HomeMy WebLinkAboutRES NO 309-04 309-04 RESOLUTION NO. A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING AN AMENDED CONFLICT OF INTEREST CODE FOR THE CITY OF BAKERSFIELD DEPARTMENTS. WHEREAS, California Government Code section 87300 requires each governmental agency to update and amend its Conflict of Interest Code when positions are created, deleted or modified so as to bring them within the positions designated by the Political Reform Act; and WHEREAS, the Council is the Code reviewing body for said City Departments; and WHEREAS, the proposed amendments have been reviewed and considered by said Departments of the City of Bakersfield, NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as follows: 1. That the proposed Conflict of Interest Code attached hereto as Exhibit "A" is approved for adoption by the respective Departments of the City of Bakersfield; and 2. Chairperson 4 Vice Chairperson 4 Secretary 4 Treasurer 4 All Departments, Commissions, and Committees Consultant 1 Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in the Code subject to the following limitation: The City Manager may determine in writing that a particular consultant, although a "designated position," is hired to perform a range of duties that is limited in scope and thus is not raquirad to fully comply with the disclosure requirements in this section. Such written determination shall include a description of the consultant's duties based upon that description, and a statement of the extent of disclosure requirement. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code. EXHIBIT "A" ORIGINAL APPENDIX OF DISCLOSURE CATEGORIES Persons in the following categories must disclose as follows: Category Disclosure All investments and business positions in business entities, sources of income, loans and gifts, and all interests in real property within two miles of the boundaries of the City of Bakersfield, and all interests in real property within two miles of any land owned or used by the City of Bakersfield. Investments and business positions in business entities and sources of income which provide services, supplies, materials, machinery or equipment of the type utilized by the City of Bakersfield, and all loans and gifts from such entities. All investments and business positions in business entities, sources of income, loans and gifts, and all interests in real property within two miles of the redevelopment project area. All investments and business positions in business entities, and sources of income which provide services, supplies, materials, machinery or equipment of the type utilized by the Public Financing Authority, all loans and gifts from such entities, and all interests in real property within two miles of land owned or used by the Public Financing Authority.
