I.
INTRODUCTION
·
A site characterization study has been performed for a former
underground storage tank site at the F.W. Strickler & Son facili-
ty located at 4546 stine Road in Bakersfield, California. It is
situated in the southeast quarter of Section is, T.30S., R.27E.,
M.D.B.& M. as shown on Figure 1. The property is bounded on the
east by stine Road, on the south by District Boulevard, on the
west by a Rainbo Bakery facility, and on the north by a vacant
lot. The general area is industrial, commercial, and residen-
tial.

The purpose of this study was to determine the degree and extent
of soil contamination resulting from unauthorized releases of
gasoline into the subsurface at the site. This investigation
included an inspection of the site, drilling and logging of 3
hand auger test holes, chemical analyses of selected soil sam-
ples, research of available materials, review of existing data,
and the preparation of this report by Mr. Thomas F. Gutcher,
Registered Geologist No. 5010.

This report was prepared following the guidelines of the Bakers-
field city Fire Department, Hazardous Materials Division. The
investigation reported herein has been conducted in accordànce
with generally recognized and current state-of-the-art geological
procedures. The geological factors that were considered are
outlined in this report. Other geological factors were not
considered inasmuch as they were not deemed relevant to the
intended land use and scope of this investigation. This investi-
gation was conducted to the best of the investigative geologist's
abilities in accordance with the foregoing limitations.

SITE BACKGROUND
·
Former Tank Facilitv
·
A 1,000 gallon gasoline tank was removed from the site on Septem-
ber 29, 1992. The tank was located in the northwest corner of
the site as shown on Figure 2. The tank was made of steel and
was installed at the site around 1978. The tank was reportedly
used for only about one year following installation. There are
no known reports of discrepancies or reportable variations in
inventory monitoring, failed tightness tests, repairs to the tank
or piping, or past leaks. No obvious evidence of leakage was
noted during tank removal.

Preliminary site Àssessment Results
·

Four soil samples were collected following tank removal. The
samples were analyzed for BTXE and TPH gasoline by BC Labora-
tories in Bakersfield, CaÍifornia. Evidence of significant
gasoline contamination wàs detected in two of the samples (sample
#1 and sample #2). The results of the chemical analyses of
sample #1 and sample #2 are included as Appendix A. Sample #1
was collected from a depth of about 2 feet beneath the south end
of the tank (about 8 feet below grade level). It reportedly
contained 16,000 mgjkg TPH gasoline and high levels of the BTXE
constituents. Sample #2 was collected from a depth of about 6
feet beneath the south end of the tank (about, 12 feet below grade
level). It reportedly contained 310 mgjkg TPH gasoline and
moderately low levels of the BTXE constituents. These 'results
indicate product loss beneath the south end of the tank and some
degradation of the soil.

SITE GEOLOGY
·
·
The surface soil on the property is classified as Kimberlina fine
sandy loam, 0 to 2 percent slopes. It is described as a deep,
well-drained soil formed in alluvium derived from granitic and
sedimentary rocks. permeability is moderate, runoff is slow, and
water erosion hazard is slight (U.S. Department of Agriculture,
1988). According to the Geologic Map of California, Bakersfield
·

Sheet (Campbell, 1971), the surficiàl sediments on the property
I.
are Quaternary (Holocene) alluvial fan deposits composed of loose
sand and silt.
·
The sediments encountered in the three test holes drilled during
I
I.
I
I
this investigation, to a depth of 23 feet, consist of a brown,
locally gravelly, sandy silt and silty sand. A yellowish~orange,
poorly graded, gravelly, medium-grained sand was encountered at
23 feet. In general, the sediments are slightly moist and loose
to slightly consolidated. The sediments exhibit a moderate
·
degree of variability typical of Quaternary fan deposits. De-
tailed descriptions are shown on the test hole logs in Appendix
B.
·
According to the Kern county Water Agency (1991a), the depth to
groundwater beneath the property was about 170 feet in September
·
of 1990. The groundwater quality is generally very good (Kern
County Water Agency 1991b). No shallow perched groundwater is
known to exist in the vicinity. No groundwater was encountered
in the three test holes drilled during this investigation, all of
which reached a depth of 25 feet.
·

Based on historic water depth data, collected for the period from
1973 to 1990, the depth to groundwater beneath the site has
fluctuated between about 100 and 175 feet below the surface (see
·

Table 1). The average depth to groundwater beneath the site
during this time period is about 155 feet.
SOIL SÀMPLING
·
·
Three hand auger test holes were drilled at the site on March 5
and 6, 1993 (T.H. Nos. 1 through 3 on Figure 3). Test Hole No.1
was drilled through the presumed center of the contaminátion.
Test Hole No. 2 was drilled nine feet to the north of Test Hole
No.1. Test Hole No. 3 was drilled six feet to the south of Test
·
Hole No.1. All three test holes were drilled to a depth of 25
feet. Soil samples were collected at five foot intervals start-
ing at a depth of 10 feet in each test hole.
·
The borings were drilled with a 2 inch diameter hand auger using
-2, 4 and 5 foot extensions. Soil samples were collected with a
·
hand-driven core sampler. The core sampler holds three 2 inch
diameter by 2 inch long brass liners. After advancing the test
hole to the proper sample depth with the hand auger, the hand
·
auger was carefully removed and the core sampler inserted into
the boring. The core sampler was then driven into the soil using
a hand-actuated impact hammer. The brass liners were then
·
removed from the sampler and one liner was immediately covered
e.
with Teflon seals and polyethylene caps ánd taped shut with duct
tape. Each brass liner, after being sealed and taped, was
labeled and placed in a polyethylene sample bag which was then

labeled and sealed. Each sealed sample was placed in àn ice
·
chest and retained in a chilled state on blue ice for transport
to the laboratory.
·
Another soil sample from each sample depth was retained for field
screening and soil descriptions. Field screening consisted of a
·
headspace reading for hydrocarbon vapors with an Hnu PID meter.
In addition to the headspace readings, hydrocarbon odors, if
detected, were noted. The sampling equipment was scrubbed,
washed and thoroughly rinsed between each sample collection.
·
RESULTS OF SITE CHARACTERIZATION
·
Seven of the soil samples collected from Test Hole Nos. 1 through
3 were submitted for chemical analyses. The samples were ana-
·
lyzed for TPH gasoline and BTXE by BC Laboratories in Bakers-
field. The analytical methods utilized by BC Laboratories are
listed on the laboratory reports included in Appendix C. The
quality assurance and quality control of the laboratory are
·
available from BC Laboratories on request. The analytical
results of the seven soil samples submitted for analyses along
·
with the chain of custody record are included in Appendix C.
Table 2 shows a summary of the analytical results in tabular
form.

The 15, 20, and 25 foot samples from Test Hole No. 1 were ana-

lyzed. The 15 and 25 foot samples from Test Hole No. 2 were ana-
lyzed. The 20 and 25 foot samples from Test Hole No. 3 were ana-
lyzed. No TPH gasoline or BTXE constituents were detected in any
of these samples.

CONCLUSIONS AND RECOMMENDATIONS
·
As expected, the extent of gasoline contamination at the former
tank location is very minor. Gasoline odor was noted in the 15
· foot sample from Test Hole No. 1, but was not detected by labora-
tory analysis (see Appendix B, page B-1). No contamination was
·
detected below a depth of 12 feet (see Table 1). The lateral
extent of the contamination is also minor. since Test Hole No. 3
was located only 6 feet from Test Hole No.1, the lateral extent
of contamination is probably less than 12 feet in diameter. The
amount of contaminated soil is estimated to be between 5 and 50
cubic yards.

since only the two preliminary site assessment samples showed
detectable contamination, no meaningful cross sections or plume
maps can be developed. The gasoline contamination is too limited
to show a contaminant plume. Furthermore, remediation of this
limited contamination does not seem appropriate. It poses no
significant threat to groundwater or other aspects of the envi-
ronment and should have no adverse affect on biological

Per our conversation today, F.W. Strickler and Son is required to complete an
assessment to define the vertical and horizontal'extent of contamination associated with
the former underground fuel storage tank removed at 4546 Stine Road. This
requirement is in accordance with Chapter 6.7 of the California Health and Safety code
and Chapter 16, Title 23 of the California Code of Regulations.
Our letter of October 22, 1992 clearly requested this additional work, in order to define
the extent of the gasoline contamination present.
In order to avoid regulatory action, please submit your work plan for further assessment
to this office by May 1 0, 1993. The work plan should follow guidelines found in
Appendix A-Reports, Tri-Regional Board, Staff Recommendations for Preliminary
Evaluation and Investigation of Underground Tank Sites, January 22, 1991.

SITE BACKGROUND
·
The F.W. strickler & Son facility is located at 4546 stine Road
in Bakersfield, California. It is situated in the southeast
quarter of section 15, T.30S., R.27E., M.D.B.& M. as shown on
Figure 1. The property is bounded on the east by stine Road, on
the south by District Boulevard, on the west by a Rainbo Bakery
facility, and on the north by a vacant lot. The general area is
industrial, commercial, and residential.

One 1,000 gallon gasoline tank was removed from the site on
September 29, 1992. The tank was located in the northwest corner
of the site as shown on Figure 2. The tank was made of steel and
was installed at the site around 1978. The tank was reportedly
used for only about one year following installation. There are
no known reports of discrepancies or reportable variations in
inventory monitoring, failed tightness tests, repairs to the tank
or piping, or past leaks. No obvious evidence of leakage was
noted during tank removal.

PRELIMINÀRY SITE CHARACTERIZATION RESULTS

Four soil samples were collected following tank removal. The
samples were analyzed for BTXE and TPH gasoline by BC Labora-
tories in Bakersfield, California. Evidence of significant
gasoline contamination was detected in two of the samples (sample
#1 and sample #2). The results of the chemical analyses of
sample #1 and sample #2 are included as Appendix A. Sample #1
was collected from a depth of about 2 feet beneath the south end
of the tank (about 8 feet below grade level). It reportedly
contained 16,000 mg/kg TPH gasoline and high levels of the BTXE
constituents. Sample #2 was collected from a depth of about 6
feet beneath the south ehd of the tank (about 12 feet below grade
level). It reportedly contained 310 mg/kg TPH gasoline and
moderately low levels of the BTXE constituents. These results
indicate product loss beneath the south end of the tank and some
degradation of the soil. The major decrease in contaminant
levels from the 2 foot depth to the 6 foot depth suggests that
the contamination is not very extensive.

SITE GEOLOGY
·
The surface soil on the property is classified as Kimberlina fine
sandy loam, 0 to 2 percent slopes. It is described as a deep,
well-drained soil formed in alluvium derived from granitic and
sedimentary rocks. Permeability is moderate, runoff is slow, and
·

water erosion hazard is slight (U.S. Department of Agriculture,
1988). According to the Geologic Map of California, Bakersfield
Sheet (Campbell, 1971), the surficial sediments on the property
are Quaternary (Holocene) alluvial fan deposits composed of loose
sand and silt.
According to the Kern County Water Agency (1991a), the depth to
groundwater beneath the property was about 170 feet in September
of 1990. The groundwater quality is generally very good (Kern
County Water Agency 1991b). No shallow perched groundwater is
known to exist in the vicinity.

SOIL SAMPLING PLAN
Three test holes are proposed to assess the vertical and lateral
extent and the degree of contamination associated with the
gasoline tank. The proposed boring locations are shown on Figure
3. Test Hole No.1 is assumed to be near the source of the
contamination and will be used to assess the vertical extent of
contamination. Test Hole Nos. 2 and 3 are offset borings intend-
ed to acquire data to delineate the lateral extent of contamina-
tion. The locations of Test Hole Nos. 2 and 3 may be altered
slightly depending on the results of the preceding sampling.
The large decrease in the degree of contamination between sample
#1 and sample #2 suggests that the contamination is limited to

shallow depths. Therefore, it is proposed that the facility be
assessed using hand auger borings. The borings will be drilled
until the maximum vertical extent of contamination is exceeded or
to a depth of 25 feet. If contamination is found to exceed a
depth of 25 feet or if conditions do not permit drilling to
adequate depths with a hand auger, additional drilling, using a
truck-mounted drilling rig, may be necessary. Groundwater should
not be encountered at the shallow depths proposed herein and will
not be considered further in this work plan.

Soil samples will be collected at 5 foot intervals starting at a
depth of 10 feet below the surface. Approximately 12 soil
samples will be collected and field-screened. Selected samples
will be submitted for analyses. Soil samples will be analyzed
for TPH gasoline using Modified EPA Method 8015 and for BTXE
using EPA Method 5030/8020.

The soil samples will be analyzed by BC Laboratories in Bakers-
field. The quality assurance and quality control of the labora-
tories are available from the laboratories upon request. Chain
of custody records documenting sample handling will be included.
·
The borings will be drilled with a 2 inch diameter hand auger
using 4 and 5 foot extensions. Soil samples will be collected
with a hand-driven core sampler. The core sampler holds three 2
inch diameter by 2 inch long brass liners. After advancing the
·

test hole to the proper sample depth with the hand auger, the
·
hand auger will be carefully removed and the core sampler insert-
ed into the boring. The core sampler will then be driven into
the soil using a hand-actuated impact hammer. The brass liner
·
will then be removed from the sampler and immediately covered
with Teflon seals and polyethylene caps and taped shut with duct
tape. Each brass liner, after being sealed and taped, will be

labeled and placed in a polyethylene sample bag which will then
be labeled and sealed. Each sample will be placed in an ice
chest and retained in a chilled state on blue ice for transport
·
to the laboratory.
Another soil sample from each sample depth will be retained for
·
field screening and soil descriptions. Field screening will
consist of a headspace reading for hydrocarbon vapors with an Hnu
PID meter. In addition to the headspace readings, hydrocarbon
·
odors, if present, will be noted.
The sampling equipment will be scrubbed, washed and thoroughly
·
rinsed between each sample collection. The test holes will be
backfilled with bentonite chips. contaminated drill cuttings, as
identified by field screening, will be placed in DOT drums for
·
future treatment or disposal by the client.

SITE SAFETY PLAN
F.W. STRICKLER & SON FACILITY
Introduction
·
A Site Safety Plan (SSP) has been designed to address safety provisions needed during the site
..
investigation work. Its purpose is to provide established procedures to protect all on-site
personnel from direct skin contact, inhalation, or ingestion of potentially hazardous materials that
may be encountered at the site. The SSP establishes personnel responsibilities, personal
·
protective equipment, standard decontamination procedures, and emergency action plans.
·
The purpose of this work is to investigate the degree and extent of gasoline contaminated soil.
Smith-Gutcher and Associates, Inc. plans on drilling three hand auger soil borings around an
abandoned underground tank facility. The SSP describes means for protecting all on-site
·
personnel from contamination or personal injury while conducting on-site activities. As
described below, we will meet all requirements of the California Department of Health Services.

The property contained one 1,000 gallon underground gasoline storage tank storage tank. The
tank was removed on September 29, 1992. Soil contamination associated with the tank was

Responsibilities of Key Personnel
·
All personnel on-site will have assigned responsibilities. Tom Gutcher, California registered
o
·
geologist, will serve as Project Manager, field technician, and site safety officer (SSO). Mr.
Gutcher will assure that all on-site personnel have a copy of the site safety plan. Personnel will
be required to document their full understanding of the SSP before admission to the site.
·
Compliance with the site safety plan will be monitored at all times. A training session will be
conducted to assure that all personnel are aware of safe work practices. In the training session,
personnel will be made aware of hazards at the site. Mr. Gutcher will be responsible for
·
keeping field notes, collecting soil samples, and following chain-of-custody protocol.
·
On-site employees will take reasonable precautions to avoid unforeseen hazards. After
documenting understanding of the SSP, each on-site employee will be responsible for strict
adherence to all points contained herein. Any deviation observed will be reported to the SSO
·
and corrected. On-site employees are held responsible to perform only those tasks for which
they believe they are qualified. Provisions of this SSP are mandatory and personnel associated
·
with on-site activities will adhere strictly hereto.

.Job Hazard Analysis

Hazards likely to be encountered on-site include those commonly encountered when operating
any mechanical equipment, such as the danger of falling objects or moving machinery. Simple

precautions will reduce or eliminate risks associated with operating such equipment.

An assistant will be employed to help drill and sample three soil borings with a hand auger.
Only qualified personnel will have any contact with drilling and sampling equipment. All on-site
personnel are required to wear hard hats when in close proximity to the drilling equipment.

Proper respiratory equipment will be worn if vapor contamination levels on-site exceed action
levels as determined using a PID. Action levels requiring respiratory apparatus will be 10 ppm
in the breathing zone. Furthermore, no smoking, open flame, or sparks will be permitted during
·
drilling operations in order to prevent accidental ignition.
·
Risk Assessment Summary
Exposure to chemicals anticipated on-site include benzene, toluene, xylene, and ethylbenzene
·
(BTXE), and gasoline. These chemicals represent a hazard because they are moderately to
extremely toxic and highly flammable. The Threshold Limits Values (TL V), Short Term
·
Exposure Limits (STEL), and Toxicity levels, all in ppm, are listed below:

A Photo-Ionization Detector (PID) will be used to monitor vapor concentrations around the site.
Should concentration~ exceed TL V levels, protective measures will be taken.

Personal Protective Equipment

Personnel on-site will have access to respirators with organic vapor cartridges. Replacement
cartridges will be available on-site as needed. Hard hats will be worn by all personnel on-site
when in close proximity to the drilling equipment.

Work Zones and Security Measures
·
Access to the area of. investigation will be restricted to authorized personnel. The Project
Manager will be responsible for site security.

Decontamination Measures
Avoidance of contamination whenever possible is the best method for protection. Common
sense dictates that on-site personnel avoid sitting, leaning, or placing equipment on possible
contaminated soil. All personnel will be advised to wash their hands, neck, and face with soap
and water before taking a break or leaving the site. If respirators are used, they will be washed
with soap and water foJJowing each day's use. Sampling equipment will be decontaminated
before each sample is coJJected.
General Safe Work Practices
On-site personnel will be briefed each day in "tailgate" meetings as to the day's goals and
equipment to be used. Anticipated contaminants and emergency procedures will be reviewed.
The Project Manager will oversee operations and act as the sample coordinator to assure that
proper protocol is used at all times in collecting and handling samples.
Trainin! Requirements
The SSO will inform aJJ personnel on site of contaminant properties, health hazard data, risk
from exposure, and emergency first aid. All chemicals present will be discussed and the SSO
will assure that everyone fully understands site hazards.

Medical Surveillance Proeram

According to 29 CFR 1910.120 Paragraph (f), employees who wear respirators 30 days or more
during one year or who have been exposed to hazardous substances or health hazards above

established permissible exposure limits are required to be monitored medically.
·
Record KeeDine
Documentation will be kept on personnel exposed to contaminant hazards on the job site
·
according to OSHA regulations. These will include documentation that employees have received
training on the SSP, respiratory protection, and all emergency procedures. These will be
reviewed during the pre-site training.
·
Exposure records on each job will be kept for 30 years to meet requirements. Included will be
·
names and social security number of employees, on-the-job logs from entry to exit, first aid
administered, visits on-site by outside persons, and personal air monitoring records.

Upon review of the recently submitted laboratory results from your
facility, this office has determined that the extent of the
contamination plume, associated with the gasoline tank previously
located on your property, has not been adequately defined.
This office requires (in accordance with Chapter 6.7 of the
California' Health and Safety Code and Chapter 16, Title 23 of the
California Code of Regulations) that further assessment be done to
define the vertical and horizontal extent of the contamination
plume.
Please submit a work plan for further assessment, to this office,
with in 30 days from receipt of this letter. The work plan should
follow guidelines found in: Appendix A - Reports, Tri - Regional
Board Staff Recommendations for Preliminary Evaluation and
Investigation of Underqround Tank Sites; January 22, 1991.
Additionally, be advised that oversight cost for this project will
be billed to you at a rate of $47.50 per hour.

On September 29, 1992, CALPI, Inc. removed 1 - 1,000 gallon
underground tank from F. W. Strickler at 4546 Stine Road,
Bakersfield, California_93313.
The tanks were decontaminated on site using a high pressure steam
cleaner and inerted with dry ice. Rinsate was disposed of at Gibson
Environmental in Bakersfield, California under hazardous waste
manifest # 91482491. The tanks were removed to Golden state Metals.
Soil was sampled under the direction of the Kern County Health
Department. The samples were analyzed at B.C. Laboratories of
Bakersfield for TVH gas, BTX & E. A complete chemical analysis is
enclosed.
In addition to the lab results, copies of the manifest, chain of
custody and the tank disposition tracking record are enclosed.

Depanments).
2. Permittee must notify the Hazardous Materials Management Program at (805) 861-3636 two working days I'rior to tank removal or abandonment in place to
arrange for required inspections(s).
3. Tank closure activities must be per Kern County Environmental Health and Fire Depanment approved methods as described in Handbook UT-30.
4. It is the contractor's responsibility to know and adhere to all applicable laws regarding the handling, transponation or treatment of hazardous materials.
S, The tank removal contractor must have a qualified company employee on site supetvising the tank removal, The employee must have tank removal experience
prior to working unsupervised.
6. If any contractors other than those listed on permit and permit application are to be utilized, prior approval must be granted by the specialist listed on the
permit. Deviation from the submitted application is not allowed.
7. Soil Sampling:
a. Tank size leas than or equal to 1,000 gallons - a minimum of two samples must be retrieved from beneath the center of the tank at depths of
approximately two feet and six feet.
b. Tank size greater than 1,000 to 10,000 gallons - a minimum of four samples must be retrieved one-third of the way in from the ends of each tank
at depths of approximately two feet and six feet.
c. Tank size greater than 10,000 gallons - a minimum of six samples must be retrieved one-Counh oC the way in from the ends oC each tank and beneath
the center of eacb tank at depths of approximately two feet and six feet.
8. Soil Sampling (piping area): .
A minimum of two samples must be retrieved at depths of approximately two feet and six feet for every 15 linear feet of pipe run and under the dispenser area.

9. Soil Sample analysis:
a. All soil samples retrieved from beneath gasoline (leaded/unleaded) tanks and appurtenances must be analyzed for benzene, toluene, xylene, and total
petroleum hydrocarbons (for gasoline).
b. All soil samples retrieved from beneath diesel tanks and appurtenances must be analyzed for total petroleum hydrocarbons (for diesel) and benzene.
c. All soil samples retrieved from beneath waste oil tanks and appurtenances must be analyzed for total organic halides, lead, oil and grease.
d. All soil samples retrieved from beneath crude oil tanks and appurtenances must be analyzed for oil and grease.
e. All soil samples retrieved from beneath tanks and appurtenances that contain unknown substances must be analyzed for a full. range of substances
that may have been stored within the tank.
10. The following timetable lists pre- and post-tank removal requirements:

11. Purging/Inerting Conditions:
a. Uquid shall be pumped from tank prior to purging such that less than 8 gallons of liquid remain in tank. (CSH&SC 417(0)
b. Tank shall be purged through venl pipe discharging at least 10 feet above ground level. (CSH&SC 41700)
c. No emission shall result in odors detectable at or beyond property line. (Rule 419)
d. No emission shall endanger the health. safety, comfort or repose of any person. (CSH&SC 41700)
e. Vent lines shall remain attached to tank until the inspector arrives to authorize removal.
RECOMMENDAT10NSfGUIDELINES FOR REMOVAL OF UNDERGROUND STORAGE TANKS
This department is responsible for enforcing the Kern County Ordinance Code, Division 8 and state regulations pertaining to underground storage lanks.
Representatives from Ihis department respond to job sites during tank removals to ensure that Ihe tanks are safe to remove/close and that the overàll job performance
is consistent with permit requirements, applicable laws and safety standards. The following guidelines are offered 10 clarify the interests and expectations for this
department.
1. Job site safety is one of our primary concerns. Excavations are inherently dangerous. It is the contractor's responsibility to know and abide by CAL-OSHA
regulations. The job foreman is responsible for the crew and any subcontractors on the job. A$ a general rule. workers are not permitted in improperly sloped
excavations or when unsafe conditions exist in the hole. Tools and equipment are to be used only for their designed function. For example, backhoe buckets
are never substituted for ladders.
2. Properly licensed contractors are assumed to understand the requirements of the permit issued. The job foreman is responsible for knowing and abiding by
the conditions of the permit. Deviation from the permit conditions may result in a stop-work order.

Individual contractors will be held responsible for their post-removal paperwork. Tracking forms, hazardous waste manifests and analyses documentation are
necessary r ch site in order to close a case file or move it into mitigation. When contractors do not follow through on necessary paperwork. an
unmana ble acklog of incomplete cases results. If this continues, processing time for completing new closures will increase.

It has come to our attention that you currently own property
located at 4546 Stine Road (APN 384-021-07), Bakersfield, CA which
contains at least one underground storage tank. The tank has been
out of service and you are in violation of the following sections
of code.
California H&SC:
Sec. 25284(a), Failure to obtain a permit to own and operate
'an underground storage Facility for Hazardous Material;
Sec. 25298, Failure to properly close an underground tank;
Sec. 2587(a&b), Failure to pay city fees and state surcharge
for underground tanks;
Sec. 25292, Failure to monitor and maintain records.
Uniform Fire Code:
Sec. 79.115 (a,b,& f);
(a) Failure to remove or safeguard an out of service
tank(s),
(b) Failure to obtain an permit to remove or temporarily
close an underground tank(s),
(f) Failure to remove an underground tank out of service for
one (1) year.
Violations of the Health and Safety Code are punishable by fines of
not less than $500.00 or more than $5,000.00 per> day, per
violation, per tank.

The Uniform Fire Code violations are misdemeanor offenses and
punishable by fines and imprisonment.
Please make arrangements to properly abandon the tank(s) by
Setember 30, 1992 to avoid further action.
