
2. If additional resources are needed contact the appropriate agency for the additional help
(i.e. Fire Department or outside contractor service).

3. EHS personnel will be responsible for notifying the following agencies of the release or
threatened release immediately (within 15 minutes of the incident):

C. Responsibilities of the Emergency Response Team
The Emergency Response Team, which consists of a group of specially trained
employees on all three shifts, will handle specifically assigned duties delegated by the
Incident Commander on that shift.

The Incident Commander will designate a person to begin paging the appropriate
personnel. The Emergency Response Incident Commander or senior plant Emergency
Team Member shall be responsible for obtaining two-way radios in order to maintain
communications.
D. Termination of Chemical/Hazardous Materials Release Procedures
The Incident Commander shall terminate the Chemical/Hazardous Materials Release
Procedures on duty.. If the Evacuation Plan was executed, the notification shall be made at
the Plant Main Entrance. If the employees were not evacuated, the Department Managers
will be contacted to. terminate the Chemical/Hazardous Materials-Release Procedures.
Fire Plan
A. Responsibility of Plant Personnel
If you discover a fire (regardless of the size), pull the nearest fire alarm immediately. After
leaving the fire area, report the nature and location of the fire to the security office (ext. 599)
and evacuate the building.
B. Responsibilities of Facilities Management
After receiving the report of a fire when the alarm is pulled, first identify the fire location
on the alarm zone panel, then check out fire area to ensure the fire exists. If there is a
fire, call the fire department to confirm they were alerted by the fire alarm system. If the
internal telephone system is out of order, use a pay telephone.
After calling the Fire Department, the Utilities/Facilities Team Coordinator or Group
Leader must meet the Emergency Response Team at the designated gathering area. The
Emergency Response Team should respond to the alarm and meet at the designated area

awaiting instruction from the Incident Commander, unless obvious actions should be
taken. The group call for the Emergency Response Team is activated by use of radios
and/or alarm.
After verifying the Fire Department has been contacted the Utilities/Facilities Team
Coordinator or Group Leader must notify the Plant Manager, Business Unit Managers,
and EHS personnel.
If the fire alarm is pulled, the Security Guard at the main entrance shall stop all incoming
traffic with the exception of emergency vehicles (fire truck, ambulance, etc.). The
Security Guard will also be responsible for clearing all non-emergency vehicles from in
front of the entrance gates. The Security Guard must be prepared to tell the Fire
Department personnel the following:
a) Location of the fire.
b) The name of the Nestl6 Ice Cream Company employee to contact in the plant.
C. Responsibilities of the Emergency Response Team
The Emergency Response Team, which consists of a group of specially trained
employees on all three shifts, will handle specifically assigned duties delegated by the
Incident Commander on that shift.

Potential Hazards
Fire or Explosion

· Will be easily ignited by heat, sparks or flames.

· Vapors from liquefied gas are initially heavier than air and spread along ground.
· Vapors may travel to source of ignition and flash back.

Spill Notification
Environment Policy - Guidance on Spill Reporting
Reporting of spills is required under the following Federal legislation:
· Comprehensive Environmental Response Compensation and Liability Act
(CERCL^)
· Emergency Planning and Community Right to Know Act (EPCRA) (often referred to
as the Superfund Amendments and Reauthorization Act, SARA Title - III).
Requirements for reporting under these acts are similar in that listed substances are assigned
reportable quantities whose exceeding during a spill event triggers reporting. Unfortunately, the
reportable quantities are not always the same between lists, and certain States require reporting
of all spill events regardless of size of locations.
Compliance with these spill reporting provisions is mandatory, and it shall be the policy of
Nestl6 Ice Cream Company, operating companies to notify the appropriate agencies (listed
below) in the event of a reportable spill in a timely manner (this should be as soon as possible
after discovery of the spill). If questions arise, you should contact one of the individuals listed
below using your best judgment. It is safer to report a non-reportable spill than to not report a
spill that is later deemed reportable. ~

concern to our operations, however you need to be aware of the entire listing.
