NOTICE OF VIOLATION AND SCHEDULE
FOR COMPLIANCE
Dear Mr. Brown:
It has come to our attention that you are the executer of property located at 1421 E. Truxtun
Ave" which contains one (1) underground storage tank. The tank has not been properly permitted,
and has been illegally abandoned for several years, These acts are in violation of the following
sections of the Uniform Fire Code as adopted by the Bakersfield Municipal Code, Chapter 15,64,
Section 7902.1.7.2.3, Uniform Fire Code (1994 Edition)
"Underground tanks which have been out of service for a period of
one (1) year shall be removed from the ground in accordance with
Section 7902.1.7.4 and the site shall be restored in an approved
manner. "
The specific violations and remedial action necessary to return the property to compliance has
been provided to you in the order of Corrective Action-Schedule for Compliance by the City of
Bakersfield Fire Department, Office of Environmental Services, dated July 1, 1999, July 9, 1999,
August 4, 1999 and September 14, 1999.
The purpose of this letter is to impress upon you the need to take immediate action, With that
goal in mind, I urge you to return the property to compliance through cooperation with the Office
of Environmental Services, I must inform you that failure to properly close (remove) the tank by
January 31, 2000, may necessitate legal action, including, but not limited to misdemeanor citations
and/or injunctive relief

Dear Mr. Brown:
This is a follow up to the phone conversation, with Jonea, your
office manager. Her request for a thirty (30) day extension to secure a
contractor is hereby granted.
However, this office cannot delay enforcement past September 5,
1999. If by this date, you have not properly closed your tank, we will then
be forced to seek action through the City Attorney's office.

Dear Mr. Brown:
A follow up visit was made to the above mentioned address to identify
an illegally abandoned tank located at Amy Auto Painting. I contacted your
office and Jonea came over to observe the vent line and fill pipe on the tank in
question.
Because of the proximity to the foundation, abandonment in place will
be allowed. For your convenience, I am enclosing a list of contractors who
are licensed to remove/fill underground storage tanks. You may choose any
contractor you wish, provided that they are qualified. The contractor must
take out a permit through this office before any work is to be done.
Please make the necessary arrangements to properly close this tank by
August 5, 1999. Should you have any additional questions, please feel free to
contact me at 326-3979.
