Dear Mr. Wood:
The Kern County Environmental Health Services has received and reviewed the assessment report,
dated June 14, 2001, for the site referenced above. The report provided the following infonnatÍon:
1. On March 20, 2001, Innovative Construction Solutions, Inc., of Huntington Beach.
California, excavated five test pits, using a backhoe, to depths of approximately five feet
below ground surface. The test pits were located in the vicinity of previous borings B9 and
B 10, immediately in front of two sheds located in the impound portion of the site.
2. A total of six soil samples were analyzed for TRPH using EP A Method 418.1. Each sample
was analyzed, then passed through a #60 sieve and analyzed again.
3. Visual observations revealed the presence of bottles, metal, wood, concrete, automobile
debris, rubber, and asphalt one to two feet in diameter, along with soil within the pits
excavated. The soil did not appear stained.
4. The Total Recoverable Petroleum Hydrocarbons detected in each sample retrieved were
significantly higher than the amount detected after using the #60 sieve. Contamination
present in the soils sieved did not exceed cleanup levels proposed and approved in previous
clean-up plans.
This letter confirms the completion of the assessment and remediation of contaminated soils at the
above-described location. Based on the results submitted, this Department is satisfied that the
assessment is complete, and that no further action is indicated at this time.
It is important to note that this letter does not relieve you of further responsibilities mandated under
the California Health and Safety Code and California Water Code if additional or previously
unidentified contamination at the subject site causes or threatens to cause pollution or nuisance or
is found to pose a significant threat to public health.

Dear Mr. Wood:
The Kern County Environmental Health Services Department received a revised Work Plan for Assessment
of Soil Conditions at the property previously called "Pick Your Part Auto" at the location referenced above.
The work plan presented the following proposed activities:
1. Geomatrix proposes to excavate four test pits, using a backhoe. One ofthe test pits will be located
between borings B9 and B 1 0, and the remaining test pits will be located within approximately 20
feet of these borings.
2. Each test pit will be approximately two (2) feet wide, five (5) feet deep and eight (8) feet long.
3. Geomatrix proposes to visually observe the soil and collect soil samples from the soil for laboratory
analysis. Selected soil samples collected from the test pits will be analyzed for TPH and lead, using
EP A methods 80 15M and 6010, using a state certified laboratory.
4. Geomatrix proposes to backfill the pits with excavation spoils prior to moving to a new sampling
location.
The proposal presented has been reviewed and approved as revised. Please contact this department within
48 hours of planned sampling, so that an inspector can be on site to witness work. If you have any questions

Dear Ms. Green:
Geomatrix Consultants, Inc. (Geomatrix) has prepared this work plan on behalf of Pick Your
Part to respond to a request by the County of Kern Environmental Health Services Department
(CKEHSD), dated November 16, 2000, for additional actions required for site closure, As you
are aware, Geomatrix has recently been retained by Pick Your Part to perform additional
activities at the site to satisfy the CKEHSD request. This work plan presents our proposed scope
of work for assessment of soil conditions at the location of borings B9 and B 1 0 in the Impound
Section of the former Pick Your Part Facility located at 2120 South Union Street in Bakersfield,
California (the site). This work is being performed to identify an appropriate remedial
alternative for this area of the site. This work plan presents a summary of previous assessments
and remediation performed to date and the proposed scope of work for additional assessment to
be conducted at the site.
BACKGROUND
A subsurface investigation was performed at the site by Contamination Cleanup of California
(CCC) in April 1994 to comply with a CKEHSD order. Forty-eight shallow soil borings were
drilled and samples were collected from depths of approximately 1 and 3 feet below ground
surface (bgs) at each boring location and submitted for laboratory analysis. The investigation
identified areas at the site where soil contained elevated levels of petroleum hydrocarbons and
lead. In August 1998, CCC submitted a Remediation Plan for Contaminated Soil to CKEHSD
outlining remediation goals for total petroleum hydrocarbons (TPH) of 1000 milligrams per
kilogram (mg/kg) and lead of 50 mg/kg (TTLC) and 5 mglliter (STLC).
In May 1999. approximately 437 cubic yards of soil was excavated from the site and disposed of
at a Class I facility. Soil was removed from four areas: the vehicle crusher: the engine pile: the
storage sheds area of the impound section; and adjacent to the service building. Thirteen soil
samples were collected to con1ìrm remediation goals had been achieved. Two samples. S7 in the
vehicle crusher area and S 12 in the storage sheds area. had TPH and lead reported above cleanup

goals. Additional soil was then excavated in the areas of S7 and S 12, however no confirmation
samples were collected.
In April 2000, four soil borings were drilled to depths of approximately 25 feet bgs, two in the
vicinity of S7 and two in the vicinity of S 12, to collect soil samples to confirm remediation goals
had been met during the additional soil removal. Soil samples were collected from these borings
at intervals of approximately five feet and submitted for laboratory analysis. Reported
concentrations ofTPH and lead in the samples collected from a depth of approximately five feet
bgs from the two borings drilled in the vicinity of previous boring S 12 (B9 and B 10) were above
remediation goals for TPH and lead. It was noted on the chain-of-custody records for these
samples that the samples contained asphalt material.
On November 16, 2000, CKEHSD issued a letter to CCC indicating that in order to receive
closure for the site, soil in the area of borings B9 and B 10 must be removed to a depth of five
feet bgs and properly disposed of. As an alternative, a risk assessment could be completed to
demonstrate that the remaining soil in excess of the remediation goals does not pose a risk to
current and future property use.
OBJECTIVES AND APPROACH
Based on our review of project documents prepared by CCC, additional assessment of soil in the
vicinity of borings B9 and B 10 is required to select the appropriate remedial alternative. The
objectives of the additional assessment are to assess the vertical and horizontal extent of
petroleum hydrocarbons and lead in soil in the vicinity of borings B9 and B 10.
The approach for this assessment includes:
· excavating up to five test pits to approximately five feet bgs;
· visually observing the soil and collecting soil samples for laboratory analysis;
· backfilling the test pits with excavation spoils; and
· analyzing soil samples for TPH and lead.
SCOPE OF WORK
The proposed scope of work for this assessment consists of the following four tasks:

Task 1: Pre-field Activities
This task consists of activities to be performed in preparation for fieldwork. Pre-field activities
to be conducted include:
· coordinating site access and field logistics with site personneL
· preparing a Site Health and Safety Plan,
· coordinating and scheduling with subcontractors, and
· notifying Underground Services Alert (USA) of our test pit digging.
Task 2: Test Pit Excavation and Soil Sampling
This task consists of excavating up to five test pits to depths of approximately five feet bgs using
a backhoe to visually observe soil conditions and obtain soil samples for laboratory analysis.
The test pits will be approximately two feet wide, five feet deep and eight feet long. The
locations for the test pits will be selected to provide information on the lateral and vertical extent
of petroleum hydrocarbons and lead in soil in the vicinity of borings B9 and B 1 O. It is estimated
that one test pit will be located between borings B9 and B 10 and the remaining test pits will be
located within approximately 20 feet of these borings. The actual locations of the test pits will
be determined in the field based on observed conditions. The estimated locations of the test pits
are shown on the attached figure from the May 22, 2000 Phase II Report by CCC, which does
not have a scale. Geomatrix is currently preparing a scaled site plan which will be included with
the results of this assessment. After completion of soil sampling at a location, the test pit will be
backfilled with excavation spoils prior to mO\"Íng to a new location and excavating the next test
pit. No test pits will remain open, except for the test pit that is being sampled under the
observation of Geomatrix personnel.
Task 3: Laboratory Analyses
This task consists of analyzing selected soil samples collected from the test pits for TPH and
lead. The soil samples selected for laboratory analysis will be analyzed for TPH with carbon
chain distinction using EPA Method 8015M and lead using EPA Method 6010. Soil samples
will be analyzed by a state-certified laboratory.
Task 4: Data and Remedial Alternative Eyaluation
Data obtained during this assessment will be evaluated and an appropriate remedial alternative
will be selected to address the requirements set forth in the CKEHSD's November 16,2000
letter, The selected remedial alternative will be presented in a work plan that will contain the
following:

Geomatrix Consultants, Inc. (Geomatrix) has prepared this work plan on behalf of Pick Your
Part to respond to a request by the County ofKem Environmental Health Services Department
(CKEHSD), dated November 16,2000, for additional actions required for site closure_ As you
are aware, Geomatrix has recently been retained by Pick Your Part to perform additional
activities at the site to satisfy the CKEHSD request. This work plan presents our proposed scope
of work for assessment of soil conditions at the location of borings B9 and B lOin the ImpoWld
Section of the former Pick Your Part Facility located at 2120 South Union Street in Bakersfield,
California (the site). This work is being performed to identify an appropriate remedial
alternative for this area of the site. This work plan presents a SlUTImary of previous assessments
and remediation perfonned to date and the proposed scope of work for additional assessment to
be conducted at the site.
BACKGROUND

Dear Mr. Volero:
The Department has reviewed the site assessment report dated May 22, 2000, for the site referenced
above. Telephone calls were made by this agency to determine future use ofthe property. Art Rockhoff
was met at the site. He stated that he is currently leasing the property to a company that will be storing
and scrapping vehicles; however, he would not be able to confirm that the site will never be used as a
residence or schooL The person leasing the property has been advised to fence or rope the area near B9
and B 1 0, since this area is the only area with samples that exceed soil cleanup levels.
The following additional actions are required for site closure:
· Soil is to be removed in the area of B9 and B 1 0 to a depth of five feet and properly
disposed of. This disposal mi!Y meet criteria utilized by the Local Solid Waste Landfills.
As an alternate option, you may complete a risk assessment, utilizing established practices to demon-
strate that the contamination remaining in excess of the cleanup criteria is not, and will not be, a hazard
to exposures in current and future property use.
You must either submit a letter to this department describing excavation plans for the area impacted.
with plans to bring in clean fill, or provide a site risk assessment for review by December 20, 2000.

Dear Mr. V ollero:
The Department has reviewed the revision letter for the workplan for the site referenced above. The
following summarizes work completed and proposed for the site:
1. In July 1999, soil was excavated to a five-foot (5' ) depth in the motor pile area and near the
crusher. Samples were retrieved to verify that cleanup goals were obtained. Samples S 7 and
S 12 exceeded cleanup criteria established for the project.
2. Additional sampling proposed includes the following:
a. A minimum of two soil borings will be retrieved in the previous locations of samples
S7 and S12.
b. A total of four soil borings will be drilled in the scrap and impound sections. They
will be advanced to a depth of25 feet or to a depth in which screening suggests two
nondetect samples.
c. Samples will be retrieved using a direct push (Geoprobe) sampling rig beginning at
5 feet, and soil samples will be collected in a split spoon sample containing a brass
liner.
d. The consultant will screen utilizing visual observations.
e. The samples will be sent to a state-certified laboratory for analysis. Each sample will
be tested for the presence of Total Petroleum Hydrocarbons, TPH-diesel, Total Lead
and Soluble Lead.
f. The laboratory will be encouraged to screen for the presence of asphalt in the
samples analyzed.

The workplan is acceptable with the following modifications:
1. The Department must be present to witness samples retrieved at the site. All samples
retrieved must not be modified in any manner between retrieval and approved analysis.
(Though observations can be made for the presence of asphalt from soil in the area, the
consultant and the laboratory must not modify any sample retrieved for analysis. The
laboratory must utilized approved methods in analyzing the sample retrieved.)
2. Each plot plan provided has different dimensions for the scrapping and impound sections.
Please review all previous photos and notes to determine exact locations of S7 and S 12.
3. As stated in the workplan dated January 7,2000, the results must be used to determine the
lateral and vertical soil contamination in the affected areas at the subject site. The
concentrations of contaminants revealed by the investigation must be used to determine
whether a significant threat exists at the site.
4. This Department must be notified within 48 hours of planned augering, before augering is
scheduled to begin. All requirements for proper management, characterization, and disposal
of any cutting must be met.

Contamination Clean-Up of California, Inc. (CCC) is submitting the
recommended changes to the proposed Work Plan, dated December 27, 1999. A new
plot plan is included reflecting the placement of soil borings within the vicinity of
previous soil borings S-7 and S-12 at the subject site.
The proposed Work Plan will be revised as follows:
1. The placement of a minimum of two soil borings in the previous locations
of samples # S-7 and S-12.
2. A total of four (4) soil borings will be installed in excavation areas #1 and
#3 of the wrecking section at the subject site. These borings will be
advanced to a depth of twenty-five feet (25ft) or to a depth which
screening suggests two non-detect samples.
3. Soil samples will be collected at five feet interval to a total depth of

4. The soil samples will be screened in the field for hydrocarbons stains,
odor and for the presence of asphalt materials.
5. The analytical laboratory will be advised to screen soil samples for the
presence of asphalt materials prior to preparation and analysis.
The wrecking section for the facility used construction material as backfill and
asphalt, concrete, bricks, and other construction debris was observed during the
excavation in the areas of proposed sampling.
If you concur with the changes to the work plan we would like to proceed with the
sampling via verbal approval with confinnation by written correspondence.

Proposed Work Plan for the Assessment of Soil Contamination at Pick

Dear Mr. V ollero:
The Department has reviewed the work plan submitted for the site referenced above. The following summarizes
work proposed:
1. Four soil borings are to be advanced in Areas #1 and #3, in the locations where earlier samples S7 and S12
were obtained. The borings will be drilled to a depth of twenty-five feet, or deeper if required.
2. Soil samples are to be retrieved at five-foot intervals utilizing a direct push, geoprobe sampling rig and a
split spoon sampler with brass lining.
3. The samples will be screened utilizing an OVA meter FID for the presence of Volatile Aromatic
Hydrocarbons. Soil cuttings will be placed back into the borings.
4. All samples will be analyzed for Total Petroleum Hydrocarbons (TPH) by EPA Test Method 418.1, TPH
diesel byCal EPA DTSC Modified Test Method 8015, Total Lead (TILC) by EPA Test Method 7420, and
Soluble Lead (STLC) by Title 22 Wet Method (Extraction) and EPA Test Method 7420.
The workplan must be revised to reflect the following suggested changes:
1. A few boring locations must be changed so that at least one boring is in the location labeled S7 and one is
in the location labeled S 12.
2. A new plot plan showing the new sample locations must be provided to this department for review and
approval.
3. Field screening must be designed for heavy/nonvolatile hydrocarbons, such as oils and diesel. Samples
must be advanced until screening suggests two non-detect samples.

The Kern County Environmental Health Services Department has reviewed the
Remediation Report dated September 23, 1999. The following information was provided
within the report:
1. 487 cubic yards of TPH contaminated soil was removed from the scrap area,
impound area, crusher, and motor pile area, at the address referenced above, from
depths ranging from two feet (2') to five feet (5') beneath ground surface.
2. Contaminated soil was transported via uniform hazardous waste manifests for
disposal.
3. The four (4) excavated areas were backfilled with clean imported soil and
compacted to a relative ninety percent (90%).'
4. A total of thirteen (13) confirmation samples were collected from the affected areas
excavated at the site.
5. The test results for the confirmation samples exceeded the cleanup criteria
summarized in the August 1998, remediation plan for Total Petroleum
Hydrocarbons, and Lead, for samples retrieved at E4, E5, S7 and S12 locations.

After review of the report, the Department finds that the "No Further Action" proposal has
not been justified. Proposed cleanup criteria have not been met at a few locations on site,
and a risk evaluation of the site contamination exceeding cleanup levels has not been
provided.
The following is still required of the site:
1 . The vertical and lateral extent of contamination must be determined in the areas
where highest contamination was discovered. (This would be the S7, and S12
areas.)
2. Confirmation samples retrieved must be analyzed for TRPH, Total and Soluble
Lead levels.
3. Field screening must be used when retrieving samples to determine where sampling
should be terminated.
4. If you wish to continue excavation of contaminated soil, you must advise the local
agency approximately 48 hours before excavation is scheduled to begin. All
requirements for proper management, characterization, and disposal of excavated
materials must be met. as before.

Contamination Clean-Up of California, Inc. (CCC), is in receipt of your agency
response letter to the proposed soil remediation plan for the Pick Your Part Auto
Wrecking facility, Bakersfield, California. The revisions to the soil remediation plan are
as foltows:
1. The excavated contaminated soil of the scrap area wilt be segregated into a
separate stockpile. Upon completion of soil excavation in the scrap area, four (4)
random samples wilt be coltected from this pile and analyzed for total lead
(TTLC).
2. The contaminated soil excavated from the Retail and Impound areas at the site
wilt be segregated into pile #2. A total of two (2) soil samples wilt be randomly
collected from ihis pÍÌe and analyzed for tûtallead (TiLC) at a State Ccrliñeò
Analytical laboratory.
3. A twenty four hour (24 hr.) pre-notification wilt be given to your agency for the
witness of the collection of the confinnation samples at the subject site.
The lead concentrations of the soil samples of the two stockpiles generated from
the excavation wilt dictate the disposition of the impacted soil at the site. If you concur
with these revisions to the proposed soil remediation work plan, please reply in writing.

contaminated soil at the Pick Your Part facility in Bakersfield. This appears to be a
viable remediation option for this site.
However, due to previous soil sample results indicating hazardous levels of lead in
the soil in the scrap section of the facility, the soil will have to be segregated and
characterized after excavation. A least four random samples are to be taken from
the pile. The samples must be analyzed for lead to determine if the soil is
hazardous. Disposal options will be determined by the results of the analysis.
Before approval can be given to begin work at the site, a revised corrective action
plan needs to be submitted and approved. If you have any questions, please

Contamination Clean-Up of California, Inc. has been retained by Pick Your Part
Auto Wrecking for the remediation of Total Petroleum Hydrocarbon contaminated soil at
their former facility at 2120 S. Union Avenue, Bakersfield, California.
Contamination Clean-Up conducted a site investigation at the subject site on April
19, 1994. The subsurface investigation revealed TPH and Lead contaminants at the site
in excess of regulatory agency's action limits and will require remediation. The volume
of soil to be removed and properly disposed of is approximately 1500 tons. The affected
areas at the subject site will be excavated and the disposition of the impacted soil will be
transported to CD Resources, Inc. Recycling Facility, Devore, California. Confirmation
soil samples will be collected from the excavated areas to certify that the contaminant
concentration has be reduced to meet the clean-up criteria included in the Remediation
Plan submitted for your approval prior to the commencement of work.
If you concur with the proposed clean-up plan for the remediation of impacted
soil at the subject site, please reply in writing. Pick Your Part would like to initiate the

California, Inc., for the subsurface investigation of soil contamination at the facility noted

The following comments as they relate to the sampling plan must be addressed in an

2. Pages 3 and 4, Section 3.1, 3.2, and 3.3. state that samples are to be retrieved at
specified depths for the three areas of concern. What. is the plan if ~ntamination
continues beyònd the levels indicated, and how will samples be field-screened for
contamination? Typically borings are continued until a minim~ of ten (10) feet of
uncontaminated soil is encountered.
3. This Department requires that teflon be used to seal samples instead of aluminum
as specified in the sampling plan.
4. Page 5, Section 4.0 states the samples will be "placed on ice." The samples must be
placed in "Blue ice" because ice melts, causing samples to get wet. This typically
results in labels being unreadable and samples being contaminated by water if a seal
should leak.

This letter is in response to our telephone conversation of March 2nd.; please use it as an
addendum to the proposed sampling plan for Pick Your Part Auto Wrecking, which was sent to
you on February 23, 1994.
With regard to our telephone conversation, please note that we are making the following
amendments, as per our discussion, to the proposed sampling plan:

Samples will be taken at the depths specified in the sampling plan. If at the final
sampling depth noted in the sampling plan, there is still visual evidence of soil
(staining) contamination, then additional samples will be drawn. Samples will be
continually extracted until visual observations reveal the contamination has
subsided.
4. The accompanying plot map will reveal the location of the planned sampling
points.
Mr. Gray, thank you for your attention in this matter. If these adjustments are acceptable,
we are ready to begin sampling within one week of your approval.

1.0 Introduction
The Pick Your Part auto dismantling and retail facility is located at 2120 S. Union
Avenue, Bakersfield, California. The facility consists of an office building, storage and service
sheds, used autos, parts and other auto accessories. The site occupies 7.3 acres offlat land and is
located in close proximity to other auto recycling establishments. Pick Your Part's primary
business is the recycling of used autos and the retailing of parts. It is a serve yourself operation
which means customers remove the parts they choose from the automobiles.
Pick Your Part has occupied the facility for the past four years. Prior to Pick Your Part,
the site was home to a truck repair and wrecking establishment from the .early 1960's until Pick
Your Part took possession around 1990.
In February of 1994, the Kern County Environmental Health Services Department
inspected the facility and noticed significant soil staining in the scrap area of the facility. After
that inspection, Pick Your Part was asked to perform a more detailed characterization of the
potential nature and extent of the contamination at the facility.
Contamination Clean-Up of Cali fomi a, Inc. has been retained by Pick Your Part to
perform a characterization of the property.
2.0 Purpose And Objective
The purpose and objective of this Subsurface Investigation is to determine the nature and
the extent of the contamination at the Pick Your Part facility at 2120 S. Union Avenue in the City
of Bakersfield.
3.0 Field Investigation
The subsurface investigation of soil contamination will consist of conducting vadose soil
boring sampling throughout the areas in question. In order to minimize the impact sampling will
have on the Pick Your Part operation and still recover the data necessary for a complete site
investigation, the site has been divided into three (3) distinct sections. Those sections are (1) the
Retail Section, (2) the Scrap Section, and (3) the Impound Section.

3.1 The Retail Section
Background
The Retail Section of the Pick Your Part facility is approximately 5 112 acres in size and has
approximately 850 automobiles on support stands. These are the automobiles from which the
customers are allowed to remove parts. The automobiles in this section have had all of the fluids
removed (oil, gas, anti-freeze, radiator coolant, etc.). Because most of the fluids have been
removed, this section has only minor surface spills. The spills are the result of any residual fluid
left in the car as it is practically impossible to remove the fluids in their entirety.
Because of the relatively minor impact to soil, we suggest the taking of twenty (20) soil
samples in this area.
Samples will be taken at the one (1) foot level.
The samples will be analyzed for the following:

3.2 The Impound Section
Background
The Impound Section is approximately one (1) acre in size. The Impound Section is
where the abandoned automobiles are placed while Title (ownership) of the vehicle is being
converted over to Pick Your Part.
In addition, once the vehicle becomes the property of Pick Your Part, it is in this area
where the oil, gasoline, anti-&eeze, freon, catalytic converter, etc., are removed &om the vehicle.
The area of the impound that has the greatest potential risk of.contamination is the area
around the de-fluidizing racks where the automobiles are prepared before they go into the Retail
Section.
We propose to drill fifteen (15) soil borings in this area. The borings will be taken at the
one (1), and three (3) foot levels.

Background

The Scrap Section is approximately one (1) acre in size. Once the sellable parts are
removed by the customers, the automobile is transfered from the Retail Section to the Scrap
Section. In the Scrap Sectio~ the automobile is crushed and sent to a steel processor for
recycling.
Because of the nature of the scrapping operation, it is the Scrap Section that has the
greatest potential for soil contamination.
We propose sixteen (16) samples be taken in the scrap area. These samples will be taken
at the one (1») three (3») and five (5) foot levels.
The samples will be analyzed for the following:

4.0 Sampling Procedures
Samples will be collected in the following fashion:
A tractor, with an auger attachment, will be used to drill sample borings to the desired
depth. The sample boring will be cleaned out and the samples will be collected by utilizing a
hammer attached sampler containing a brass liner. The undisturbed soil samples will be
withdrawn from the sampling auger in the two (2) inch brass liners (tubes), ends covered with

aluminum foil, capped, sealed with tape, labeled and placed on ice. The auger will be
decontaminated between each sampling by washing it with a detergent (TPS) solution, rinsed and
then given a final rinse with de-ionized water.
The samples will be transported to a State Certified Analytical Laboratory, via a Chain of
Custody Form, for analysis.
5.0 Geology and Hydrology
Conversations with Mr. Tom Haslebacher of the Kern County Water Agency revealed the
following information.
The sediment of the surrounding area is of recent Pliocene Age and alluvial deposits iTom
the Kern River Alluvial Fan. Groundwater depth is approximately 200 feet and the flow is to the
southeast. Groundwater flow is unconfined to approximately 800 feet.
6.0 Summary
The purpose of this proposed Sampling Plan is to determine the horizontal and vertical
extent of soil contamination at the Pick Your Part facility at 2120 S. Union Avenue in Bakersfield,
California.
This is to be acocmplished by extensive soil borings throughout the facility. The samples
win be analyzed to determine the nature of the contamination.
Upon completion of this Sampling Plan, a written summarization of the results and
recommendations as to further actions will be submitted for review.

SUBJECf: HAZARDOUS WASTE VIOLATIONS LOCATED AT 2120 SOUTH
UNION AVENUE, BAKERSFIELD, CALIFORNIA
Dear Mr. Snook:
On January 12, 1994, an inspection was conducted at the facility noted above. During the
inspection, spillage of waste oil to the ground was noted throughout the site. At the east
end of the facility a large area of concentrated oil-contaminated soil was obselVed. As noted
below, the facility is not in compliance with many of the storage and handling requirements
for small quantity hazardous waste generators. As a result of that inspection, violations of
hazardous waste regulations and statutes were identified. Specific violations are listed
below.
1. The facility is in violation of California Health and Safety Code, Article 8, Chapter
6.5, Division 20, Section 25189.5 (a).
2.
"The disposal of any hazardous waste or the causing thereof, is prohibited when
the disposal is at a facility which does not have a permit from the department
issued pursuant to this chapter."
The property owner or operator does not have a permit issued from the ,Department
to dispose of.hazardous waste at the site noted above.
The facility is in violation of California Health and Safety Code, Article 8, Chapter
6.5, Division 20, Section 25189 (d).
"Any person who negligently disposes or causes the disposal of any hazardous
waste at a point which is not authorized. "
Waste oil has been disposed on the ground at the facility noted above.

3. The facility is in violation of California Health and Safety Code, Division 20, Chapter
6.5, Section 25143.9.
"Recyclable waste material must be labeled or marked clearly with the words
EXCLUDED RECYCLABLE MA TERIAL."
The waste oil storage containers and waste antifreeze containers were not labeled or
marked in accordance with the above requirement.
4. The facility in violation of California Health and Safety Code, Division 20, Chapter
6.5, Section 25250.5.
"Disposal of used oil by deposit on land is prohibited. "
Waste oil has been disposed of on the soil at the facility noted above.
5. The facility is in violation of California Code of Regulations, Chapter 30, Title 22,
Section 66262.11.
''A person who generates a waste, as defined in Section 66261.2, shall determine
if that waste is a hazardous waste using the following method. The generator
shall determine if the waste is listed as a hazardous waste in Article 4 or Chapter
11 or in Appendix X of Chapter 11 of this division. If the waste is listed in
Appendix X and is not listed in Article 4 of this Chapter, the generator may
determine that the waste from his particular facility or operation is not a
hazardous waste by either (1) testing the waste according to the methods set forth
in Article 3 of Chapter 11 of this division, or according to an equivalent method
approved by the Department pursuant to Section 66260.21; or (2) applying
knowledge of the hazardous characteristics of the waste in light of the materials
or process used and the characteristics set forth in Article 3 of Chapter 11 of this
division. "
It was determined during the inspection that none of the apparent waste-like
substances had been analyzed or that the generator had knowledge of their hazardous
properties.

6. The facility is not in accordance with California Code of Regulations, Chapter 30,
Title 22, Section 66262.34(f)(1 ) (2)(3)(A)(B)(C).
"Generators who accumulate hazardous waste on site without a permit or grant
of interim status shall comply with the following requirements: the date upon
which each period of accumulation begins shall be clearly marked and visible for
inspection on each container and portable tank; the date the 90 day period begins,
for purposes of Subsection (a) and (b) of this Section, shall be clearly marlæd
and visible for inspection on each container and tank. All containers and
portable tanks shall be labeled with the following information: the composition
and physical state of the wastes, statement or statements which call attention to
the particular hazardous properties of the wastes (e.g., flammable, reactive, etc.)
and the name of the person producing the wastes."
It was determined during the inspection that none of the containers storing
hazardous waste was labeled in accordance with the above requirements.
7. The facility is in violation of California Code of Regulations, Chapter 30, Title 22,
Section 66264.173.

It was obseIVed during the inspection that containers storing hazardous waste were
open while not in the process of adding or removing waste.
8. The facility is in violation of California Code of Regulations, Chapter 30, Title 22,

liThe owner or operator shall inspect areas used for container storage or transfer,
at least weekly, looking for leaking containers and for deterioration of containers
and the containment system caused by co"osion or other factors."
There were no records at the facility to demonstrate that the above requirements had
been met.

9. The facility is not in accordance with California Code of Regulations, Chapter 16,
Title 22, Sections 66266.81 (a) (3) (A) (B), 66266.81 (a) (6) (D), and 66266.81(b)(I)(2)(3).
''A person who accepts spent lead-acid storage batteries in exchange or partial
exchange for operable lead-acid storage batteries shall be exempt from the
requirements of this division pertaining to the generation and storage of a
hazardous waste with respect to the batteries, unless the person stores more than
on ton of such batteries at anyone location for more than 180 days; or
the person stores one ton or less of such batteries at any one 'location for more
than one year."
"The owner or operator shall store spent lead-acid batteries in accordance with the
packaging requirements of Title 49 Section 173.260 and shall label the packaged
batteries with the date they were received. The labeling shall be written in ink,
paint, or other weather resistant material such that the date is legible and
conspicuous. "
''A damaged battery shall be managed and transported so as to minimize the
release of acid and lead and to protect the handlers and the environment,
including at a minimum the battery be stored and transported in a nonreactive,
structurally secure, closed container capable of preventing the release of acid and
lead. A container holding one or more damaged batteries shall be labeled with
the date that the first battery in the container was placed there, the initial date of
accumulation. A container holding one or more damaged batteries shall be
written in ink, paint, or other weather resistant material so that the date is legible
and conspicuous.
It was determined during the inspection that used batteries were not stored in
accordance with the above requirements.

. CORRECTION REQUIRED
Upon receipt of this letter, the facility owners or operator must correct all deficiencies noted
in this Notice within thirty (30) days, and submit to the Department written documentation
that all violations as noted below have been corrected.
1. All hazardous waste containers must be labeled with appropriate labels. The
labels must be correctly marked for the particular types of waste contained
therein. This would include, but not be limited to, waste oils, waste
antifreeze, and waste batteries.
2. All waste streams must be characterized for hazardous waste constituents as
per California Code of Regulations, Section 66262.11.
3. All hazardous waste containers must be closed during transport and storage,
except when it is necessary to add or remove waste.
4. A documented inspection program must be implemented for the hazardous
waste storage areas.
5. Please submit a detailed work plan for characterization of contaminated soil
at the site. The work plan must include a site safety plan, sampling protocol,
and proposed disposal plans for the contaminated soil. The work plan must
be submitted for review by this office within thirty (30) days of receipt of this
letter. After review and approval of the work plan, implementation must be
initiated within fourteen days.
The issuance of this notice does not preclude the Department from taking administrative,
civil or criminal aëtion as a result of the violations noted herein.
