Owner/Operator Martin and Richard Etcheverry own and operate Ernst Manufacturing. IV. Backqround The Department received a complaint from an employee, who wished to remain anonymous. The complaint stated that various hazardous wastes were being disposed into a sump located at the extreme southwest corner of the facility. V. Description of Facilitv Ernst Manufacturing is located in southeast Bakersfield. The site is approximately 5 to 7 acres in size. VI. Observations I met with Martin and Richard Etcheverry to discuss the complaint. The following is a narrative of our conversation. Inspection ReporlÞ Ernst Manufacturing Page 2 e They manufacture packing house equipment and buy in bulk quantity various bolts, nuts, etc. They then repackage, into smaller sizes, these items for resale. The only hazardous materials used are the paint used to paint the packing house equipment and paint thinner. The paint comes in one-gallon size containers. When empty, they are disposed of to a dumpster. The paint thinner is purchased in 50-gallon drums from Sullivens Standard Petroleum in Bakersfield. Sullivens picks up these drums when empty. All of their vehicles are taken to Jiffy Lube to have the oil changed. They said that some of their employees had dumped some paint into the pit which is primarily used to collect rainwater. Martin Etcheverry said that Terry L. Grey, Hazardous Materials Inspector, from Kern County, had been on-site to investigate the same complaint. Grey is to send him a letter describing the sampling and cleanup procedures needed to mitigate the problem. VII. Conclusions This complaint can be closed and tracked via the Kern County Health Department and by this inspection. Union Avenue Bakersfield, CA 93307 Gentlemen: A complaint was received by this office on January 31, 1991, regarding the illegal disposal of gasoline, oil, and cleaning solvents by your company. An investigation was conducted on February 5, 1991. It appears that oils and other substances have been discharged to the soil at the southwest corner of the property, adjacent to the Kern Island Canal. It is a violation of the California Health and Safety Code, Article 13, Chapter 6.5, Division 20, Section 25250.5 and Article 8, Section 25189.2(c) for hazardous wastes to be disposed of in this manner. Therefore, within 30 days of receipt of this letter, all visibly contaminated soil is to be excavated and placed into secure containers. A representative sample(s) must be collected and analyzed by a certified hazardous waste laboratory for the following laboratory analyses: Title 22, inorganic persistent and bioaccumulative toxic substances (metals), EPA Method 8240 test for purgeable halogenated and aromatic organics, and polychlorinated biphenyls (PCB's). Notify this office 48 hours prior to sampling. When laboratory analyses have been completed, forward a copy of the Report to this office for review.
