HomeMy WebLinkAboutRES NO 93-00RESOLUTION NO.._ 9 3 '" 0 0 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD APPROVING THE AMENr)ED CONFLICT OF INTEREST CODES FOR THE CITY OF BAKERSFIELD DEPARTMENTS, BOARDS, COMMISSIONS, AND COMMITTEES. WHEREAS, the Political Reform Act requires each governmental agency to review its Conflict of Interest Code biennially to determine accuracy or the need to amend; and WHEREAS, the Council is the Code reviewing body for said Departments, Boards, Commissions, and Committees; and WHEREAS, the proposed amendments have been reviewed and considered by said Departments, Boards, Commissions, and Committees of the City of Bakersfield. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as follows: 1. That the proposed Cor~flict of Interest Codes attached hereto as Exhibit "A" are approved for adoption by the respective Departments, Boards, Commissions, and Committees of 'the City of Bakersfield; 2. That all designated employees as provided in the attached Conflict of Interest Codes in Exhibit "A" are hereby instructed to file Statements of Economic Interest according to the terms of 2 California Code of Regulations Section 18730; and 3. Chairperson 1 Vice Chairperson 1 Secretary 1 Treasurer 1 Redevelol0ment of Project Area Committee Member 3 All Departments, Commissions, and Committees Consultant Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in the Cede subject to the following limitation: The City Manager may determine in writing that a particular consultant, although a "designated position," is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with the disclosure requirements in this section. Such written determination shall include a description ofthe consultant's duties t~ased upon that description, and a statement of the extent of disclosure requirement. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this conflict of interest code. EXHIBIT "A" CONFLICT OF INTEREST CODES APPENDIX OF DESIGNATED POSITIONS PAGE 7 APPIENDIX OF DISCLOSURE CATEGORIES Persons in the following categories must disclose as follows: All investments and business positions in business entities, sources of income, loans and gifts, and all interests in real property within two miles of the boundaries of the City of Bakersfield, and all interests in real property within two miles of any land owned or used by the City of Bakersfield. Investments and business positions in business entities and sources of income which provide services, supplies, materials, machinery or equipment of the type utilized by the City of Bakersfield, and all loans and gifts from such entities. All investments and business positions in business entities, sources of income, loans and gifts, and all interests in real property within two miles of the redevelopmerit project area. All investments and business positions in business entities, and sources of income which provide services, supplies, materials, machinery or equipment of the type utilized by the Public Financing Authority, all loans and gifts from such entities, and all interests in real property within two miles of land owned or used by the Public Financing Authority.
