A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS THAT NO MAJORITY
WRITTEN PROTEST HAS BEEN FILED AND ORDERING
THE TERRITORY DESIGNATED AS PROCEEDING NO. 979,
ANNEXATION NO. 327 (BRUNDAGE LANE NO. 3),
ANNEXED TO THE CITY OF BAKERSFIELD. (WARD 5)
WHEREAS, Resolution of Application No. 159-88, dated
July 27, 1988 was submitted to the Local Agency Formation
Commission of Kern County ("Commission") for the annexation of
territory to the City of Bakersfield designated as Proceeding No.
979, Annexation No. 327 (Brundage Lane No. 3); and
WHEREAS, a duly noticed public hearing upon
posal was held before the Commission on November 22,
continued to December 13, 1988; and
said pro-

WHEREAS, following said public hearing the Commission,
on December 13, 1988, adopted its Resolution Making Determin-
ation, being Resolution No. 88-42, recorded in Minute Book 35 of
said Commission; and
WHEREAS, c.n January 13, 1989, the City Clerk of the City
of Bakersfield set WEDNESDAY, FEBRUARY 1, 1989, at the hour of
7:00 P.M. (or as soon thereafter as the matter may be heard) in
the Council Chambers of the City Hall, 1501 Truxtun Avenue,
Bakersfield, California, as the time, date and place of hearing
on the proposed annexation and the owners of land within the said
territory were duly informed of their right to file written pro-
tests against the annexation with the City Clerk at any time prior
to the conclusion of the hearing on the proposed annexation; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. In accordance with Sections 57075 and 57078 of the
Government Code, it is hereby found that written protests, if any,
filed and not withdrawn prior to the conclusion of the hearing
represent landowners owning less than 50 percent of the assessed
value of the land within the territory to be annexed.
2. The description of the exterior boundaries of the
territory annexed is contained in Exhibit "A" and shown on the map
marked Exhibit "B", both are attached hereto and incorporated in
this Resolution as though fully set forth herein.
3. That the said territory designated as Proceeding No.
979, Annexation No. 327 (Brundage Lane No. 3), and described herein,
and every part thereof, is hereby ordered annexed to the City of
Bakersfield.
4. That the Clerk shall forthwith transmit a certified
copy of this resolution ordering a change of organization, along
with any required remittance to cover the fees required by
Section 54902.5 of the Government Code, to the Executive Officer
of the Local Agency Formation Commission of Kern County.
5. That the Executive Officer of the Commission is
hereby requested to prepare and execute a certificate of comple-
tion and make the filings required by Part 4, Chapter 8 of the
Cortese-Knox Local Government Organization Act of 1985 and record
a certified copy of the certification of completion with the
recorder of Kern County, with the surveyor of Kern County and
with the Clerk of the City of Bakersfield.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on February 1, 1989 , by

ANNEXATION NO. 327
(BRUNDAGE NO. 3)
A parcel of land situated in the County of Kern, State of California, being a
portion of Sections 1 and 2 of T. 30 S., R. 27 E. and Sections 35 and 36 of
T. 29 S., R. 27 E., M.D.B. & M., more particularly described as follows:
Beginning at a point on the center line of Terrace Way (Co. Rd. No.
3081) bearing South 89°24'19 East, 237.85 feet from the intersection
of the Westerly prolongation of said center line with the West line of
said Section 1; said point also being on the existing Corporate
Boundary of the City of Bakersfield;
THENCE (i) Southerly along a 900 foot radius curve, concave Westerly,
through a central angle of 1°55'36" an arc distance of 30.27 feet to
the point of intersection of the South line of said Terrace Way with
the East right of way line of Wible Road;
THENCE (2) continuing Southerly along said East right of way curve
through a central angle of 2°16'57" an arc distance of 35.85 feet;
THENCE (3) continuing along said right of way line, South ii°26'10"
West, 485.03 feet to sn angle point thereon;
THENCE (4) continuing along said right of way line, South 07°55'11"
West, 119.62 feet to a point on the South boundary line of Tract
No. 1579 as shown on Map filed in Book 7 of Maps, Page 118 in the
office of the Kern County Recorder;
THENCE (5) North 89°22'44" West along said South boundary line
(N. 89°53'10" W. on said Record Map) a distance of 121.35 feet to the
Southwest corner thereof;
THENCE (6) North 88°2A'58" West, 312.21 feet (more or less) to the
point of intersection of the East line of abandoned Alamo Street
(Co. Rd. No. 2379) and the Easterly prolongation of the South line of
the Elcia Drive Drainfield;
THENCE (7) North 88°45'52" West, along said South line and
prolongation thereof, a distance of 522.28 feet to the Southwest
corner of said Drainfield;
THENCE (8) North 03°14'58" East, along the West line of said
Drainfield, a distance of 660.61 feet to an angle point thereon also
being a point on the center line of Terrace Way (Co. Rd. No. 2141);
THENCE (9) North 88°46'11" West along said center line 11.36 feet to
the West line of the additional Drainfield property described by Deed
recorded in Book 5049, Page 559 of Official Records in the Office of
the Kern County Recorder;

Drainfield property, 120.01 feet;

Maps, Page 173 in the Office of the Kern County Recorder;
THENCE (13) South 88°48'33" East along said South boundary line

the Southeast corner thereof;

line of Elcia Drive (40 feet in width), said North line also being on
and along the existing Corporate Boundary of the City of Bakersfield;
