Winston Tire's Safety Training Program will encompass the safe handling and disposal of all hazardous materials. Winston Tire's çompany Policy is to provide the necessary equipment to properly handle hazardous materials. This facility is already equipped with the proper storage vessels for receiving hazardous materials, The Management Staff will have the responsibility of choosing reliable and safe hazardous waste haulers and ensure the proper reporting to Government Officials. INTERNAL AUDITS. Management is responsible to keep on file all hazardous waste manifests as required by Company Policy and Law. Managers are to inspect on a daily basis, the integrity of waste storage vessels. This inspection is to be recorded properly and filed. The Management Staff is responsible for accumulating these records and producing the required reports for Government Agencies. Further, through the use of management and staff and consultants, to audit the stores periodically to ensure compliance. HAZARDOUS WASTE DESTINATION FACIUTY AUDIT. As required by Law and Company Policy, the Management Staff is responsible to visit the destination site of all hazardous materials. Further, to collect relevant information regarding the financial stability of said hazardous waste site. It is this ~'s policy to request indemnification of the hazardous waste disposal facility and the hazardous waste hauler. The Management Staff will be responsible to ensure this occurs. In addition, the annual inspection will occur according to Law and a re-evaluation of this firms hazardous waste destination facilities will occur at that time. -8- e e VENDORSITRANSPORTERS It is this finn's policy to engage transporters of hazardous liquids' and vendors of new hazatdous liquids only after they have proven to the responsible Department Manager, that they have the capacity to clean up any spills they may cause while on our premises. Specifically, they must have on their vehicles, adequate booms and absorbent material to clean up minor spills. They must also be prepared to contact a vacuum service or other finn that can clean up any major spill they cause. Further, their liability insurance must cover the cost of any clean up and remediation stemming from a spill they cause while on our premises. The transporter of hazardous waste must have a valid EPA number, valid State Driver's Ucense and both Vehicle and Uability Insurance. No hazardous materials are to leave the premises without a completely filled in Manifest per State/Federal Law. CLEAN UP MATERIALS This finn will have on the premises adequate clean up materials to ensure that any potential spills do not leave the property, going into the sewer, stonn drain or street. The applicable Manager listed in the Hazardous Communication Program, will be responsible for accumulating these clean up materials and having them available to all employees for immediate use. Addendum "A" to this document will list the required clean up materials and their quantities. If these materials are used, they should be replaced immediately. PROPERTY SURVEY Each Deparnnent Manager whose department utilizes hazardous liquids, is responsible to this finn to ensure that they are completely aware of the direction liquids may flow if they leak. For example, if the new oil storage tank leaks, you must know in which direction the liquid is likely to travel. Discuss this with all employees working around new oil tanks and ensure that they understand how to control the potential leaks by knowing in which direction the liquid may flow. e e SPILL CONTAINMENT EQUIPMENT Attached to this document is an addendum containing a list of euipment which will be utiliièd for spill mitigation. These items will include booms and absorbent pads to prevent material from entering the environment. Ensure that employees use gloves where required e.g. solvent, carburetor cleaner. In the event we are required to use non-recycleable abosorbent materials e.g. kitty litter, make sure that this material is used sparingly since it must be transported to a hazardous materials storage facility. All employees should understand how the absorbent material works and how to use the absorbents sparingly. Employees should avoid using rags and other items as absorbents unless absolutely necessary. SPILLED MATERIAL If the spills are very small, the absorbent material' can be rung out· into the appropriate waste container and the job will be complete. If the spill is large, and the amount of absorbed material cannot be placed in the waste containers, then the responsible Manager must contact the Vacuum Service to remove the spilled material. If the vacuum service cannot remove the solid material e.g. kitty litter, then contact the Hazardous Waste Management Transporter to remove the material. It is important that we receive the appropriate Hazardous Waste Manifest for any material being transported off the . prenuses. MEDICAL EMERGENCY In the event an individual is injured from a release of this hazardous material (unlikely from the material itself), they should be taken to the Emergency Room indicated in the Business Emergency Plan.. All employees have been trained as to the . location of the Emergency Clinic. In the event of a serious injury, the responsible Manager or Employees should dial 911 and contact Emergency Services. Follow the procedures that were outlined in the Safety and Hazardous Materials Training Program with regard to First Aid. e - DRAINS/SUMPS/SEW ERS If the spilled material may travel toward drains, sewer, street or ~ any way leave the premises into the environment, immediate action should be taken to block that direction of flow. As stated in the Prevention Program, the responsible Manager must ensure that they are aware of the contour of the property and understand in which direction liquid would flow should a spill occur. If a spill of hazardous materials is heading in the direction of a drain, then the drain should be sealed off immediately. If the spilled material is on its way down a driveway out to the street, the responsible employee should line åbsorbent material ahead of the stream to ensure that it does not go into the street. SOIL It is absolutely imperative that hazardous liquids do not leave paved area and travel intå soil. If hazardous liquids enter an area of soil, remediation expense could be very high. The first area of concern when a spill occurs is to make sure that the liquid does not enter an area of soil. TIùs also includes large potholes in the pavement where the soil is exposed. The first area to be concerned with is soil, then sewers then the streets. The object is to contain the hazardous spill on a pavement area where clean up is easy and contamination is not an issue. If hazardous materials do spill over onto soil, the firm's Senior Management must be notified immediately. Remediation may be required. TRAINING All employees must· be trained· in affective methods of containing spills. Each employee should be aware of the types of absorbent materials available and their location. Employees must be shown possible exit routes that hazardous liquids may take and they must be told about the priorities e.g. soil, drains, etc. SUMMARY The Emergency Response and Clean Up Plan has explained what to do in the event of a spill. Who to notify and the fact that all individuals must be trained in the proper response techniques. e e SUMMARY To restate, it is this firm's policy to ensure that all employees are responsible to reduce the amount of waste generated on a daily basis. Through training and advisement from the Management Staff, employees are to continually advise Management of potential methods to reduce waste. It is this firm's policy to ensure that employees safely handle all hazardous materials and know exactly how to use them to reduce waste and health hazards. The proper containment devices and protective materials are supplied to each store for use by personnel to ensure the quality of health and to limit the amount of waste that can enter the environment. It is this firm's policy to ensure that all waste products are considered potential recycle able materials. At present, this firm. recycles tires, batteries, antifreeze and waste oil. Each of these products is sent to a destination which will either result in a new product being created or reuse of the same product. Through the use of solvent and rag services, these products are also recycled. By reducing the amount of waste from individual chemical containers, grease and motor oil we can reduce the amount of waste we actually create. By paying attention to the proper capacity of crankcase, radiator etc., we can further reduce the amount of waste. Finally,all employees are encouraged on a routine basis to submit to their supervisors, suggestions that can reduce waste. The Management Staff is continually working on ways to reduce the toxicity of materials used in the workplace and yet continue to provide products which are cost efficient and effective. This plan was developed by EnviroCom Consultants and approved by Winston Tire's Management on March 13, 1991. This plan is to be reviewed continuously during the year and revised by March 13, 1991. A copy of this plan will be disseminated to all Managers for review with employees at the first safety meeting following receipt of this document. Managers are to indicate the names of employees present at the meeting when the contents of this document were discussed, the names of these employees and the date of the meeting are to be recorded on the following page. -9- e e MAJOR SPILLS If thðo hazardous material has leaked into the outside environment, and it is necessary to contact the Local Administering Agency, the following procedures should be implemented. A. Use the Emergency Notification Fonn located in the Hazardous Materials Business Plan or in the back of this plan. B. Indicate the time you called the Local Administering Agency and who you spoke with. c. Take any notes about your conversation or any comments they make to you. D. Log the time the Emergency Response vehicles arrived. This is very important. E. Log the time the Emergency Response vehicles leave, particularly the Hazmat Team. F. If the spill is large, and cannot be cleaned up by our personnel, immediately contact the Vacuum Service just after you call the Administering Agency. G. Do your best with our emj>loyees and the vacuum service to clean up this spill. AVOID USING HAZMAT PERSONNEL TO CLEAN UP. H. It is important that the Hazmat Team leave the premises as quickly as possible, they charge by the minute. Do not detain the Hazrnat personnel for any reason. You can call them later if you have further questions or visit their office. I. Cooperate fully with the Authorities in the clean up and by providing necessary information about how the spill occurred. J. Ensure that you have completed the Emergency Response Form properly and provide a copy to the Business Manager. K. Any time an outside agency has been contacted for a spill, take photographs of the area and all relevant items which may help us reduce our exposure. e e MATERIAL SAFElY DATA SHEETS (MSDS) Responsible Individual:Store Manager , \ Material safety data sheets have been collected for all hazardous chemicals at our facility. A copy of the MSDS's is available in the Service Manager's office. All MSDS's are reviewed for accuracy and completeness. We have stated in writing to our suppliers the need to supply MSDS sheets initially and any time the manufacturer's formulas are changed. Individuals with purchasing authority are responsible to ensure that MSDS sheets are ordered and on file before the invoice is paid. Individuals responsible for receiving MSDS sheets will notify the MSDS sheets Coordinator listed above if employees must be retrained due to the receipt of hazardous material. lABELING PROGRAM Responsible Individual: Store Manager A11labels provided by our suppliers are retained on containers as they are received. Labels are checked to verify that they contain the identity of the hazardous chemical, the appropriate hazard warnings, the name and address of the manufacturer, importer or other responsible party. The product identity showed on the label is checked against our hazardous chemical inventory and the appropriate MSDS to determine if an MSDS is available and that the product label and the MSDS m~tch; The supplier is contacted at any time when a discrepancy exists. . The responsible individual as stated above ensures that all labels are legible, in English and prominently displayed on all containers of hazardous chemicals in this facility. This responsible individual above, ensures that all hazardous chemicals are properly labeled, marked or tagged when received. If any labels are missing, damaged or incorrect, this individual will contact the supplier to obtain appropriate labeling. e e ,¡ TRAINING ON NON-ROUTINE HAZARDOUS TASKS Responsible Individual: Store Manager EmplQyees assigned to hazardous or potentially hazardous non- routine tasks are given special training regarding proper procedures, personal protective equipment, labeling, MSDS's etc. This has been done to ensure that adequate protective measures have been taken prior to starting work. EXCHANGING HAZARDOUS INFORMATION WITH OUTSIDE CONTRACfORS . Responsible individual: Store Manager When this firm engages outside contractors for temporary work in this facility, the contractor receives information about the location of the MSDS's and and overview of hazardous materials used in this facility. A written copy of the Hazard Communication Program is also made available to the outside contractor. Any contractor utilized in this facility must present to the above named individual, infonnation regarding hazardous materials they intend to use in this facility. The purpose of this notification is to avoid reactivity from mixtures of chemicals. VIOLATION OF UFC 80.106 Personnel Training and Written Procedures. Persons responsible for the operation of areas in which hazardous materials are stored, dispensed, handled or used shall be familiar with 'the chemical nature of the materials and the appropriate mitigating actions necessary in the event of fire, leak or spill. Responsible persons shall be designated and trained to be liaison personnel for the fire department. These persons shall aid the fire department in preplanning emergency responses and identification of the locations where hazardous materials are located and shall have access to Material Safety Data Sheets and be knowledgeable in the site emergency response procedures. 2) Material Safety Data Sheets (MSDS) were not available. VIOLATION OF UFC 80.104 (d) Material Safety Data Sheets (MSDS) shall be readily available .on the premises for hazardous materials regulated by this article. 3) Several Hazardous Materials were Present in reportable quantities but were not included in your chemical inventory. · ~ \ e e VIOLATION OF CH. 6.96 CALIFORNIA HEALTH & SAFETY CODE 25509(a)(1-4) (a)The annual inventory form shall include, but shall not be limited to, information on all of the following which are handled in quantities equal to or greater than the quantities specified in subdivision (a) of Section 25503.5: . (1) A listing of the chemical name and common names of every hazardous substance or chemical product handled by the business. (2) The category of waste, including the general chemical and'mineral composition of the waste listed by probable maximum and minimum concentrations, of every hazardous waste handled by the business. (3) A listing of the chemical name and common names of every other hazardous material or mixture containing a hazardous material handled by the business which is not otherwise listed pursuant to paragraph (1) or (2). . (4) The maximum amount of each hazardous material or mixture containing a hazardous material disclosed in paragraphs (1), (2), and (3) which is handled at anyone time by the business over the course of the yea~. 4) Waste oil containers were not properly labeled. VIOLATION OF OSHA 1910.1200 (1) The chemical manufacturer, importer, or distributor shall ensure that each container of hazardous chemicals leaving the workplace is labeled, tagged or marked with the following information: (i) Identity of the hazardous chemical(s). (5) The employer may use signs, placards, process sheets, batch tickets, operating procedures, or other such written materials in lieu of affixing labels to individual stationary process containers, as long as the alternative method 'identifies the containers to which it is applicable and conveys the information required by paragràph (2) of this section to be on label. The written materials shall be readily accessible to the employees in their work area throughout each work shift. (7) The employer shall not remove of deface existing labels on incoming containers of hazardous chemicals, unless the container is immediately marked with the required information. In addition, such a generator is exempt from all the requirements in SubpartsG and H of 40 CFR Part 265, except for 265.11 and 265.114. (2) The date upon which each period of accumulation begins is clearly marked and visible for inspection on each container. (3) While being accumulated on-site, each container and tank is labeled or marked clearly with the words, "Hazardous Waste", and (4) The generator complies with the requirements for owners or operators in Subparts C and D in 40 CFR Part 265 and with 265.16. (b) A generator wh9 accumulates hazardous waste for more than 90 days is an operator of a storage facility and is subject to the requirements of 40 CFR Parts 264 and 265 and the permit requirements of 40 CFR Part 270 unless he has been granted an extension to the 90.day period. VIOLATION OF UFC 80.106 Personnel Training and Written Procedures. Persons responsible for the operation of areas in which hazardous materials are stored, dispensed, handled or used shall be familiar with the chemical nature of the materials and the appropriate mitigating actions necessary in the. event of fire, leak or spill. Responsible persons shall be designated and trained to be liaison personnel for the fire department. These persons shall aid the fire department in preplanning emergency responses and identification of the locations where hazardous materials are located and shall have access to Material Safety Data Sheets and be knowledgeable in the site emergency response procedures. 2) Material'safety Data Sheets (MSDS) were not available. VIOLATION OFUFC 80.104 (d) Material Safety Data Sheets (MSDS) shall be readily available on the premises for hazardous materials regulated by this article. 3) Several Hazardous Materials were Present in reportable quantities but were not included in your chemical inventory. "" e -~- ~ ---- - VIOLATION OF CH. 6.96 CALIFORNIA HEALTH & SAFETY CODE 25509(a)(1-4) (a)The annual inventory form shall include, but shall not be limited to, information on all of the following which are handled in quantities equal to or greater than the quantities specified in subdivision (a) of Section 25503.5: (1) A listing of the chemical name and common names of every hazardous substance or chemical product handled by the business. (2) The category of waste, including the general chemical and mineral composition of the waste listed by probable maximum and minimum concentrations, of every hazardous waste handled by the business. (3) A listing of the chemical name and common names of every other hazardous material or mixture containing a hazardous material handled by the business which is not otherwise listed pursuant to paragraph (1) or (2). (4) The maximum amount of each hazardous material or mixture containing a hazardous material disclosed in paragraphs (1), (2), and (3) which is handled at anyone time by the business over the course of the year. 4) Waste oil containers were not properly labeled. VIOLATION OF OSHA 1910.1200 (1) The chemical manufacturer, importer, or distributor shall ensure that each container of hazardous chemicals leaving the workplace is labeled, tagged or marked with the following information: (i) Identity of the hazardous chemical(s). (ii)Appropriate hazard warnings; and (iii)Name and address of the chemical manufacturer, import,er, or other responsible party. ,; e . _ _____u_·~ "__ -- --- ----- (4) Except as provided in paragraphs (3) and (4) the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged, or marked with the following information: (i) Identity of the hazardous chemical(s) contained therein; and (ii)Appropriate hazard warnings. (5) The employer may use signs, placards, process sheets, batch tickets, operating procedurès, or other such written materials in lieu of affixing labels to individual stationary process containers, as long as the alternative method identifies the containers to which it is applicable and conveys the information required by paragràph (2) of this section to be on label. The written materials shall be readily accessible to the employees in their work area throughout each work shift. I . (7) The employer shall not remove of deface existing labels on incoming containers of hazardous chemicals, unless the container is immediately marked with the required information. (8) The employer shall ensure that labels or other forms of warnings are legible, in English, and prominently displayed on the container, or readily available in the work area throughout each work shift. Employers having employees who speak other languages may add the information in their language to the material presented, as long as the information is presented in English as well. 5) Empty containers not properly closed. VIOLATION OF UFC 79.201 (c) Empty Containers. The storage of empty tanks and containers previously used for the storage of flammable or combustible liquids, unless free from explosive vapors, shall be as specified for the storage of flammable liquids. Tanks and containers when emptied shall have the covers or plugs immediately replaced in openings. 6) Hazardous Waste (used motor oil) on site for more than 90 days "~' .' ~... e ___ ._ _n__. - VIOLATION OF 40 CODE OF FEDERAL REGULATIONS SUB PART C, PART 262.34, Accumulation time Except as provided in paragraphs (d), (e), and (f) of this section, a generator may accumulated hazardous waste on-site for 90 days or less without a permit or without having interim status, provided that: (1) The waste is placed in containers and the generator complies with Subpart I of 40 CFR Part 265, or the waste is placed in tanks and the generator complies with Subpart J of 40 CFR Part 265, except 265.197(c) and 265.200. In addition, such a generator is exempt from all the requirements in Subparts G and H of 40 CFR Part 265, except for 265.11 and 265.114. (2) The date upon which each period of accumulation begins is clearly marked and visible for inspection on each ·container. (3) While being accumulated on-site, each container and tank is labeled or marked clearly with the words, "Hazardous Waste", and . (4) The generator complies with the requirements for owners or operators in Subparts C and D in 40 CFR Part 265 and with 265.16. (b) A generator who accumulates hazardous waste for more than 90 days is an operator of a storage facility and is subject to the requirements of 40 CFR Parts 264 and 265 and the permit requirements of 40 CFR Part 270 unless he has been granted an extension to the 90 day period. Such extension may be granted by EPA is hazardous wastes must remain on-site for longer than 90 days due to unforeseen, temporary, and uncontrollable circumstances. an extension of up to 30 days may be granted at the discretion of the Regional Administrator on a case-by- case basis.
