A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD AUTHORIZING SETTLEMENT
OF CLAIMS AGAINST THE CITY.
WHEREAS, California Government Code Section 935.4 pro-
vides that a public entity may authorize its employees to allow,
compromise or settle liability claims against the entity in
amounts not exceeding twenty thousand dollars ($20,000) per
claim; and
WHEREAS, under Resolution No. 47-82, the Council of the
City of Bakersfield authorized the City Attorney to settle lia-
bility claims against the City in an amount not to exceed twenty
thousand dollars ($20,000); and
WHEREAS, the Office of Risk Management for the City of
Bakersfield handles all liability claims against the City prior
to service of a Summons and Complaint; and
WHEREAS, effective administration
program necessitates the reliance upon the
Attorney and the Office of Risk Management
liability claims against the City;

NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of Bakersfield hereby authorizes settlement authority for
liability claims against the City as follows:
1. Prior to service of a Summons and Complaint, the
Office of Risk Management is hereby authorized to settle liability
claims in an amount not to exceed ten thousand dollars ($10,000).
The Office of Risk Management and the City Attorney are hereby
authorized to jointly settle such claims in amounts exceeding ten
thousand dollars ($10,000) but not exceeding twenty thousand
dollars ($20,000).
2. After service of a Summons and Complaint, the
Office of the City Attorney is authorized to settle liability
claims in an amount not to exceed twenty thousand dollars
($20,000).
3. Any liability claim to be settled in an amount in
excess of twenty thousand dollars ($20,000), whether or not a
Summons and Complaint have been served, may be settled only after
receiving authorization from the City Council.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
