RUSS ALLRED CALLED. HE RECEIVED THE LETTER MAILED ON 05/14/91. ALLRED SAID THAT THE COMPANY HAS NO MONEY SINCE FILING CHAPTER 11 TO COMPLY WITH THE CLEANUP AND SAMPLING ORDER. HE SAID THAT THE FUEL STAINS WERE LEFT BY A SCRAP DEALER WHO HAD REMOVED GAS TANKS FROM VEHICLES AND THAT THE SCRAP DEALER IS RESPONSIBLE FOR THE SPILLAGE. BEFORE STARTING THE INSPECTION, ALLRED INFORMED ME OF A BIT OF BACKGROUND INFORMATION. THE PROPERTY IS OWNED BY CLEO & EVA TRAMEL. MR. TRAMEL IS DECEASED. THE INTERNAL REVENUE SERVICE HAS A CASE AGAINST TRAMEL WITH THE PROPERTY BEING THE MAJOR ASSET. AMBER STEEL IS GOING THROUGH CHAPTER 11 BANKRUPTCY, THE MAJOR CREDITOR IS THE IRS. THE WESTERN TWO THIRDS OF THE PROPERTY IS MOSTLY CLEAN. THERE ARE A FEW SPILLS HERE AND THERE AND SOME CONTAMINATION BELOW THE ABOVE GROUND DIESEL TANK. ALLRED SAYS THAT THE DIESEL TANK HAS NOT BEEN USED BY AMBER STEEL AND THAT THE FIRE DEPT. HAS INSPECTED IT. THE EASTERN THIRD OF THE PROPERTY HAS THE FOLLOWING CONCERNS: 1. A LARGE 10' X 20' AREA OF STAINED SOIL. 2. TANKS HAD BEEN TURNED OVER SO THAT THE CONTENTS HAD RUN ONTO THE GROUND. (3 TANKS WERE FRESH, STILL WET.) 3. ANOTHER SMALLER TANK WAS SITTING ON TOP OF A 55 GALLON DRUM AND DRAINING SOME TYPE OF HYDROCARBON INTO IT. 4. 4 TO 5 DRUMS OF WHAT APPEARS TO BE WASTE OIL. 5. NEXT TO THE SOUTH SIDE OF A SHOP BUILDING UNDER A SEA/TRAIN IS AN AREA OF HEAVILY STAINED SOIL. 6. A POSSIBLE DISPENSER AND UNDERGROUND TANK SITE TO THE SOUTH OF THE SHOP BUILDING. THE TANK IS POSSIBLY UNDER THE CEMENT PAD. POSSIBLE FILL PIPE OPENING IN THE CONCRETE. 7. DRUMS OF UNLABELED GASOLINE. 8. AT THE NORTHEAST GATE A DRUM WITH DISPENSER HAS SPILLAGE AROUND IT. An investigation was conducted on April 19, 1991. The following violations were noted: \1 1. Health and Safety Code Section 25123.3: Storage of a hazardous waste for greater than 90 days at an unpermitted facility and failure to label a hazardous waste. 2. Section 25250.5: Disposal of waste oils to the ground. 3. Section 25190 (D): Negligent disposal of haZardous waste. Within thirty (30) days of receipt of this notice, all liquid waste oil is to be removed by a licensed waste oil hauler for recycling. All visibly contaminated soil is to be excavated and placed into secure containers. A representative sample(s) must be collected and analyzed by a certified hazardous waste laboratory for the following constituents: Title 22 inorganic persistent and bioaccumlative toxic substances metals test (TTLC), EPA Method 8240 test for organics and polychlorinated biphenyls (PCB's). There is also a 55-gallon drum of material that requires identification. Notify this office 48 hours prior to sampling. Review of the laboratory analyses cannot be completed at this time due to omission of one of the tests required. It is my understanding that the original samples are no longer available. Additional sampling will be required for the other analyses, The new samples are to be taken from as near to the original samples as possible at the same depths. Sample number 1 at one foot. Sample number 2A at two foot, sample number 2B at 4 foot. Sample number 3A at two foot, sample number 3B at four foot. The following tests are to be performed at all three sampling sites at all depths noted above; 8010/8020 volatile halogenated organics and volatile aromatics. At sampling site number 1 the STLC test for lead is to be performed. Please notify this office at least 48 hours prior to sampling. Sampling is to occur no later than August 26, 1991.
