Mr. Doug Eberts, 7713 Calle Nobleza, the intersection at Ming Avenue and Calle Hija Council for their help. spoke regarding and thanked the Mr. Neal McKim, 1517 Calle Poderosa, spoke regarding Stockdale Estates traffic and expressed his thanks to Councilmember Peterson and the City Traffic Department. Mr. Warren Davis, 1512 Calle Poderosa, spoke regarding Stockdale Estates traffic and expressed his thanks to the Council and staff for improving the traffic condition in his neighborhood. Mr. Marvin Dean, P. O. Box 1062, spoke regarding reprogramming of Community Development Block Grant Funds. No. REPORTS City Manager Dale Hawley read City Manager Report 5-90 regarding Rideshare Incentive Program as follows: The San Joaquin Valley is currently a non-mandated area as far as mobile air pollution is concerned. However, the Air Pollution Control District is obligated to have a Non-Attainment Plan submitted to the State of California by the spring of 1991. This plan would include all phases of air pollution mobile and stationary. The State of California would then make the determination or regulation whether or not to mandate alternate means of transportation in the City of Bakersfield and the County of Kern. Currently, Southern California i__s mandated by the South Coast Air Quality Management District's Regulation XV. This regulation requires that all employees with work sites of 1 00 or more employees develop a ride-share program to achieve a 1.5 average vehicle ridership (AVR). It is estimated that for every vehicle on the road per year, an amount of carbon equal to the vehicle's weight is released into the air. For instance, one standard car weighing approximately 2,000 lbs. would release one ton of carbon per year. !54 Bakersfield, California, September 5, 1990 Page 5 Therefore, in an effort to help reduce these mobile air pollution emissions, and perhaps not forced to be mandated by the State of California for mobile emission control, we are requesting Council approval of the attached Resolution and Rideshare Program & Procedures. With the support of the City Council, this program can evolve into a viable way of both improving the air quality in this area, as well as doing our part in reducing traffic congestion. Also, when private employers observe what our local governments - both City and County- are doing to help improve air quality, they may in turn adopt similar alternate transportation programs of their own. Monies were approved for this program during the 1990-91 budget hearings, and implementation of said program would be the responsibility of the Personnel Division. Upon a motion by Councilmember Brunni, City Manager Report No. 5-90 was accepted. Adoption of Resolutiou No. 121-90 of the Council of the City of Bakersfield adopting a Voluntary Rideshare Incentive Progra~ for the employees of the City of Bakersfield. Upon a motion by Councilmember Brunni, Resolution No. 121-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, Peterson, Noes: None Abstain: None Absent: None DeMond, Smith, Brunni, McDermott, Salvaggio Councilmember Peterson read Budget and Finance Committee Report No. 12-90 regarding Revisions to Massage Ordinance as follows: Revisions proposed by staff were reviewed by the Committee on August 22, 1990, and include comprehensive changes to Chapter 5.32. The most significant revisions are exemptions from the permit requirements for those identified in Section 5.32.020 B. of the proposed ordinance. All the revisions had been reviewed by and were discussed with a Police Department representative, and the Police Department supports the recommended changes. The Committee recommends adoption of this ordinance and that it be given first reading this evening. 155 Bakersfield, California, September 5, 1990 - Page 6 Upon a motion by Councilmember Peterson, Budget and Finance Committee Report No. 12-90 was accepted. First Readimg of an Ordinance of the Cx)nncil of the City of Bakersfield ~ending Chapter 5.32 of the Bakersfield Mnnicipal Code relating to massage establishments. Councilmember Satvaggio requested that when this Ordinance comes back to the Council for adoption, staff prepare a short memo explaining what the revisions mean and why they are necessary. Councilmember Edwards, Chairperson of Committee, read Report No. 7-90 regarding Outside follows: the Personnel Employment as The Personnel Committee met on August 23, 1990, to review the proposed amendment to Section 2.72.260 of the Bakersfield Municipal Code. The Code section states that Public Safety Officers may not hold any other profession, trade, calling or business. This is in direct conflict with Charter Section (202)20 which states they may engage in outside employment. The Personnel Committee concurs with the changes recommended to bring the Municipal Code into conformance with the Charter and requests Council approval of this report and the attached Ordinarlce. Upon a motion by Councilmember Edwards, Personnel Committee Report No. 7-90 was accepted. First Reading of an Ordinance of the C~)nncil of the City of Bakersfield amending Section 2.72.260 of the Bakersfield Municipal Code relating to ontside employment. Councilmember DeMond read Personnel Committee Report No. 8-90 regarding Revised Job Specifications as follows: The Personnel Committee approved the following: Revised Job Specifications 1. Community Services Manager #910. 2. Water and Sanitation Manager #916. 3. Fire Inspector #147. The Personnel Committee requests acceptance of the report and adoption of the Salary Resolution. Upon a motion by Councilmember DeMond, Personnel Committee Report No. 8-90 was accepted. 156 Bakersfield, California, September 5, 1990 - Page 7 Adoption of Resolution No. 122-90 of the Council of the City of Bakersfield a~ending Resolution No. 10-89 setting salaries and related benefits for officers and employees of the General Supervisory, Police Supervisory and Management Units of the City of Bakersfield. (Community Services Manager and Water and Sanitation Manager.) Upon a motion by Councilmember DeMond, Resolution No. 122-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None Upon a motion by Councilmember Brunni, Item 7 e., Budget and Finance Committee Report No. 13-90, regarding Implementation of Property Tax Administration Charge and Jail Booking Charge by Kern County, was considered an item which arose after the Agenda was prepared and upon which action is necessary, by the following roll call vote: Ayes: Councilmembers Edwards, Peterson, Noes: None Abstain: None Absent: None DeMond, Smith, Brunni, McDermott, Salvaggio Councilmember McDermott, Chairperson of the Budget and Finance Committee, read Report No. 13-90 regarding Implementation of Property Tax Administration Charge and Jail Booking Charge by Kern County as follows: The City Council requested that the Budget and Finance Committee be kept updated on impacts to the City Budget resulting from the recent State Budget crisis. Recent events have occurred which were brought to the Committee by staff involving actions taken by both the State and the County which will dramatically impact the City's Budget and level of service. On Tuesday, September 4, 1990, the Kern County Board of Supervisors voted to implement a jail booking charge to non-County agencies, except for the California Highway Patrol, for jail bookings occurring since July 1, 1990. In addition, they are preparing to implement a property tax administration charge on cities which was passed by the State legislature as part of Senate Bill 2775 (Maddy). The Board deferred charging school districts and special districts the proDerty tax administration fee until Fiscal Year 1991-92. The impact on the City of Bakersfield budget is estimated by the County Administrative Officer to be $357,000 annually for the property tax administration charge, and $1 , 200,000 annually for the jail booking charge. 157 Bakersfield, California, September 5, 1990 - Page 8 The Committee has reviewed these new additional fees with staff and recommends the following: First, that the City not pay retroactively for booking charges prior to the date the City was notified by the County of such charges on September 5, 1990; secondly; that the City should pursue legislation through our State's legislators which would require recovery of the costs for booking criminals from the criminals themselves; and third; that staff review current booking practices in order to address ways to reduce this additional cost which has been shifted from the County to the City; and finally; that the matter of these charges and the manner in which they are calculated be referred to the combined City/County Intergovernmental Relations Committee for review. We request the Council accept this report and implement its recommendations. Upon a motion by Councilmember McDermott, Budget and Finance Committee Report No. 13-90 was accepted. Councilmember Peterson stated he would like the City/County Intergovernmental Relations Committee to know that he feels this is a double tax against the citizens of the City of Bakersfield. Police Chief Patterson responded to questions by Councilmember Smith by stating the California Highway Patrol is exempt because they are part of the State government and they did not want to pay so they exempted themselves. He also stated the County will not be charging itself. Councilmember Brunni stated that this matter was never discussed at the City/County Intergovernmental Relations Committee, and that the Committee had numerous meetings over the last several months. Councilmember Salvaggio spoke of his displeasure with the County. Upon a motion by Councilmember McDermott, the recommendations of Budget and Finance Committee Report No. 13-90 were implemented by the following roll call vote: Ayes: Councilmembers Edwards, Peterson, Noes: None Abstain: None Absent: None DeMond, Smith, Brunni, McDermott, Salvaggio Bakersfield, California, September 5, 1990 - Page 9 ACTION ON BIDS Modify and install Wible Road Median, Panama Lane to Auto Mall Drive. Upon were rejected readvertised. a motion by Councilmember McDermott, all bids and authorization given for the project to be Approval of Agreement No. 90-219 with Halopoff & Sons, Inc., for construction of Roadway on Panorama Drive from West Bluff Court to Bryn Mawr Drive. Upon a motion by Councilmember DeMond, the low bid from Halopoff & Sons, Inc., in the amount of $98,078.60 was accepted, all other bids rejected, and the Mayor authorized to execute the Contract. Traffic Signal Control Equipment for Public Works (167 units). Upon a motion by Councilmember Salvaggio, the low bid from Signal Control Company in the amount of $43,294.75 was accepted and all other bids rejected. Approval of Contract No. 90-220 with Safety Electric Corp. for traffic signal system on Coffee Road at Rosedale Highway. Upon a motion by Councilmember Brunni, the low bid from Safety Electric Corp. in the amount of $123,647.00 was accepted, all other bids rejected, and the Mayor authorized to execute the contract. Nine Police Motorcycles (replacement). Upon a motion by Councilmember Peterson, the bid from Ryan Kawasaki in the amount of $60,568.88 was accepted. Two Police Department Pickup Trucks (replacement). Upon a motion by Councilmember Salvaggio, the low bid from Three-Way Chevrolet in the amount of $27,819.22 was accepted and all other bids rejected. Adoption of Resolution No. 123-90 of the Council of the City of Bakersfield determining that certain Survivair breathing apparatus and tanks can be reasonably obtained from only one vendor, Halprin Supply, and authorizing the Finance Director to dispense with bidding therefor, not to exceed $50,000.00. This Ordinance was given first reading at the meeting of August 22, 1990. Communication has been received from DeWalt Corporation, 2340 Niles Street, dated September 4, 1990, requesting Council defer adoption of the Ordinance to the meeting of September 19, 1990. Upon a motion by Councilmember Brunni, this matter was deferred to the regular Council meeting of September 19, 1990. Adoption of Ordinance No. 3313 of the Council of the City of Bakersfield amending Title 17 of the Bakersfield Municipal Code by changing the Land Use Zoning of those certain properties commonly known as 4900 through 5224 (even only) and 4901Gaylene Avenue from an R-2 (Limited Multiple Family Dwelling) Zone, R-2-D (Limited Multiple Family Dwelling-Design Overlay) Zone and an MH (Mobile Home) Zone to an R-1 (One Family Dwelling) Zone and from an R-2-D (Limited Multiple Family Dwelling) Zone to an MH (Mobile Rome) Zone. This Ordinance was given first reading at the meeting of August 22, 1990. Upon a motion by Councilmember Salvaggio, Ordinance No. 3313 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None An Ordinance of the Council of the City of Bakersfield amending Map No. 123-18 of Title Seventeen of the Bakersfield Municipal Code by changing the Land Use Zoning of that certain property in the City of Bakersfield located approximately 500 feet south of White Lane on the east side of Mountain Vista Drive to the Buena Vista Canal, north of the westerly extension of Campus Park Drive from an A (Agriculture) Zone to an R-1 (One Family Dwelling) Zone. This Ordinance was given first reading at the meeting of July 11, 1990. 160 Bakersfield, California, September 5, 1990 - Page 11 Upon a motion by Councilmember Brunni, this matter was deferred to the regular Council meeting of September 19, 1990. First Reading of an Ordinance of the Council of the City of Bakersfield amending Section 2.68.010 of the Bakersfield Municipal Code relating to monthly salary of Co%lncilm-mhers. This Ordinance is the subject of the referendum election and needs to be adopted prior to the election. It takes effect only if the voters approve Measure "K" on November 6th. Adoption of Zoning Resolution No. 387 of the Council of the City of Bakersfield granting the appeal by Allen West, from the decision of the Board of Zoning Adjustment on an application for a modification to permit the reduction of the rear yard setback from five feet to three feet and to allow the reduction of the minimum separation between a dwelling and an accessory structure in an R-] (One Family Dwelling) Zone on that certain property commonly known as 2017 Birchwood court. This Resolution sets forth the decision of the Council following the public hearing on the matter held on July 25, 1990. Upon a motion by Councilmember McDermott, Zoning Resolution No. 387 was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None Amendment No. 1 to Block Grant (CDBG) Year 1990-91. Community Application Development for Fiscal Councilmember Salvaggio requested some rationale as to why changes need to be made. Upon a motion by Councilmember Peterson, this matter was referred to the Budget and Finance Committee. NEW BUSINESS First Reading of an Ordinance of the Council of the City of Bakersfield adding Chapter 15.80 to the Bakersfield Municipal Code, relating to the Dedication of Land, Payment of Fees, or both for the purposes of parks and recreation land. This Ordinance implements the "Quimby Act" pursuant to Government Code Section 66477 and the Park Element policies of the 2010 General Plan. It establishes the mechanism for park land acquisition in response to residential development. First Reading of an Ordinance of the Council of the City of Bakersfield amending Title 17 of the Bakersfield Municipal Code by changing the Land Use Zoning of that certain property located at the northeast corner of Bernard Street and Fashion Place from an R-1 (One Family Dwelling) to a P.C.D. (Planned Commercial Development) Zone. On August 16, 1990, the Planning Commission conducted a public hearing and recommended approval of the proposed zoning. On April 5, 1990, the Planning Commission considered and recommended adoption of a Negative Declaration for the project. Adoption of Resolution of Application No. ~24-90 of the Council of the City of Bakersfield proposing proceedings for annexation of territory to the City of Bakersfield identified as Annexation No. 337, Quantico No. 1 Annexation (Ward 1 ). This Resolution of Application proposes proceedings for annexation of territory to the City of Bakersfield identified as Annexation No. 337 (Quantico No. 1 Annexation). Upon a motion by Councilmember Edwards, Resolution No. 124-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None Approval of Consultant' s Agreement No. 90-221 with Golden Valley Testing, Inc., for soils and concrete testing of the Ming Avenue Overcrossing Widening at Highway 99. Upon a motion by Councilmember McDermott, Agreement No. 90-221 with Golden Valley Testing, Inc., was approved and the Mayor authorized to execute the Agreement. Bakersfield, California, September 5, 1990 - Page 13 Appropriation of funds from the Council Contingency Fund for the previously approved Attorney Retainer Services Agreement No. 90-199 with Donald Maynor. Upon a motion by Councilmember McDermott, $60,000.00 was appropriated from the Council Contingency Fund to the Public Works Capital Improvement Budqet within the Capital Outlay Fund by the following roll call ~ote: Ayes: Noes: Abstain: Absent: Councilmembers Edwards, DeMond, Smith, McDermott, Salvaggio Councilmember Brunni None None Peterson, Appointment of Acting City Attorney. Upon a motion by Councilmember Peterson, Robert M. Sherfy was appointed as Acting City Attorney at Step 2 of the salary range for City Attorney, per the Salary Schedule, effective September 10, 1990. Each of the Councilmembers thanked Art Saalfield for all his hard work and wished him luck in his future endeavors. COUNCIL STATEMENTS Councilmember McDermott asked staff to draft an ordinance for the next Council meeting to prohibit pay toilets within the City. Councilmember Brunni submitted the name "Bill Park Greens" for the park south of Stockdale Highway and west of Jenkins Road. Councilmember Brunni spoke regarding the dead geese on Truxtun Extension. She reflected on the illegal abandonment of the geese; encouraged citizens to adopt geese and staff to look at the issue from a viewpoint of traffic safety. Councilmember Brunni asked staff to draft a Resolution of Support in making a link between the City of Bakersfield and Russia on a Sister City Project. Councilmember Brunni spoke regarding correspondence received from Assemblyman Trice Harvey regarding monies available for highway landscape and urban forestry and resource land acquisitions. She stated she would like to see if staff can look into getting some money for the City, perhaps for the Kern River Parkway or other areas in the City. Councilmember Peterson spoke regarding the letter from Assemblyman Harvey regarding the legislature allocating $10,000,000 annually over ten years to provide competitive environmental enhancement grants for local, state and federal nonprofit agencies, and asked staff to put forth its best effort to get the City's share of this money for the enhancements of the projects in the City. Councilmember Peterson entered into the record two letters he received: one from Doug Eberts, Driltek, and one from Mel and Jan Fisher; regarding the intersection at Stockdale and Calle Hija, and urged the Police Department to help with traffic speeds. He requested staff continue to monitor the intersection and report back on the effect of the island median. Councilmember DeMond stated she referred the letter from Assemblyman Harvey to Economic Development Director Jake Wager and asked him to look into it. follows: Councilmember Salvaggio stated for the record as Last week I was distressed to learn of the resignation of one of our most able and loyal employees, Ms. Nellie Wright. Tonight, I would like to dedicate my Council Statement to Nellie. Bakersfield, California, September 5, 1990 - Page 15 Nellie served the citizens of Bakersfield for almost twenty years in a variety of departments, including Fire, Police, Planning, Finance, City Manager's Office, and for the last several years as Personnel Clerk. Nellie was well-liked and highly regarded by all her peers. As a good Christian woman, Nellie is a happy and well-adjusted person who is devoted to her family. Nellie was an exemplary employee who always liked to excel in her work for the City of Bakersfield. She would often come to work at 6:00 or 6:30 in the morning, work during her lunch hour and take her work home to do. She may have been the only City employee who knew the City's Civil Service Rules and Regulations backwards and forwards. From the word "go," Nellie Wright was a real professional, and I know the City is better off because of all her hard work and dedication over the years. So, tonight I want to say thank you, Nellie. I appreciate your outstanding service to the City of Bakersfield and its citizens. Your service will be sorely missed.
