A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD FOR MAINTENANCE DISTRICT NO. 1
APPROVING AND ADOPTING THE 1989-90 BUDGET,
LEVYING ASSESSMENTS, RESERVING THE RIGHT TO
PERFORM MAINTENANCE WORK BY CITY FORCES AND
AUTHORIZING COLLECTION OF ASSESSMENTS BY
THE KERN COUNTY TAX COLLECTOR.
WHEREAS, the Report of the Public Works Director, including
the 1989-90 budget for Maintenance District No. 1 and complying with
the provisions of Section 13.04.130 of the Bakersfield Municipal
Code, having heretofore been filed with the City Clerk as required
by Section 13.04.140 of that Code, and the requirements of Section
13.04.150 and 13.04.160 having been met, the City Council has this
date held a noticed public hearing as required by Sections 13.04.210
and 13.04.220 of the Bakersfield Municipal Code; and
WHEREAS, the City Council has considered the Report of the
Public Works Director, including the aforementioned budget, and has
considered and heard any and all protests which may have been filed
against the amounts of the assessments or to the fairness of the
benefit formula or formulae.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The above recitals are found to be true and correct.
2. The Report of the Public Works Director, attached here-
to, including the 1!)89-90 budget for Maintenance District No. 1 and
the assessments therein contained, is hereby approved, such budget
is hereby adopted and such assessments are hereby levied.
3. The reservation of the right to perform maintenance
work by City forces is hereby made.
4. The City Clerk shall transmit the assessments levied
herein to the Direc~2or of Finance with instructions to submit said
list to the Kern County Auditor-Controller and Tax Collector, and
such other County officers as may be required, for placement of such
assessments on the secured roll of the County and request that said
assessments be collected in the same manner as ad valorem property
taxes.

MAINTENANCE DISTRICT NO. 1
City of Bakersfield
Fiscal Year 1989-90
City of Bakersfield, Maintenance District No. 1 is generally described
as a district within the City of Bakersfield extending west from the east curb
line of the median strip of Gosford Road to the eastern boundary of the
Arvin-Edison Canal and the area extending south from the south curb line of
Stockdale Highway to the centerline of Ming Avenue.
Pursuant to the provisions of Chapter 13.04 of Title 13 of the
Municipal Code of the City of Bakersfield, ~le Public Works Director, makes and
files this Report and proposed assessment of and upon all parcels of property
within the district to be assessed for the cost of maintaining and operating
local public improvements, including street landscaping which include, but are
not limited to, plant forms, drainage facilities, irrigation systems and equip-
ment, holes, posts, wires, pipes, conduits, water mains and/or sprinkler systems
and ornamental planting, including turf, lawns, shrubs, and trees now existing
or hereafter to be constructed, laid or planted in and for said maintenance dis-
trict and of a public nature, including the cost of necessary repairs, replace-
ments, water, fuel, power, gas, electric current, care, supervision and any and
all other items necessary for the proper maintenance and operation thereof, and
all additions, improvements and enlargements thereto which may hereafter be
made.
The areas to th~ north and east of Maintenance District No. 1 are
fully developed and street landscaping in those areas is completed and maintained
through the Community Services Department's expenditures. After Proposition 13,
funds available for street landscaping and other maintenance are substantially

reduced. This District was adopted due to the absence of funding frc~ another
source for maintenance of median strip landscaping in the area encompassed by
Maintenance District 1.
The district is designated for medium density development. It is tra-
versed by a single major arterial, Gosford Road. Because of the natural bounda-
ries of the area occasioned in part by the character and timing of surrounding
development, the area within the district receives the greatest benefit from the
improvements and maintenance thereof. Benefits from more permissive or varied
street landscaping, including heat regulation, some noise attentuation and/or
esthetic enhancement accrues to the parcel owners within Maintenance District
NO. 1. In addition, the parcel owners receive the benefit of increases in the
market value of their parcels.
The benefit of increased land value inures to the parcels uniformly,
and can be assessed at a uniform acreage rate. The esthetic and, to some
extent, noise reduction and heat/light regulation will benefit all of the dis-
trict and are most susceptible of enjoyment by each resident. These benefits
are, therefore, to be uniformly assessed on the basis of each residential unit.
The benefit formula has been changed beginning fiscal year 1989-90 to
achieve consistency with k~nefit formulas currently implemented on all other mainte-
nance districts with similar land uses.
The benefit formula is set forth in the attachment hereto.
NOW, THEREFORE, I, E. W. Schulz, Public Works Director of the
City of Bakersfield, by v~rtue of the power vested in me and the order of the
Council of said City, hereby sulknit the following budget and assessment upon all
parcels of property within Maintenance District No. 1, subject to be assessed to
pay the cost of maintenance and operation in said District for the fiscal year
1989-90.
Said assessment is made in accordance with the benefit formula
attached hereto.

BENEFIT FORMULA
The various lots and parcels within the district shall be assessed at the fol-
lowing rates:
For each assessable lot or parcel the assessment shall be:
(1) Non-Residential Zone us Use.
Assessment shall equal the dollar amount determined by:
A portion of the total number of dollars budgeted by the
district for maintenance and operation of the assessment
district for the year in which the assessment is levied
equal to the dollar amount allocated to maintenance and
operation for that year of any and all improvements in
the district except parks and except any improvements
in or on any t~rks or incident thereto (MT)'
multiplied by:
the number of assessable acres, or portion thereof, in the lot or
parcel; (AL),
and divided by:
the number of assessable acres in the district (AT)

Detached dwelling units (those dwelling units not joined to any oth-
ers by any cc~on walls) are deemed permissible in areas zoned R-1.
The number of detached dwelling units permitted to be constructed on
a lot or parcel shall be deemed to be the numeral 5 multiplied by the
number of assessable acres, or portion thereof, in the parcel or lot,
rounded off to the nearest whole number.
Attached dwelling units (those joined to another by one or more com-
mon walls) are deemed permissible in area zoned R-2. The number of
attached dwelling units permitted to be constructed on a lot or par-
cel shall be deemed to be the numeral 12 multiplied by the number of
assessable acres, or portion thereof, in the parcel or lot, rounded
off to the nearest whole number.

NOTICE OF HEARING
MAINTENANCE DISTRICT NO. 1
NOTICE IS HEREBY GIVEN that the Public Works Director of the City of
Bakersfield has caused to be prepared and filed with the City Clerk a Report in
writing, which provides the basis for the benefit assessment for maintaining
street landscaping and other local public improvements to be borne by all par-
cels of property within Maintenance District No. 1, generally extending west
from the east curb li~ of the median strip of Gosford Road to the eastern
boundary of the Arvin-Edison Canal, and the area extending south from the south
curb line of Stockdale Highway to the centerline of Ming Avenue, including your
property. Said Director's Report sets forth the amounts to be provided in the
budget for maintenance and operation, a description of each parcel of property
in the proposed maintenance district by a description sufficient to identify the
same, and the amount of assessment to be levied for the fiscal year 1989-90
against each parcel of property. Said report shall be open to public inspection
at the Public Works Director's Office, 1501 Truxtun Avenue, Bakersfield,
California.
Any interested owner objecting to the amount of the assessment on any of
his or her parcel or parcels of property to be assessed, or the fairness of the
benefit formula or formulae, may file with the City Clerk at or before the hour
fixed for hearing a protest, in writing, signed by him/her, describing the par-
cel of property so that it may be identified, and stating the grounds of his/her
protest, and may appear at said hearing and be heard in regard thereto.
A hearing was held on June 5, 1989 at which time the Council elected to set
this matter for hearing at its meeting of Wednesday, June 28, 1989 at 7:00 P.M.,
or as soon thereafter as the matter may be heard.
Accordingly, said Director's Report will be heard by the Council at its
meeting to the matter [~ld on Wednesday, the 28th day of June, 1989 at
7:00 p.m., or as soon ~hereafter as the matter may be heard, in the Council
Chambers, City Hall, 1501 Truxtun Avenue, Bakersfield, California, at which time
and place said Council will examine said Report and hear protests, if any.
