A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DETERMINING THAT THE SUBDIVIDER
OF TRACT MAP 4840 UNIT "A" HAS FAILED TO
COMPLETE THE IMPROVEMENTS IN ACCORDANCE WITH
AGREEMENT NO. 87-117 AND GIVING NOTICE TO
PROCEED WITH THE WORK.
WHEREAS, Improvement Agreement No. 87-117 for Tract Map
4840 Unit "A" between the City of Bakersfield and Bakersfield
Country Club Development, Ltd., was executed on May 20, 1987; and
WHEREAS, the aforementioned Agreement required all
improvements to be completed before May 20, 1988; and
WHEREAS, the required improvements have not been
completed as of this date; and
WHEREAS, the cost of completing the improvements is
estimated to be $90,953.00.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The $ubdivide~ of Tract Map 4840 Unit "A" has failed
to properly and fully complete all of the work of improvement in
accordance with Agreement No. 87-117.
2. The Subdivider and surety for Tract Map 4840 Unit "A"
shall be given fourteen (14) days written notice to proceed with
the completion of the improvements as required by Improvement
Agreement No. 87-11'7.
3. Should the Subdivider fail to complete the aforemen-
tioned improvements within sixty (60) days of the written notice,
the City of Bakersfield shall proceed against the Subdivider and
surety to recover all costs, direct and indirect, and complete the
work of improvement by independent contract or by City forces.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on __ August 9~ 1989 , by
