action or monitoring is required at the above stated address.
Nothing in this determination shall constitute or be construed as a satisfaction or
release from liability for any conditions or claims arising as a result of past, current, or
future operations at this location. Nothing in this determination is intended or shall be
construed to limit the rights of any parties with ~espect to claims arising out of or relating
to deposit or disposal at any other location of substances remóved from the site. Nothing

1.0 INTRODUCTION
. ,
Triton Environmental Group, Inc. (Triton) has prepared this Soil Characterization
Report (Report) on behalf of Union Pacific Railroad (UPR) and in accordance with a
subcontracting agreement between Triton and Advanced Cleanup Technologies, Inc.
(ACTI). The characterization activities described in this Report for the Sumner Street
Site (Site) were associated with a release of diesel fuel in the area of the railroad
tracks. This Report documents the characterization methodology, findings,
conclusions, and recommendations.
2.0 PURPOSE
The purpose of the characterizatiOn was to determine the horizontal and vertical
extent of diesel fuel-impacted soil, if any, in Site soils. The scope of work included
the collection and analysis of soil samples and an analysis of the laboratory data and
lithology. The information generated was used to determine what mitigation
measures, if any~ would be necessary to protect human health and the environment
in the Site vicinity.

Analytical methodology is based on methods outlined in the United States
Environmental Protection Agency (USEPA) document SW-846, Test Methods for
Evaluating Solid Waste, Third Edition, 1986 (SW-846) and the criteria established in
the California Code of Regulations (CCR), Title 22.
3.0 BACKGROUND
According to information provided by ACTI, approximately 1,000 to 3,000 gallons of
diesel fuel were released to the soil surface in the area of the tracks on November
23, 2001 from a ruptured fuel cell on a locomotive. ACTI removed the standing
liquid fuel from the soil surface. ACTI estimated an area approximately 1,200
square feet in size may have been impacted by the release.

ACTl prepared and submitted to the City of Bakersfield Fire Department (CBFD) a
"Work Plan for Baker Street Soil Sampling, Bakersfield, CAli, dated June 21, 2002
(Workplan). In a letter to UPR dated July 15, 2002, the CBFD approved the
Workplan with some additional requirements.

In January 2003 ACTI contracted Triton to conduct the site characterization based
on ACTI's Workplan and the CBFD's approval letter. Triton contacted Mr. Howard
Wines of the CBFDon January 16, 2003 to discuss the proposed characterization
activities. Base on our conversation with Mr. Wines,· Triton submitted a revised
workplan (Revised Workplan) for the CBFD's review and approval on January 22,
2003. Mr. Wines verbally approved the Revised Workplan on January 23, 2003.
4.0 ENVIRONMENTAL SETTING

4.1 Regional Physiographic Conditions
The Site surface slopes regionally south-southwestward at a rate of
approximately 20 feet per mile and is located approximately 800 feet south of
the East Side Canal. Elevation at the Site is approximately 425 feet above
mean sea level (MSL).
4.2 Geologic Setting
The Site is located within the San Joaquin Valley, which constitutes the
southern portion of the Great Valley geomorphic province. The Great Valley is
a large, northwestward-trending, asymmetric structural trough that has been
filled with as much as six miles of sediment in the San Joaquin Valley. The
sediments range in age from Jurassic to Holocene. Granitic and metamorphic
rocks crop out along most of the eastern and southeastern flanks of the Great
Valley, while marine rocks of pre-Tertiary age crop out along most of the
western flank. The post-Eocene-aged continental rocks and deposits contain
most of the fresh groundwater, and are underlain by or contain saline water at
depth in most places. They range in thickness from zero along the flanks of the
Great Valley to more than 15,000 feet in the extreme southern part, where the
base of the fresh water lies at a maximum depth of about 4,700 feet. In the
Site area, the basement rocks are overlain by chiefly coarse-grained sediments
at depths ranging from less than 300 feet to about 3,900 feet in thickness,
deposited by the Kern River, its antecedents, and other streams in an area
rapidly down warping in geologic time (Page, 1986).
The Site is located approximately two miles south of the Kern River (South) Oil
and Gas Field (Munger, 1993). The average completion depth for oil wells in
the Kern River Field is 900 feet below ground surface (bgs) (Troxel & Morton,
1962).

4.3 Groundwater Conditions
Depth to groundwater at the Site has been mapped at approximately 240 feet
bgs in the fall of 2000. The regional groundwater flow direction is interpreted
as southward, based on dáta provided by others (KCWA, 2001).

- 5.0 CHARACTERIZATION·

In order to evaluate Site soils for the presence of diesel fuel, Triton advanced four soil
borings (B1, B2, B3, and B4) in the area where the standing liquid fuel was identified
by ACT!. All work was conducted under the direction of a State of California-
registered geologist. Soil boring locations are identified on Figure 2. The soil boring
locations were approved on-site by Mr. Wines. A total of 10 soil samples were
selected for analysis. A description of the characterization activities is presented
below.

5.1 Sampling Rationale
Prior to advancing any soil borings, Triton developed a sampling plan as part of
the Revised Workplan to ensure the following criteria were met:
· The area of investigation would be limited to the area of the release;
· representative soil samples would be collected for analyses; and
· appropriate analytical methods would be employed.
Soil borings were advanced until petroleum hydrocarbons were not detected
in two subsequent 5-foot samples using field-screening methods.
Samples selected for analysis were analyzed for the following:
· Benzene, toluene, ethyl benzene, and xylenes (BTEX) by EPA Method
8260; and
· Total Petroleum Hydrocarbons as diesel (TPHd) by EPA Method 8015M;

5.2 Soil Sampling
A total of four soil borings were advanced on January 23, 2003 in the area of
the reported release using hollow stem auger techniques. Using the depth
criteria established in Section 5.1, soil borings B1 and B3 were advanced to a
total depth of 40 feet bgs and soil borings B2 and B4 were advanced to a total
depth of 30 feet bgs. Soil samples were collected at five-foot intervals, starting
at the surface, using a precleaned split spoon sampler loaded with three clean
brass soil sampling sleeves, each two inches in diameter and six inches in
length. Each sample was labeled with a discrete number identifying the
location and depth it was collected from (e.g., soil sample B4-30 was collected
from location B4 at a depth of 30 feet bgs). Samples were then sealed with
Teflon™ sheets and plastic end caps, and placed in an ice chest chilled to 4° C.
All samples were transported under Chain of Custody to BC Laboratories, Inc.
(BC Labs), in Bakersfield, California for analysis.

A portion of each sample was screened for volatile organic compounds (VOCs)
using a MiniRae 2000 photoionization detector (PID). The sample was placed
in a recloseable plastic bag, sealed, disaggregated, and held for approximately
five minutes. The bag headspace was sampled with the PID probe by opening

the bag enough to insert the PID probe.
Sampling equipment was decontaminated between soil borings using a TSP
wash followed by a deionized water rinse. PID measurements and lithologic
descriptions were recorded on soil boring logs and are included as Exhibit 1.
Upon completion, soil· borings were backfilled with bentonite chips in the
lowermost 10-foot interval and then backfilled to the surface with drill cuttings.
Excess drill cuttings were placed in a DOT-approved drum and left on-site
pending receipt of the analytical results. Upon receipt of the analytical results,
the cuttings were spread on-site and the drum was recycled.
6.0 FINDINGS
6.1 Analytical Results
A total of 10 soil samples were analyzed by BC Labs. BTEX were not detected
above their respective Practical Quantitation Limits (PQL). TPHd was detected
at a concentration of 79 milligrams per kilogram (mg/kg) in soil sample B3-5.
TPHd was not detected in any of the other samples at a concentration greater
than the PQL of 10 mg/kg. A summary of the analytical results is presented in
Table 1. Copies of the individual Reports of Analytical Results are included as
Exhibit 2.
6.2 Distribution of Chemicals of Concern
The distribution of chemicals of concern in Site soils is limited. TPHd was the
only chemical of concern detected and it was only detected in one sample (B3-
5). TPHd was .detected at a depth of five feet bgs in sample B3-5. TPHd was
not detected in subsequent soil samples B3-20 and B3-40, collected at 20 and
40 feet bgs, respectively.
6.3 Regulatory Agency Action Levels
While there are no action levels for TPHd published by the BCFD, there are a
. number of action levels published by other agencies/organizations that could
be applied to the Site. A brief discussion of each is presented below:

· Based on Table 2-1 of the Leaking Underground Fuel Tank Field Manual
(LUFf, 1989), the maximum concentration of TPHd that could be left in
place at a site with similar conditions without threatening groundwater
would be 10,000 mg/kg; and
· Based on Table 4 of API Publication 1628 (API, 1989), the maximum
hydrocarbon concentration that could be left in the unsaturated zone at
a site with similar conditions without threatening groundwater would be
6,500 mg/kg.

7.0 CONCLUSIONS
The distribution of the chemicals of concern detected in Site soils is limited based on
the results of the characterization activities conducted by Triton. All detected
concentrations of the chemicals of concern are below all applicable regulatory agency
action levels. The release of the diesel fuel at the Site appears to have caused
minor impact to native soils;
Triton concludes that the concentrations of the chemicals of concern detected in site
soils do not pose a threat to human health or the environment.
8.0 LIMITATIONS
Triton's activities were conducted in accordance with practices and procedures
generally accepted in the consulting engineering field. Triton had free access to the
property and all available records. No party impeded, interfered, or influenced any
part of this preliminary characterization. This report represents Triton's professional
opinion and judgement, which are dependent upon information obtained during
performance of consulting services. Any opinions and recommendations presented
apply to site conditions existing at the time of performance of services.

BACKGROUND
According, to information provided by ACTI, approximately 1,000 to 3,000 gallons of diesel fuel
were released to the soil surface in the area of the tracks on November 23, 2001 from a
.. ruptured fuel cell on a locomotive. ACTI removed the standing liquid fuel from the soil surface.
ACTI estimates an area approximately 1,200 square feet in size may have been impacted by
the release.
ACTI prepar:ed and submitted to the BFD a "Work Plan for Baker Street Soil Sampling,
Bakersfield, CAli, dated June 21,2002 (ACTI Workplan). Triton's Workplan is based on the ACT!
Workplan and our telephone conversation with Mr. Wines.

FIELD INVESTIGATION
Prior to conducting subsurface field activities, ACTI will mark the proposed soil boring locations
and notify Underground Service Alert and UPRR of proposed field activities. After the proposed
boring locations are cleared for drilling, Triton will advance and sample four soil borings. The
borings will be advanced using hollow stem auger drilling techniques. One soil boring will be
advanced in the center of the reported release area to determine the vertical extent of the
impacted soil. The other three soil borings will be used to define the horizontal extent of the
impacted soil. The locations of the borings are identified on the attached figure provided by
ACT!. These proposed locations may be changed during the investigation iffield data suggests
an alternate location may provide better characterization of impacted soil. Based on soil types,
the nature of the release, and the quick removal of the dieSel fuel from the soil, the total depth
proposed for- tnë--soi I bori ngsls- 30-feerogs. - - However; the -soil bori ngswill-beadvancedulÍtil
one of the following occurs:
· Drill bit refusal;
· Petroleum hydrocarbons are not detected in two subsequent 5-foot samples using field-
screening methods; or
· groundwater is encountered.
According to the KCWA Report, it is not likely that groundwater will be encountered during the
investigation.
Borings will be backfilled with bentonite chips in the lowermost 10-foot interval and then
backfilled to the surface with drill cuttings. Excess drill cuttings will be placed in DOT-approved
drums for disposal at a later date pending receipt of the analytical results.
All work will be conducted by, or under the direction of, a State of California-registered geologist.
SOIL SAMPLING
Soil samples will be collected at five-foot intervals starting at five feet bgs. Samples will be
collected using a pre-cleaned split spoon sampler loaded with three clean brass soil sampling
sleeves, ~ach 1.5_ inches in diameter and sixJnchesin length. Each sample will be labeled,
sealeq with Teflon™ sheets and plastic end caps, and placed in an ice chest chilled to 4°
Centigrade. All samples will be transported under Chain of Custody to BC Laboratories, Inc. (BC
Labs), in Bakersfield, California for analysis. A portion of each sample will be screened forVOCs in
the field using a photoionization detector (PID). The sample will be placed in a recloseable plastic
bag, sealed, disaggregated, and held for approximately five minutes. The bag headspace will be
sampled with the PID by opening the bag enough to insert the PID probe.
Sampling equipment will be decontaminated between sampling events using a TSP (or
equivalent) wash followed by a deionized water rinse. PID measurements and lithologic
descriptions will be recorded on a soil boring log.

SOIL SAMPLE ANALYSIS
Soil samples will be selected for analysis based on field screening results and analyzed by BC Labs
for the following chemicals of concern (COCs):
(
. Benzene, toluene, ethyl benzene, and xylenes by EPA Method 8260; and
. Total Petroleum Hydrocarbons as diesel fuel by EPA Method 801SM.
REPORT
Triton will prepare a Soil Sampling Report (Report) summarizing the investigation methodology,
labor~!ory _ .a!lalytical res~lts, conclusions and recommendations. A California Registered
. Geologist will éertif'rthe Report. - -- --- -- --
SCHEDULE
Based on Mr. Wines' verbal approval of the Workplan, and contingent onUPRR clearance, soil
borings will be advanced on January 23, 2003. Triton estimates that the field activities can be
completed in one day, the analytical data will be reported within three weeks, and the draft
Report will be completed and forwarded to UPRR for review and comment approximately two
weeks after receipt of the analytical results. The final Report will be forwarded to the BFD
approximately one week after Triton's receipt of UPRR comments. Please call me if you have

Dear Mr. Wines:
Triton Environmental Group, Inc. (Triton) has prepared this Soil Sampling Workplan (Workplan)
on behalf of Union Pacific Railroad (UPRR) and in accordance with a subcontracting agreement
between Triton and Advanced Cleanup Technologies, Inc. (ACTI). The Workplan was prepared
to describe activities planned for the advancement of four soil borings and the Collection and
analysis of soli samples at 700 Sumner Street, Bakersfield, California. The soli borings will be
advanced In an effort to determine the horizontal and vertiœl extent of diesel fuel In the soil in
the area of the railroad tracks. The proposed work is being conducted in re5ponse to a letter
from the City of Bakersfield Fire Department (BFD) to UPRR, dated December 4, 2001 and
Triton's telephone conversation with Mr. Howard Wines on January 16, 2003.
BACKGROUND
According to Information provided by ACTI, approximately 1,000 to. 3,000 gallons of diesel fuel
were released to the soli surface In the areél of the tracks on November 23, .2001 from a
. ruptured fuel cell on a locomotive. ACTI removed the standing liquid fuel from the soil surface.
Acn estimates an area approximately 1,200 square feet in size may have been impacted by
the release. .
ACTI prepared and submitted to the BFD a "Work Plan for Baker Street Soil Sampling,
6akersfleld, CAn, dated June 21, 2002 (Acn Workplan). Triton's Workplan isbased on the ACTI
Workplan and our telephone conversation with Mr. Wines.
HYDROGEOLOGIC CONDITIONS
Based on information provided by Acn, groundwater In the Site vicinity has histOrically been
measured at a depth of greater than 200 feet below ground surface (bgs). Depth to
groundwater was reported at approximately 240 feet bgs in the fall of 2000 In the Kern County
Water Agency document "Improvement District No.4, 2000 Report on Water Conditions", dated
February 1, 2001 (KCWA Report). The groundwater gradient was to the southeast.

Prior to conducting subsurface field activities, AcrI will mark the proposed soil boring locations
and notify Underground Service Alert and UPRR of proposed field activities, After the proposed
boring locations are cleared for drilling/Triton will advance and sample four soil borings. The
borings will be advanced using hollow stem élu.ger drilling techniques. One soli boring will be
advanced In the center of the reported release area to determIne the vertIcal extent of the
Impacted soil. The other three soil borings will be used to define the horizontal extent of the
Impacted soil. The locations ofthe borings are Identified on the attached figure provided by
ACTI. These proposed locations may be changed during the Investigation if field data suggests
an alternate location may provide better characterization of impacted soil. Based on soil types¡
the nature of the release¡ and the quick removal of the dieSel fuel from the soli, the total depth
proposed for the soil borings is 30 feet bgs. However, the soil borings will be advanced until
one of the following occurs:
· Drill bit refusal;
· Petroleum hydrocarbons are not detected in two subsequent 5-foot samples using field-
screening methods; or
· groundwater is encountered.
According to the KCWA Report¡ it is not likely that groundwater will be encountered during the
Investigation.
Borings will be backfilled with bentonite chips in the lowermost lO-foot Interval and then
backfilled to the surface with drill cuttings. Excess drill cuttings will be placed In DOT-approved
drums for disposal at a later date pending receipt of the analytical results.
All work will be conducted by, or under the direction of, a State of California-registered geologist.
SOIL SAMPUNG
Soil samples will be collected at five-toot Intervals starting at five feet bgs. Samples will be
collected using a pre-cleaned split spoon sarnpler loaded with three clean brass soli sampling
sleeves, each 1.S Inches In diameter and six Inches in length. Each sample will be labeled,
sealed with TeftonTU sheets and plastic end caps, and placed In ëm ice chest chilled to 40
Centigrade. All samples will be transported under Chain of Custody to BC Laboratories, Inc. (BC
Labs), in Bakersfield, california for analysis. A portion of each sample will be screened forVOCs in
the field using a photoionizatlon detector (PID). The sample will be placed in a recloseable plastic
bag, sealed, disaggregated, and held for approximately five minutes. The bag headspaœ will be
sampled with the PID by opening the bag enough to insert the PID probe.
Sampling equipment will be decontaminated between sampling events U5ing a TSP (or
equivalent) wash followed by a deionized water rinse. PID measurements and lithologic
descriptions will be recorded on a soli boring log.

SOIL SAMPLE ANALYSIS
Soil samples will be selected for an~lysis based on field screening results and analyzed by Be Labs
for the following chemicals of concern (COCs):
. Benzene, toluene, ethyl benzene, and xylenes by EPA Method 8260; and
. Total Petroleum Hydrocarbons as diesel fuel by EPA Method 8015M.
REPORT
Triton will prepare a Soil Sampling Report (Report) summarizing the investigation methodology,
laboratory an~lytical results, conclusions and recommendations. A California Registered
Geologist will certify the R.eport.
SCHEDULE
Based on Mr. Wines' verbal apprOval of the Workplan, and contingent on .UPRR clearance, soli
borings will be advanced on January 23, 2003. Triton estirnates that the field activities can be
completed In one day, the analytical data will be reported within three weeks, and the draft
Report will be completed and forwarded to UPRR for review and comment approximately two
weeks after receipt of the analytical results. The final Report will be forwarded to the BFD .
approximately one week after Triton's receipt of UPRR comments. Please call me If you have

Dear Mr. Cooper:
I have reviewed the work plan, dated June 21, 2002, submitted by
Advanced Clean up Technologies, Inc. (ACfI). The work plan indicated
that four soil borings wiJI be advanced for the purpose of collecting a total
of 13 soil samples to assess the environmental impact from a locomotive
diesel fuel tank rupture which occurred on the west side of the Baker
Street crossing on November 23,2001. An estimated 1700 gallons of
diesel fuel was spiJIed onto the main track with most of the spjIJ coJlecting
in the low lying area north of the main track.
Comments to the Work Plan
The work plan does not speCify the target depths nor sampling intervals
for the proposed soil borings. Therefore, this office will require that soil
samples be obtained every five feet in depth for each boring and each
boring advanced until two consecutive samples exhibit no field indications
of soil contamination. If necessary, this office will allow the use of slant
borings to obtain soil samples from beneath the main track as an
acceptable alternative to attempting to drill between the ties. All soil .
samples obtained shall be analyzed for TPH-d by EPA Method 80i5 m,
BTEX and MTBE by EP A Method 8020 or 8260. Samples with
detectable TPH-d should again be analyzed for base neutral and acid
extractable organic compounds by EPA method 8270.
Additionally, any descriptions of the soil samples or conclusions based on
the sample results shall be performed by a California licensed Geologist or
Engineer familiar with the Uniform Soil Classification System. ACfI is
qualified to obtain the samples, but interpretation of the data is subject to
Business and Professions Code section 7835, which reads: "All geologic
plans, specifications reports or documents shall be prepared by a
registered geologist, or registered certified specialty geologist, or by a

subordinate employee under his direction. In addition. they shall be
signed by such registered geologist. or registered certified specialty
geologist or stamped with his seal. either of which shall indicate his
responsibility ~or them." .
The work plan is approved on the basis of the comments in this letter.

On July 15, 2002, this office reviewed and conditionally approved a soil
sampling work plan, dated June 21. 2002, submitted by Advanced
Cleanup Technologies . Inc. (ACTI).
Our records indicated that the required soil sampling has not yet been
perfonned. Accordingly, you are hereby directed to begin the necessary
sampling at the site within 45 calendar days from the date of this letter.
The work shall be in confonnance with our acceptance letter, which is
attached for your reference.

Dear Mr. Cooper:
I have reviewed the work plan, dated June 21, 2002, submitted by
Advanced Clean up Technologies, Inc. (ACTI). The work plan indicated
that four soil borings will be advanced for the purpose of collecting a total
of 13 soil samples to assess the environmental impact from a locomotive
diesel fuel tank rupture which occurred on the west side of the Baker
Street crossing on November 23, 200 1. An estimated 1700 gallons of
diesel fuel was spilled onto the main track with most of the spill collecting
in the low lying area north of the main track.
Comments to the Work Plan
The work plan does not specify the target depths nor sampling intervals
for the proposed soil borings. Therefore, this office will require that soil
samples be obtained every five feet in depth for each boring and each
boring advanced until two consecutive samples exhibit no field indications
of soil contamination. If necessary, this office will aJlow the use of slant
borings to obtain soil samples from beneath the main track as an
acceptable alternative to attempting to drill between the ties. All soil
samples obtained shall be analyzed for TPH-d by EPA Method 8015 m,
BTEX and MTBE by EP A Method 8020 or 8260. Samples with
detectable TPH-d should again be analyzed for base neutral and acid
extractable organic compounds by EPA method 8270.
Additionally, any descriptions of the soil samples or conclusions based on
the sample results shall be performed by a California licensed Geologist or
Engineer familiar with the Uniform Soil Classification System. ACTI is
qualified to obtain the samples, but interpretation of the data is subject to
Business and Professions Code section 7835, which reads: "All geologic
plans, specifications reports or documents shall be prepared by a
registered geologist, or registered certified specialty geologist, or by a

subordinate employee under his direction. In addition, they shall be
signed by such registered geologist, or registered certified specialty
geologist or stamped with his seal, either of which shall indicate his
responsibility for them."
The work plan is approved on the basis of the comments in this letter.

Section 1.0 Introduction
This document represents the Work plan for soil sampling procedures for Union Pacific
Rail Road, facility located at Baker Street crossing, Bakersfield, Ca.. The site is operated as
amain line access into and out of the Bakersfield yard. On November 23,2001 a locomotive #
UP6257 had a rupture fuel cell that leaked Aprox: 1700 gals. Of Diesel fuel onto the track and
.5urroundings.
The purpose of this Work plan is to outline and present the Technical scope of activities
anticipated for soil sampling within the contaminated area.
The Work plan is required of all site personnel and must be used in conjunction with the
jobsite safety plan (JSSP). The Work plan will be kept onsite at all times during the course of the
project. Any changes and/or: modifications to the Work plan must be approved by the UPRR
onsite Coordinator before their implementation.
Advanced Clean up Technologies Inc. (ACTI) on behalf of Union Pacific Rail Road
prepared the Work plan. It is intended for the use of ACTI personnel based on their training and
expertise. Due to potential Hazardous nature of this worksite and activity occurring thereon, it is
not recommended to be used by alternative contractors. ACTI will assume no liability in the
contents of, or the .implementation of this plan should it be used by an alternate contractor.
Søction 2.0 Purposes and Scope of Services
,;~. Th~ purpose of this Work plan is to safely implement in soil sampling at the, verify
locations, depths, and properly distinguish each sample taken. The Work plan outlines the
requirements, procedures, and operation conditions to assist ACTI personnel. involved witt) this
project. Implementation of the Work plan will include the following items;

Developing a jobsite safety plan (JSSP),
Sampling of soil,
Packaging and identifying each sample collected,
Remediation any material with in sample area.
Section 3.0 Inspection
A preliminary site inspection was conducted by ACTI personnel on Jan 23,2002. A site
map is enclosed in Appendix A The following conditions were noted;
Contaminated area is on the main line.
It consists of an area of 1200 sqft.
Partially in the middle of the track and North side of the track.
A phone communication lines run parrell with the track on the South side.
There are overhead power lines.
Before the commencement of work, ACTI will conduct a more detailed inspection of the
site and the Work plan maybe amended to reflect any unforeseen hazards. To ensure the Health
and Safety of personnel, the initial inspection will be' perfOnTled with a UPRR representative.
Additional inspections will occur before start drilling of each sample location. The Work
plan and! or JSSP maybe modified upon the results of each inspection. All changes to the Work
plan and! or JSSP must be approved by the UPRR onsite representative.
Due to the potential hazards associated with this project, the safest and most prudent
approach to collect soil samples is to divide the project into four locations. Each location will
consist of five phases. Phase 1 will consist of the inspection and layout of sample location. Phase
2 will consist of drilling and collecting samples, this also will consist of decontamination of the drill
bit after each sample collected at each designated depth,to avoid any cross contamination. Their
will be aprox; 7 samples at the first location and 6 samples at other remaining 3 locations. Phase
. 4 will consist labeling each sample extracted from each location. Phase 5 will consist remediation
of sample holes. Properly backfill holes to UPRR standards. Each phases all personnel will obtain
and properly use all necessary PPE that is required for above-mentioned tasks, that complies
with UPRR and ACTI regulations.
Section 4.0 Schedules of Events
The following schedule of events is an approximate estimation of the time necessary to
complete the scope of services previously described. The actual time necessary will be primarily
contingent on the availability of tack time provided UPRR, and soil consists antsy.

Total Aprox: time per location is 2 hours
Based on 8-hour working day, this project in expected to be only 1 day. However, ACTI
could be delayed if it is not given appropriated track time, or any other unforeseen delays, at
which that time íf occurred, UPRR onsite representative and ACTI representative will negotiate
any corrective alternatives that will not Jeopardize any Health and Safety issues to any personnel
or equipment involved with the tasks mentioned above.
Section 5.0 Emergency Contingency Plans
There are three major categories of emergencies that my occur during site operations;
1. Illness and injuries,
2. Catastrophic event (fire, explosion, train on main line),
3. Safety equipment problems.
5.1 Medical emergencies (illness and injuries)

Medical emergencies can be described as situations that present a significant threat to
the Health of personnel. These can result from a wide range of potential physical, chemical, and
biological hazards. It is important to familiarize all personnel before the start of work, with the
aspects of the JSSP. The JSSP will contain specific information to the hazards associated with
this site and the appropriate response actions.
5.2 Catastrophic Event
In the event of a catastrophic event, all work activity will cease and all project personnel
will be evacuated from the work location. The evacuation will proceed in a direction opposite of
the critical affected area with all personnel assembling in a predestinated location. For this
project, all personnel will assemble at the Southwest comer of the jobsite.
5.3 Safety Equipment Problems
The following the procedures set forth in the JSSP for PPE inspections can minimize any
problems with safety equipment Any PPE that has been compromised shall be immediately
replaced.

Dear Mr. Cooper:
Our records indicate that the above referenced site is currently subject to Corrective
Action Requirements under Article 80 of the California Fire Code concerning hazardous
. materials releases.
This office requires (in accordance with Section 8001.5. supra) that further assessment be
done to define the vertical and horizontal extent of the contamination plume and complete
all actions necessary to remedy the effects of such unauthorized discharge.
Please submit a workplan for the remedial investigation and feasibility study to this office
within 30 days from receipt of this letter.
Additionally. be advised that oversight cost for this project will be billed to you at a rate
of $80.00 per hour.

Dear Mr. Cooper:
Upon critique of the above referenced incident (OES #01-6780, NRC #586780), this
office has detennined that the extent of the contamination plume, resulting from the
estimated 1000-3000 gallons of diesel released to the ground, has not been adequately
defined.
This Office requires (in accordance with Section 8001.5 of the California Fire Code, 1998
edition) that further assessment be done to define the vertical and horizontal extent of the
contamination plume and complete all actions necessary to remedy the effects of such
unauthorized discharge.
Please submit a workplan for the remedial investigation and feasibility study to this office
within 30 days from receipt f this letter. Be advised that application of chemical
dispersant (e.g. "Bio-Solve") to the ground may be subject to certain Waste Discharge
Requirements.
Please contact Doug Patteson of the Central V alley Regional Water Quality Control
Board at (559) 488-5146 for any further requirements.
Additionally, be advised that oversight cost for this project will be billed to you at a rate
of$80.00 per hour. .
