First, this containment system will in no way be used for the storage of toxic or other hazardous materials; it will be used only for the temporary detainment of fire sprinkler water. Second, to ensure that periodic spillage does not seep into the floor drain and temporary detainment system, we will be constructing a one inch lip around said floor drain to ensure that any potential spillage does not inadvertently flow through into our detainment system. Our engineers in Bakersfield, Crosby Engineering, are currently revising our building plans to reflect the design of this one inch lip. You should be receiving a copy of these plans within the next week. Environmental Health Dear Mr. Lucas: This is in response to your request for a letter of concurrence from this Department on the fire sprinkler water tank for the Stockdale 3 project. My understanding of my conversations with you and with Bill Scheide of our Department is that you intend to install a tank as a temporary receptacle for runoff water from a fire sprinkler system required by the Bakersfield Fire Department. Mr. Scheide indicated you originally intended to store various solvents, lacquers, and other hazardous materials in the area covered by this sprinkler system. He also mentioned you were planning to remove these materials from this sprinkler area, and therefore eliminate the possibility of any of those materials mixing with and becoming part of any sprinkler water runoff to this tank. The Department agrees the last arrangement of removing all such materials will exempt the tank from the Environmental Health underground tank construction code and permitting requirements. However, any change in the use of this tank that might place hazardous substances in the tank will require it meet current ordinance standards for secondary containment, leak monitoring, and new construction. If the use of the tank does change, the Department must be notified by the tank owner and the Department will review that usage to determine if a change in regulatory status is necessary. As per a telephone conversation with Mr. Mark Lucas, of Panattoni Development Company, regarding construction of a flammable liquid storage room at 6881 District B1., this letter is being forwarded to you, outlining the requirements from the Uniform Fire Code, dealing with fire or accidental spill of stored product within this room. Due to location of the warehouse building and the Uniform Fire Code requirements to provide a safe location for the fire control water from auto- matic sprinkler to collect, a tank has been proposed by the developer. This tank would be sized to hold the anticipated fire flow from sprinklers; and, in the event there was an emergency, and liquid was directed to this tank, the liq- uid would be removed from the tank as soon as possible when the emergency is over. Again, the emphasis is placed on the fact this tank would only be used to collect liquid and fire sprinkler water in the event of a fire. This liquid would be disposed of properly after the emergency is over. A copy of Fire Code requirements is enclosed. Yours truly, B.W. Goatcher, Captain Fire Safety Control BWG/d 79.202-79.203 UNIFORM FIRE CODE in area and shall be separated from other areas by occupancy separations having a fire-resistive rating not less than one hour for rooms up to 150 square feet in area and not less than two hours where the room is more than 150 square feet in area. Separations from other occupancies shall be not less than required by Table No. 5- B of the Building Code. Liquid Storage Rooms Sec. 79.203. (a) General. Quantities of liquids exceeding those set forth in Section 79.201 shall be within a room complying with the requirements of this section. Such rooms shall be classified as a Group H, Division 2 Occupancy. Liquid storage rooms shall be protected by automatic sprinkler systems installed in accordance with U.B.C. Standard No. 38-1 and Tables Nos. 79.200- C, 79.200-D- 1 and 79.200-D-2. In-rack sprinklers shall also comply with U.EC. Standard No. 81-1. For in-rack sprinklers, alternate lines shall be staggered and multiple levels of sprinkler heads shall be provided with water shields unless separated by horizontal barriers or unless the sprinkler heads are listed for such installations. Racks with solid shelves shall be provided with in-rack sprinklers at every tier or level. Automatic foam-water systems and automatic aqueous film-forming foam- water sprinkler systems may be used when approved by the chief. All liquid storage rooms shall be provided with adequate drainage. Drainage systems shall be sized and designed to carry off any anticipated spill, plus the minimum calculated fire flow of the sprinkler system to a safe location. If connected to a public drain or sewer system, a clarifier shall be installed. (b) Construction. The construction of liquid .,;torage rooms shall be in accor- dance with the Building Code and have a minimum of one exterior wall. (c) Dispensing or Mixing. Liquids shall not be dispensed or mixed in liquid storage rooms unless such rooms comply with the electrical, heating and ventila- tion requirements in Division VIII. (d) Quantities and Arrangement of Storage. 1. General. The quantities and arrangements of liquid storage shall be in accordance with Table No. 79.200-A or 79.200-B, as applicable, and this section. 2. Mixed storage. When two or more classes of liquids are stored in a single pile or single rack section, the maximum quantities permitted in the pile or rack section shall be the smallest of the two or more separate maximum quantities. 3. Where the storage of liquids is on racks, a miniature 4-foot-wide aisle.'shall be provided between adjacent rows of racks and adjaCent'storage of liquids. Main aisles shall be a minimum of 8 feet wide. Aisles shall be provided for access to doors, required windows or ventilation openings. standpipe connections, mechanical equipment, switches, etc. Such aisles may be 3 feet in width, provided they are not r~quired for separation of piles or racks. 1982 EDIT1ON 79.203-79.205 4. Stabilizing and supports for storage. Containers and piles shall be sepa- rated by pallets or dunnage to provide stability and to prevent excessive stress to container walls. Portable tanks stored over one tier high shall be designed to nest securely without dunnage. See Section 2.303 (b) for requirements on portable tank design. Shelving, racks, dunnage, scuffboards, floor overlay and similar installations shall be of noncombustible construction or of wood not less than I- inch nominal thickness. Liquid Storage Waruhouses Sec. 79.204. (a) General. Buildings used for storage of flammable or combus- tible liquids exceeding the quantities set forth in Section 79.201 or 79.203 shall comply with the provislons of this section. Such buildings shall be classified as a Group H, Division 2 Occupancy and shall comply with the requirements of the Building Code for such occupancy. (b) Sprinker Systems. As you may recall, I was concerned that the drainage system as required by applicable fire code for our Stockdale 3 project located at 6881 District Boulevard might be somehow construed as an underground "storage" tank for "hazardous wastes." During our conversation, I believe I mentioned that my previous conversations with Mr. William Goatcher of the Bakersfield Fire Department indicated that this drainage/detention system is not designed for nor intended to be used as a storage receptacle for hazardous waste. Indeed, after our conversation yesterday morning I again spoke with Bill, who indicated that applicable code requires that the storage receptacle be sufficient to hold only these quantities of water r%quired by applicable fire sprinkler output. Consequently, this system will not be used for the detainment or storage of any hazardous waste, and we shall take all reasonable steps to ensure that this drainage system is not used for any purposed other than for its intended use as an emerqency system for the temporary detainment of fire sprinkler and hydrant water. You should be receiving in the next several days a confirming letter from Mr. Goatcher indicating that applicable fire code, which is the purpose for which this system is intended, only requires an emergency system for the temporary detainment of fire sprinkler water. As I'm sure you can appreciate, we are under significant time pressure to quickly resolve this matter. In fact, our lease obligates us to provide for a May 1st occupancy date and our building plans are even now under review by the various City agencies. Accordingly, I would greatly appreciate your response at your earliest possible convenience.
