A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DECLARING AND DETERMINING THAT,
NO BIDS HAVING BEEN RECEIVED, THE MATERIALS
MAY BE MORE ECONOMICALLY PURCHASED ON THE
OPEN MARKET, AND APPROVING AND AUTHORIZING
MAYOR TO EXECUTE CONTRACT WITH MAXIM BUILDERS
INC., FOR METAL BUILDINGS FOR THE HOMELESS
SHELTER.
WHEREAS, this Council approved the initial plans and
specifications for three metal buildings for the City's proposed
homeless shelter at 1600 East Truxtun Avenue on April 27, 1988 and
approved the revised plan therefor on April 26, 1989; and
WHEREAS, on May 15, 1989, bids were solicited for delivery
of materials for such buildings; and
WHEREAS, at the time set for bid openings on May 30,
1989, no bids had been received; and
WHEREAS, the City Manager, through the Finance Department,
after May 30, 1989, solicited proposals from potential suppliers
and has received a proposal, consistent with the technical and
delivery requirements of the bid documents, from Maxim Builders
Inc. to provide all materials for such buildings for the price of
$92,500.00; and
WHEREAS, the City Manager has recommended to this Council
that, pursuant to Section 136 of the Charter, it find that such
materials may be purchased more economically on the open market by
contracting with Maxim Builders Inc. as described above, rather
than by rebidding the project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That the Council declares and determines that the
three metal buildings, as described in the specifications for the
project as previously approved and bid, may be purchased more eco-
nomically on the open market and without rebidding, based upon
information supplied by the City Manager; and
2. That a contract with Maxim Builders Inc. to provide
the three buildings; as described in the bid specification for the
homeless shelter for a price of $92,500.00 is hereby approved, and
the Mayor is authorized to execute such contract.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on June 28, 1989 , by
the following vote:
