A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
APPROVING THE FILING OF AN APPLICATION FOR GRANT FUNDS
FROH THE CONNUNITY PARKLAND ACT OF ]986 WHICH AUTHORIZES
THE TRANSFER OF $50,000 FROH THE KERN RIVER PARKWAY TO
CONPLETE THE DEVELOPNENT OF JENKINS PARK.
WHEREAS, the people of the State of California have
enacted the Community Parkland Act of '1986 which provides funds to
the State of California and its political subdivisions for acquiring
lands and developing facilities for public recreational purposes;
and
WHEREAS, the State Department of Parks and Recreation has
been delegated the responsibility for the administration of
programs under said Act setting up necessary procedures governing
application by local agencies under the program; and
WHEREAS, sa~d procedures established by the State
Department of Parks and Recreation require the applicapt to certify
by resolution the approval of an application to the State; and
WHEREAS, said application contains assurances that the
applicant must comply with; and
WHEREAS, s~id application contain a certification that
the applicant will comply with all federal, state, and local
environmental, public health, relocation, affirmative action, and
clearing-house requirements and all other appropriate codes, laws
and regulations prior to the expenditure of the grant funds; and
WHEREAS, the applicant agency will enter into an
agreement with the State of California for development of the
project.
hereby:
NOW, THEREF:ORE, BE IT RESOLVED that the City Council
1. Approves the filing of an application for the
State Grant assistance for the above project.
2. Certifies that said agency has or will have
sufficient funds to ()perate and maintain the project funded
these programs; and

3. Certifies that said agency understands the assurances
and certifications in the application; and
4. Certifies that said agency will complete the project
within three (3) years from date of approval by the State; and
5. Appoints the City Manager as agent of the City of
Bakersfield to conduct all negotiations, execute and submit all
documents including but not limited to applications, agreements,
amendments, payment requests, and so on which may be neoessary for
the completion of the aforementioned projects; and
6. Appoin'cs the City Attorney as legal counsel of the
City of Bakersfield 'For purposes hereof.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on August 9, 1989 by the following

Development of a 4.5 acre neighborhood park in Southwest Bakersfield.
$95,000 has been approved for this project from the 1984 Park Bond Act. Due to
rising cost, additional funds will be needed and this $50,000 grant will supplement
the 1984 Grant so the project can be completed.
