BOX 3289 BAKERSFIELD CA 93385 ATTN: PLANT MGR / SAFETY DIR. Dear Customer: Recently, the State of California implemented the "Safe Drinking Water and Toxic Enforcement Act of 1986," commonly referred to as Proposition 65. This law requires, in part, that "No person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the State to cause cancer or reproductive toxicity without first giving clear and reasonable warning to such individual..." (Section 25249.10). Proposition 65 assumes that cancer or reproductive toxicity will be associated with low level exposures to the listed chemical. It generally makes no distinction in the warning required for potential exposure to a trace level of a listed chemical. Valvoline, Inc. and its subsidiaries, MAC's Oil & Chemicals, Inc. and IG-LO, Inc. subscribe to the scientific position that the degree of exposure is an essential factor in health hazard determination and that the exposure to low levels of listed chemicals does not necessarily pose a hazard of cancer or reproductive toxicity. However, to qualify for an exemption from the warning requirement, Section 25249.10 states in part: Section 25249.6 shall not apply to any of the following: a. An exposure for which federal law governs warning in a manner that preempts State authority. b. An exposure that takes place less than 12 months subsequent to the listing of the chemical in question on the list required to be pUblished under Subdivision (a) of Section 25249.8. c. An exposure for which the person responsible can show that the exposure poses no significant risk assuminç¡ lifetime exposure at the level in question for substances known to the State to cause cancer, and that the exposure will have no observable effect assuming exposure at one thousand (1,000) times the level in Question for substances known to the State to cause reproductive toxicity based on evidence and standards of comparable scientific validity to the evidence and standards which form the scientific basis for the listing of such chemical pursuant to Subdivision (a) of Section 25249.8. Valvoline, Inc. and its subsidiaries, MAC's Oil & Chemicals, Inc. and IG-LO, Inc. manufacture and market products under numerous health, safety, and environmental regulations designed to protect health and the environment. Many of these regulations already require warnings regarding potential health hazards from certain chemicals. However, it is not yet yet clear in what specific situations additional warnings will be required in order to comply with Proposition 65. Accordingly, given this uncertainty, we are providing to our customers the following warning: WARNING Various products you purchase from us in trace amounts, contain one or more chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. Read and follow label directions and information given on the Material Safety Data Sheets. Use care when handling any chemical product. You should advise your customers and employees of these possible hazards as is appropriate under the regulations issued pursuant to Proposition 65. If you have any questions or need additional information regarding any of these products, please call us at 1-800-ASHLAND. A copy of this letter can be posted where these product are presented for sale in order to advise the purchaser of the hazard. <: 7Z-62-78Z5-11 ~&, Ya/vo//ne. Dear Customer: Recently, the State of California implemented the "Safe Drinking Water and Toxic Enforcement Act of 1986," commonly referred to as Proposition 65. This law requires, in part, that "No person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the State to cause cancer or reproductive toxicity without first giving clear and reasonable warning to such individuaL" (Section 25249.10). An exposure for which federal law governs warning in a manner that preempts State authority. b. An exposure that takes place less than 12 months subsequent to the listing of the chemical in question on the list required to be published under Subdivision (a) of Section 25249.8. c. An exposure for which the person responsible can show that the exposure poses no significant risk assuminQ lifetime exposure at the level in question for substances known to the State to cause cancer, and that the exposure will have no observable effect assuming exposure at one thousand (1,000) times the level in question for substanc¡)s known to the State to cause reproductive toxicity based on evidence and standards of comparable scientific validity to the evidence and standards which form the scientific basis for the listing of such chemical pursuant to Subdivision (a) of Section 25249.8. If you have any questions or need additional information regarding any of these products, please call us at i-800-ASHLAND, A copy of this letter can be posted where these product are presented for sale in order to advise the purchaser of the hazard. 72-62-7825-11 .. ENVIRONMENTAL HEALTH & SAFETY DEPARTMENT Product Safety Group CARQUEST-FRESNO D.B.A. AUïO PARTS WHSLE P.O. An exposure for which federal law governs warning in a manner that preempts State authority. b. An exposure that takes place less than 12 months subsequent to the listing of the chemical in question on the list required to be published under Subdivision (a) of Section 25249.8. c. An exposure for which the person responsible can show that the exposure poses no significant risk assuminQ lifetime exposure at the level in question for substances known to the State to cause cancer, and that the exposure will have no observable effect assuming exposure at one thousand (1.000) times the level in question for substances known to the State to cause reproductive toxicity based on evidence and standards of comparable scientific validity to the evidence and standards which form the scientific basis for the listing of such chemical pursuant to Subdivision (a) of Section 25249.8. Accordingly, given this uncertainty, we are providing to our customers the following warning: WARNING Various products you purchase from us in trace amounts, contain one or more chemicals known to the , State of California to cause cancer, birth defects, or other reproductive harm. Read and follow label directions and information given on the Material Safety Data Sheets. Use care when handling any chemical product. You should advise your customers and employees of these possible hazards as is appropriate under the regulations issued pursuant to Proposition 65. If you have any questions or need additional information regarding any of these products, please call us at 1-80D-ASHLAND. A copy of this letter can be posted where these product are presented for sale in order to advise the purchaser of the hazard. 72-62-7825-11 MATERIAL SAFETY DATA SHEET Ya/yoúne. Dear Customer: Recently, the State of California implemented the "Safe Drinking Water and Toxic Enforcement Act of 1986," commonly referred to as Proposition 65. This law requires, in part, that "No person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the State to cause cancer or reproductive toxicity without first giving cfear and reasonable warning to such individual..." (Section 25249.10). Proposition 65 assumes that cancer or reproductive toxicity will be associated with low level expo~)Ures to the listed chemical. An exposure for which federal law governs warning in a manner that preempts State authority. b. An exposure that takes place less than 12 months subsequent to the listing of the chemical in question on the list required to be published under Subdivision (a) of Section 25249.8. c. An exposure for which the person responsible can show that the exposure poses no significant risk assuming lifetime exposure at the level in question for substances known to the State to cause cancer, and that the exposure will have no observable effect assuming exposure at one thousand (1,000) times the level in question for substances known to the State to cause reproductive toxicity based on evidence and standards of comparable scientific validity to the evidence and standards which form the scientific basis for the listing of such chemical pursuant to Subdivision (a) of Section 25249.8. However, it is not yet yet cfear in what specific situations additional warnings will be required in order to comply with Proposition 65. If you have any questions or need additional information regarding any of these products, please call us at 1-80Q-ASHLAND.
