A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CALLING A SPECIAL MUNICIPAL
ELECTION FOR THE PURPOSE OF FILLING A
VACANCY ON THE COUNCIL FOR THE UNEXPIRED
TERM IN WARD 1; CALLING THE GENERAL MUNI-
CIPAL ELECTION FOR WARDS 1, 3, 4 AND 7;
AND REQUESTING THE BOARD OF SUPERVISORS OF
THE COUNTY OF KERN TO ORDER THE CONSOLI-
DATION OF THE SPECIAL MUNICIPAL ELECTION
AND THE GENERAL MUNICIPAL ELECTION WITH
THE STATE OF CALIFORNIA GENERAL ELECTION
TO BE HELD ON TUESDAY, NOVEMBER 7, 1989.
WHEREAS, a valid petition has been filed with the City
Clerk requesting a Special Election to fill the vacant council
seat for Ward 1; and
WHEREAS, said City Clerk has certified said petition to
the Council; and
WHEREAS, the City Charter, Section 16 and 74 provides for
said Special Election; and
WHEREAS, Section 1.16.190 of the Municipal Code of the
City of Bakersfield requires a Special Election be held on the
same date as the General Election whenever a vacancy occurs on the
Council more than six months of the next general election for
Councilmember in the ward where the vacancy occurs; and
WHEREAS, the Council seat for Ward 1 became vacant on
April 18, 1989, more than six months of the next general election
for Ward 1 councilmember; and
WHEREAS, Section 67 of the Charter of the City of
Bakersfield prescribes that a General Municipal Election for elec-
tion of members of the Council shall be held on the first Tuesday
after the first Monday in November in each odd-numbered year; and
WHEREAS, Section 23300 of the Elections Code of the State
of California provides for consolidation whenever two or more
elections are called to be held on the same day; and
WHEREAS, it is the desire of this Council that the two
elections above specified be consolidated with the State of
California General Election to be held on Tuesday, November 7,
1989.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. That pursuant to Sections 16 and 74 of the City
Charter and Section 1.16.190 of the Municipal Code of the City of
Bakersfield, a Special Municipal Election is hereby called to be
held in the City of Bakersfield on Tuesday, November 7, 1989, for
the purpose of filling the vacancy on the City Council for Ward 1
for the remainder of the unexpired term.
2. That the General Municipal Election for the office
of Councilmember in Wards 1, 3, 4 and 7 of the City of Bakersfield
for the full term of four years is hereby called and will be held
on Tuesday, November 7, 1989.
3. That said Special Municipal Election for the purpose
of filling a vacancy on the Council for the unexpired term in Ward
1 and the General Municipal Election for the purpose of electing
Councilmembers in Ward 1, 3, 4 and 7 of the City of Bakersfield is
hereby ordered consolidated with the State of California General
Election to be held on Tuesday, November 7, 1989.
4. That the Board of Supervisors of the County of Kern is
hereby requested to make an order directing the County Clerk to
consolidate and conduct both the Special Municipal Election for
the purpose of filling a vacancy on the Council for the unexpired
term in Ward 1 and the General Municipal Election for the purpose
of electing councilmembers in Wards 1, 3, 4 and 7 to the City
Council of the City of Bakersfield with the State of California
General Election to be held on Tuesday, November 7, 1989.
5. The County Clerk is hereby further authorized and
requested to canvass the returns of said Special Election and
General Municipal Election and to certify such canvass of the
votes so cast, to the City Council.
6. The City Clerk is hereby authorized and directed to
certify to the adoption of this resolution and to transmit a copy
thereof to the County Clerk of Kern County and to the Board of
Supervisors of the County of Kern.
7. The City Clerk is hereby authorized and directed to
give all Notices and perform all advertising as required by law
and perform or cause to be performed all the duties and functions
required.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on May 17~ 1989 , by
