A description of the project is enclosed. Please review this proposal and be prepared to share any concerns and solutions regarding this project. The site is located at 1500 South Union A venue, about three buildings south of Casa Lorna Drive on the east side of the street. While the site is within the city limits, this portion of Union Avenue is within the county's jurisdiction. I am trying to get a representative from County Roads to join us. The site was formerly ARB, Inc. The client has heard about how customer service-oriented we are. Company Background: Southwest Contractors (SWC) is a construction company specializing in the installation of underground pipelines, primarily used for transportation of petroleum products. In addition, SWC performs Facilities construction services and Project and Operations management services. Kern Manufacturing Services, a division of SWC offers quality manufacturing of pressure vessels, columns, fabricated piping systems, process skids and similar services. The Paving division of SWC offers paving services to local contractors and individuals. I have enclosed brochures for your review. Planned Project: SWC is purchasing an approximate 14 acre facility at 1500 South Union Ave. This is located in the Enterprise Zone and the Incentive Area. The purchase price of the facility is between $700,000 and $800,000, which is still being negotiated. The current facility includes one,office building, one warehouse facility with offices, one mechanical shop anp one small fabrication shop. As part of the purchase, a new 15,000 sq. ft. fabrication facility is being constructed at a cost of apx. $500,000. I have enclosed a preliminary site plan along with this letter. 3600 Bowman Court. These are: 1) Requirement to have fire sprinkler system in the new fabrication shop. We believe this is a requirement which should be waived by the Fire Department. There is no storage of flammable materials in the facility. If the sprinklers are set off by accident, it could lead to serious injury, or death, of workers in the building due to the large amount of high voltage electrical equipment in the shop. This is a welding shop. We do not agree that the potential benefit of the sprinklers outweighs the potential detriments. 2) Fuel Storage requirements seem to be changing every time we talk to someone. We need to be able to work out a definitive plan for our fuels storage facilities. 3) We will be locating a heat treating furnace at the facility. Currently this furnace is owned by ARB and operated on District Blvd. We need help in obtaining the proper permits with the AQMD, etc. 4) To enter the facility from southbound Union Ave. there is not a full left turn lane, only a designated opening in the median. We need assistance in determining if a left turn lane can be added so our vehicles can safely enter the facility. In addition to the items discussed above, we understand that some financial assistance is available. WHAT BUSINESSES MUST COMPLY If you handle, use, store or dispose of Hazardous Substances at any time during the year in excess of the minimum reporting quantities you must submit a Plan. Typical everyday Hazardous Materials you may find in your facility may include, but are not limited to: compressed gasses; fuels - all types including propane; solvents - most solvents would be Hazardous Materials; oils new and waste; thinners; caustic or corrosive materials; poisonous or toxic materials, and radioactive materials. Minimum State Reporting quantities for all hazardous materials are: 55 gallons for liquids 500 pounds for solids 200 cubic feet (at standard temperature and pressure, for gasses) For all acutely Hazardous Materials the minimum reporting quantities are found on the list of Extremely Hazardous Substances on the current EPA List (Vol 52 No 77 of the Federal Register.) This list is available at the Hazardous Materials Division of the Bakersfield Fire Department, 1715 Chester Ave., Bakersfield, Ca. 93301. Hazardous Materials which are stored in transit or temporarily maintained in a fixed facility for less than (30) thirty days during the course of transportation are exempt from the inventory requirements of the law. -- NOTE -- (Hazardous Materials contained solely in a consumer product for direct distribution to"and use by, the gelÍeral public are NOT exempt from the reporting requirements of the law per this Administering Agency.) HOW DO BUSINESSES COMPLY Businesses that are required to comply with requirements of Chapter 6.95 Of California Health and Safety Code must submit a Plan. This Business Plan consists of: 1) Emergency Response Plans and Procedures. 2) Inventory of Hazardous Materials. 3) Training Program for Employees. The forms for completing the Hazardous Materials Management Plan are attached to this letter. By correctly filling this Business Plan in you satisfy both the Federal Requirements (Tier I and Tier II Inventory Requirements of SARA Title III) as well as the California Requirements of Chapter 6.95 of the California Health and Safety Code. Business owners are urged to read and become familiar with Chapter 6.95 of the California Health and Safety Code. Employees are required bv state law to have a proqram which provides employees with initial and refresher traininq in the followinq areas: 1) Methods for safe handling of the hazardous materials used by your business. 2) The Cal OSHA Hazard Communication Standard. 3) Correct use or em~rgency response equipment and supplies available at your business. 4) The prevention, minimizing and clean up procedures you have developed for your business, 5) The emergency evacuation plans you have developed, as well as, your notification procedure and medical plan. 6) Procedure to coordinate with and assist the local emergency personnel that may respond to your business. 7) Who and how to call for immediate assistance in the event of an accident involving hazardous materials. 1 ¡. e e HAZARDOUS MATERIALS MANAGEMENT PLAN Section 4 - Exemption Reauest: I f you feel you are exempt from the Hazardous Materials reporting requirements of Chapter 6.95 of the California Health and Safety Code, check the appropriate box. Section 5 - Certification: Sign, date and return before the due date to avoid further action. Section 6 - Notification and Evacuation Procedures: A) Agency Notification Procedures: What agencies and or corporate officials are notified in case of a hazardous materials spill or emergency -- What procedures are used to notify these parties. B) Employee Notification and Evacuation: How are your employees notified in case of a hazardous materials emergency. What evacuation procedures exist for the orderly and safe evacuation and accounting of all employees in case of an emergency requiring evacuation. C) Public Evacuation: What, if any, contingency plans do you have for the evacuation of surrounding public, in case of a hazardous materials emergency at your facility, D) Emergency Medical Plan: Summarize your plan for handling medical emergencies occurring at your business. List the local medical facili ty capable of handling an accident involving a hazardous materials exposure involving Hazardous Materials used at your business, Section Î - Mitiqation, Prevention and Abatement Plan: A) Release Prevention Steps: Explain the procedures that you have developed and implemented to help prevent an incident from occurring, These steps could include, but are not limited to, storage methods, container types, segregation, safety equipment, and/or procedures used. B) Release Containment and/or Minimization: Explain the procedures that you have developed and implemented to assist in keeping a hazardous materials incident at your business as small or confined as possible. 2 î e e HAZARDOUS MATERIALS MANAGEMENT PLAN C) Clean-up Procedures: Explain what clean up procedures will be implemented in case of a release at your business. This should address small spills, as well as a major release of material once the material is contained. Give a brief description of the nature your business activities, Enter the Standard Industrial Classification (SIC) number for your business, Each type of business has a Standard Industrial Classification code number. Some common SIC codes are listed on page 4. Other SIC codes may be obtained from your worker's compensation insurance forms, the State of California Employment Development Department by giving them your employer number, from the U,S, Labor Department or from the Standard Industrial Classification Manual, Enter the Dun & Bradstreet or federal tax identification number for your business, Enter the name of the owner, their mailing address and phone number, EMERGENCY CONTACTS: Ust two persons who have full access to the facility, including locked areas, and that are knowledgeable about your materials and process. CHEMICAL DESCRIPTION: Make as many copies of the chemical description form as necessary to report your entire inventory of hazardous materials. Report every hazardous material handled in quantities equal to or exceeding 55 gallons of a liquid, 500 pounds of a solid or 200 cubic feet of a gas. Enter the full legal name and site location of your business at the top of the form, Enter the page number in the right hand corner. Each of the instructions below correspond to the entry field with the same number on the chemical description form. -. e e 1, Check the appropriate box for a new inventory or for additions, revisions or deletions to an existing inventory, Check nontrade secret unless the chemical composition meets the criteria for trade secret status per Section 6254.7 of the California Government Code and Section 1 060 of the California Code of Evidence. Copy trade secret pages onto yellow paper before submitting your inventory'so that they will be easily identified, 2, Enter the common name or the manufacture's product name. Enter the standard chemical name. If a pure material is an acutely hazardous material (AHM), check the box labeled AHM. Report the components of mixtures under item 9 betow. 3. Enter the Dept. of Transportation (DOT) identification number and the Chemical Abstract Service (CAS) number for this chemical. CAS numbers are commonty found on Material Safety Data Sheets, 4. The Uniform Building Code Section 904.4, and the Uniform Fire Code Section 1003.4 provide that fire sprinkler systems may be omitted under certain specific guidelines. Both sections contain the following pertinent language: Permissible Sprinkler Omissions. Subject to the approval of the building official and with the concurrence of the Chief of the Fire Department, sprinklers may be omitted in rooms or areas as follows: 1. The existing Southwest Contractors tanks do not meet these requirements and are not acceptable for this purpose. Section 2.7.2. 5,5 Overfill Prevention, Protected aboveground tanks shall not be filled in excess of 90 percent of their capacity. An overfill prevention system shall be provided for each tank. During tank filling operation, the system shall: I. Provide an independent means of notifying the person filling the tank that the fluid level has reached 85 percent of tank capacity by providing an audible or visual alann signal. providing a tank level gage marked at 85 percent of tank capacity. or other approved means. and 2. Automatically shut off the flow of fuel to the tank when the quantity of liquid in the tank reach- es 90 percent of tank eapacity. For rigid hose fuel-delivery systems. an approved means shall be provided to empty the fill hose into the tank after the automatic shutoff device is activated. The filling procedure shall require the person filling the tank to deter- mine the gallonage required to fill it to 90 percent of capacity before commencing the fill operation, 5,6 Fill Pipe Connections, The fill pipe shall be provided with a means for making a direct con- nection to the tank vehicle's fuel-delivery hose so that the delivery of fuel is not exposed to the open air during the filling operation, When any portion of the fill pipe exterior to the tank extends below the level of the top of the tank. a check valve shall be installed in the fill pipe not more than 12 inches (304.8 mm) from the fill hose connection. See Section 7901.11.4 for tank valves. 5,7 Spill Containers, A spill container having a capacity of not less than 5 gallons ( 18.9 L) shall be provided for each fill connection, For tanks with a top fill connection. spill containers shall be noncombustible and shall be fixed to the tank and equipped with a manual drain valve which drains into the primary tank, For tanks with a remote fill connection. a portable spill container shall be provided. 5,8 Signs, Warning signs and identification signs shall be installed to clearly identify hazards. The design of such signs shall be in accordance with Sections 5201.8 and 7901.9. Conspicuous signs prohibiting simultaneous tank filling and fuel dispensing shall be posted, SECTION 6 - INSTALLATION OF DISPENSING AND PIPING SYSTEMS 6,1 General. Dispensing and piping systems and electrical controls shall be installed in accord- ance with Section 7901.11 and Article 52. except as provided in Appendix Sections 6,2. 6.3 and 6.4. 6,2 Tank Openings, Tank openings in protected aboveground tanks shall be through the top only. 6,3 Dispensing Devices, Dispensing devices are allowed to be installed on top of or immediately adjacent to protected aboveground tanks. 6,4 Antisiphon Devices, Approved anti siphon devices shall be installed in each external pipe connected to the tank when the pipe extends below the level of the top of the tank, SECTION 7 - PARKING OF TANK VEHICLES Tank vehicles shall not be parked within 25 feet (7620 mm) of a protected aboveground tank. EXCEPTION: When the tank is being filled from the tank vehicle. SECTION 8 - MAINTENANCE Protected aboveground tanks. piping and dispensing systems shall be maintained in a safe operating condition, Protected aboveground tanks and components of dispensing systems shall be maintained in accordance with their listings.
