During the inspection, noncompliance with requirements for management of hazardous waste in accordance with regulations and statutes was noted. 1. The facility is not in accordance with California Health and Safety Code, Chapter 6.5, Article 13, Section 25185.6. The facility refused to supply information relating to hazardous substances, hazardous wastes, or hazardous materials. 2. The facility is not in accordance with California Health and Safety Code, Article 8, Chapter 6.5, Division 20, Section 25189 (d). Waste oil has been disposed of to the ground in the area surrounding the 55- gallon drums. 3. The facility is not in accordance with California Health and Safety Code, Article 8, Chapter 6.5, Division 20, Section 25189.5(a)(d). It was determined during the inspection that waste oil was stored on site in exceedence of the 90-day storage requirements. 4. The facility is not in accordance with California Health and Safety Code, Division 20, Chapter 6.5, Section 25250.5. Waste oil has been spilled on the soil surrounding the waste storage area of the facility. 5. The facility is not in compliance 'With California Code of Regulations, Chapter 30, Title 22, Section 66262.11. · e Mull Property Subject: Abandonment of Hazardous Wastes June 8, 1994 Page 2 It was determined during the inspection that none of the apparent waste-like substances at the site had been analyzed or that the generator had knowledge of their hazardous properties. 6. The facility is not in compliance with California Code of Regulations, Chapter 30, Title 22, Section 66262.34(f)(1)(2)(3)(A)(B)(C). It was determined during the inspection that the waste oil container was not appropriately labeled in accordance with the above requirements. 7. The facility is not in accordance with California Code of Regulations, Chapter 30, Title 22, Section 66264.173. It was obseIVed during the inspection that containers storing hazardous waste oil were open. 8. The facility is not in accordance with California Code of Regulations, Chapter 30, Title 22, Section 66265.174. The facility could not demonstrate that the hazardous waste storage area had been inspected at least weekly. Upon receipt of this letter, the facility owners or operator must correct all deficiencies noted in this notice within thirty (30) days, and submit to the Department written documentation that all violations as noted above have been corrected. The issuance of this notice does not preclude the Department from taking administrative, civil or criminal action as a result of the violations noted herein. According to the Kern County Assessors office records you are the owner of this property and as such are ultimately responsible for characterization and proper disposal of any wastes located on the property. The material in the containers appears to be waste oil. It is recommended that you contact a waste oil recycler for proper disposal of the waste. Please advise this office within thirty (30) days of receipt of this letter of your intentions to properly dispose of the waste material. The generator shall determine if the waste is listed as a hazardous waste in Article 4 or Chapter 11 or in Appendix X of Chapter 11 of this division. If the waste is listed in Appendix X and is not listed in Article 4 of this Chapter, the generator may determine that the waste from his particular facility or operation is not a hazardous waste by either (1) testing the waste according to the methods set forth in Article 3 of chapter 11 of this division, or according to an equivalent method approved by the Department pursuant to Section 66260.21; or (2) applying knowledge of the hazardous characteristics of the waste in light of the materials or process used and the characteristics set forth in Article 3 of Chapter 11 of this division." It was determined during the inspection that none of the apparent waste-like substances contained in the clarifier had been analyzed or that anyone had knowledge of their hazardous properties. 3. The facility is in violation of California Code of Regulations, Chapter 30, Title 22, Section 66262.34(f)(I)(2)(3)(A)(B)(C). "Generators who accumulate hazardous waste on site without a permit or grant of interim status shall comply with the following requirements: the date upon which each period of accumulation begins shall be clearly marked and visible for inspection on each container and portable tank; the date the 90 day period begins, for purposes of Subsection (a) and (b) of this Section, shall be clearly marked and visible for inspection 'on each container and tank. All containers and portable tanks shall be labeled with the following information: The composition and physical state of the wastes, statement or statements which call attention to the particular hazardous properties of the wastes (e.g. flammable, reactive, etc.) and the name of the person producing the wastes." It was determined during the inspection that none of the containers storing waste were labeled in accordance with the above requirements. 4. The facility is in violation of California Code of Regulations, Chapter 30, Title 22, Section 66262.12(a). I~ generator shall not treat, store, dispose of, or offer for transportation, hazardous waste without having received an Identification Number." ORDER TO CORRECT' Upon receipt of this letter, the facility owners or operator must correct all deficiencies noted in this Notice of Violation within thirty (30) days, and submit to the Department written documentation that all violations have been corrected. As a result of that inspection, violations of hazardous waste regulations and statutes were identified. Specific violations are listed below. VIOLATIONS It has been determined that the facility is in violation of the following regulations and statutes cited below: 1. The facility is in violation of California Health and Safety Code, Article 8, Chapter 6.5, Division 20, Section 25189.5(a)(d). "The disposal of any hazardous waste, or the causing thereof is prohibited when the disposal is at a facility which does not have a permit from the department issued pursuallt to this chapter." 1~/lY person who knowingly treats or stores any hazardous wastes at a facility which does /lot have a permit from the department issued pursuant to this chapter." It was determined during the inspection that waste oil was stored on site in exceedence of the 90 days storage requirements for small quantity generators. 2. The facility is in violation of California Code of Regulations, Chapter 30, Title 22, Section 66262.11. e e Dale & Jan Scales Subject: Hazardous Waste Violations January 19, 1993 Page 2 ''A person who generates a waste, as defined in Section 66261.2, shall determine if that waste is a hazardous waste using the following method. The generator shall determine if the waste is listed as a hazardous waste in Article 4 or Chapter 11 or in Appendix X of Chapter 11 of this division. If the waste is listed in Appendix X and is not listed in Article 4 of this Chapter, the generator may determine that the waste from his particular facility or operation is not a hazardous waste by either (1) testing the waste according to the methods set forth in Article 3 of Chapter 11 of this division, or according to an equivalent method approved by the Department pursuant to Section 66260.21; or (2) applying knowledge of the hazardous characteristics of the waste in light of the materials or process used and the characteristics set forth in Article 3 of Chapter 11 of this division." It was determined during the inspection that none of the apparent waste-like substances contained in the clarifier had been analyzed or that anyone had knowledge of their hazardous properties. 3. The facility is in violation of California Code of Regulations, Chapter 30, Title 22, Section 66262.34(f)(1)(2)(3)(A)(B)(C).
