A RESOLUTION DECLARING INTENTION
TO ESTABLISH THE SEWER PLAN FOR
THE MCDONALD PLANNED SEWER AREA
AND PRELIMINARILY APPROVING THE
BOUNDARIES OF THE AREA AND FEE
SCHEDULE.
RECITALS
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal
Code and Section 66483 of the California Government Code, provides for a procedure
by which the City Council may assess and collect fees for the purpose of defraying the
cost of constructing planned sanitary sewer facilities ("sewer lines") for local and
neighborhood sewer areas, and;
WHEREAS, The City of Bakersfield desires to provide a sewer line for an
area annexed to the City on June 4, 1985 as shown on the map entitled "McDonald
Planned Sewer Area" attached hereto as Exhibit "A", and incorporated by reference,
and;
WHEREAS, the City has constructed the sewer line as shown on Exhibit
"A", and;
WHEREAS, the City desires to recoup the cost of constructing said sewer
line, and;
WHEREAS, the fees for construction of the sewer line (excluding sewer
connection fees) set forth in Exhibit "B" attached hereto and incorporated by reference,
are based on the actual cost of providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing recitals are true and correct and are incorporated
herein.
2. The Council hereby preliminarily approves the boundary of the
"McDonald Planned Sewer Area" area of benefit and limits of improvements as
described on the map attached hereto as Exhibit "A", and the fee schedule attached
hereto as Exhibit "B".
3. Payment by a homeowner of his/her pro rata share of the cost of
constructing the sewer line is due and payable (along with the sewer connection fee) at
the time the homeowner abandons his/her septic tank and obtains a building permit for
connection to the sewer line.
