HomeMy WebLinkAboutRES NO 110-89RESOLUTION NO. 110-89 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REQUESTING KERN COUNTY LOCAL AGENCY FORMATION COMMISSION TO APPROVE REVISION OF CITY'S SPHERE OF INFLUENCE AND THAT SUCH COMMISSION FIND THAT SUCH REQUEST CAN BE CONSIDERED AND STUDIED AS PART OF PERIODIC REVIEW. WHEREAS, a "sphere of influence" means a plan for the probable ultimate physical boundaries and service area of a local governmental agency; and WHEREAS, the Local Agency Formation Commission is required to develop and determine the sphere of influence of each local governmental agency within the county in order to carry out its purposes and responsibilities for planning and shaping the logical and orderly development and coordination of such agencies so as to advantageously provide for the present and future needs of the county and communities; and WHEREAS, if any city desires amendment or revision of an adopted sphere of influence, the City, by resolution of the City Council, may, under Section 56428 of the Government Code, file a request therefore ~¢ith the executive officer who shall present the same to the Local Agency Formation Commission for approval; and WHEREAS, if such commission finds that the request for amendment or revision of a sphere of influence can be considered and studied as a part of the periodic review of spheres of influ- ence as required by law, such commission may, in its discretion, waive reimbursement of costs; and WHEREAS, the City of Bakersfield desires revision of its adopted sphere of influence under provisions of Government Code Section 56428, to remove land and to add lands that could be annexed and served by the City in the future; and also desires waiver by the Local Agency Formation Commission of reimbursement costs. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of the City of Bakersfield as follows: 1. That all the recitals set forth above are true and correct. 2. That the City Council hereby requests revision of the City of Bakersfield's adopted sphere of influence by the Kern County Local Agency Formation Commission under the provisions of Government Code Section 56428, to remove land and to add lands that could be annexed and served by the City of Bakersfield in the future, described as follows: -2- Sphere of Influence Amendment 89-1: Reductions to Sphere of Influence Township 29 south, Range 28 east, Section 5 and portions of sections 8 and 9. Additions to Sphere of Influence North of Ming Avenue, east of Rudd Road. Township 29 south, Range 26 east, Sections 1, 12, 13, 23, 26, and portions of Sections 2, 11, 14, 27, 34 and 35. 22 Township 30 south, Range 26 east and portions of Section 3. One-half mile north of Seventh Standard Road. Township 28 south, Range 27 east, south 1/2 of Sections 31, 32, SW~ of Section 33. Township 28 south, Range 26 east, south 1/2 of Section 35, 36. 3. One-half mile north and south of Olive Drive, east of Fruitvale Avenue.
