HomeMy WebLinkAboutRES NO 180-04Resolution No. I 8 0 - 0 4 RESOLUTION APPROVING SECURING STATE FUNDING ASSISTANCE FOR OBTAINING A POTENTIAL OFF-HIGHWAY VEHICLE PARK WHEREAS, the People of the State of California have enacted the Off-Highway Motor Vehicle Recreation Act of 2003, which provides Off-Highway Vehicle Trust Funds to the State of California and its political subdivisions for planning, acquiring, developing, operating, conserving, and maintaining off-highway vehicle recreation; and WHEREAS, procedures established by the State of California require the City of Bakersfield to certify by resolution the approval of securing of Off-Highway Vehicle Trust Funds; and WHEREAS, the City of Bakersfield wishes to secure Off-Highway Vehicle Trust funds via grants, agreements and contracts with the California Department of Parks and Recreation, and/or through legislation by the State of California; and WHEREAS, the City of Bakersfield requires Off-Highway Vehicle Trust Funds to pursue the feasibility analysis, planning, and hopefully establishment of a Metropolitan Bakersfield Off-Highway Vehicle Park; and WHEREAS, it is a policy of the Metropolitan Bakersfield General Plan to pursue a project for the establishment of the type of recreational facility; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Bakersfield hereby: Authorized applying for and securing Off-Highway Vehicle Trust Funds as needed to conduct the feasibility analysis, planning, acquisition and establishment of a Metropolitan Bakersfield Off-Highway Vehicle Park, via grants, and contracts with the California Department of Parks and Recreation, and/or through legislation by the State of California. The City Manager of the City of Bakersfield is hereby authorized and empowered to execute in the name of the City of Bakersfield all necessary applications, contracts, agreements, and amendments for the purpose of securing Off-Highway Vehicle Trust Funds to implant and carry out the purpose of the project. It is understood than any lands acquired through this process will pass to the State of California, Department of Parks and Recreation, for the purpose of providing off-highway vehicle recreation opportunities. Certifies that this agency understands its legal obligations to the State of California and the California Department of Parks and Recreation. Certifies that this agency will implement the project with diligence once funds are available and project agreements and/or contracts have been consummated between the State and this agency. ORIGINA~ Certifies that the public and adjacent property owners have been notified of this project (if applicable). Appoints the Planning Director as agent of the City of Bakersfield to conduct all negotiations and execute and submit all required documents, including but not limited to, applications, agreements, amendments, contracts, payment request, etc, which may be necessary for the completion of the project. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council supports California State Park's request for additional Off-Highway Vehicle Trust Funds for the acquisition and development of the off-highway vehicle facility.
